officers that turn up to any scene are unlikely to know everything about what happened at a scene, the first two officers are equivalent to PCSOs, which means that they have basically no power and are regarded as 'not real police officers', they could obviously have felt that the photographers were not answering courteously to some simpler questions asked by them because of this so they called on the support of the other officers. it is just a standard response because there is no radio signal that is a cry for help because someone is getting stabbed or if there is a little squabble in a street, it comes under one category so free officers are obliged to respond incase their fellow officers need help. as we can see it was just before the busy time of night in a central part of the town so there were more free officers, this support would have been much less if it was busy.

However for big commercial productions, that require streets to be closed or may cause other disruptions, you *do* need permission in advance from the local authorities (council) and to pay any applicable application/permission fees. 3 - Under UK law you do *NOT* have to answer *ANY* questions from *anyone* , even the police. Remember the offical police arrest caution states: "You do not have to say anything...", this applies just as much if you have *not* been arrested as it does when you have been arrested. Even under Stop and Search/Account laws you do *not* need to give any personal details. 4 - Under UK law you cannot be held responsible for other peoples unlawful actions (there are with a few exceptions to this - such as corporate manslaughter for instance - but none that would apply here). If someone else takes offence, and starts causing trouble, it would be *THEM* in breach of the peace, *NOT* you. PC 1 was so close to doing what he should have done, but still couldn't help himself here and there. Generally they all need disciplining and retraining about what the law is and what their powers actually are.

Oh dude... the thing is though. There's just no need to be as rude as this guy is. Whilst he's not doing ANYTHING illegal, he is being an utter douchebag. Firstly, if you know you're not doing anything wrong, why not answer the questions and educate the people who are wrong. You still dont need to give your details but you could engage in friendly conversation. Secondly, whilst you can film or photograph anyone or anything in a public place, a decent photographer would have a little bit more of a moral compass and maybe ask permission, delete a photo that someone has politely requested not to be in, be a bit discrete about it. I love street photography but no photo is really worth pissing someone off for. I'd be a bit annoyed if i was homeless or someone took an unflattering picture of me and put it in some art gallery or documentary. I know full well there's nothing you can so legally but it's just polite. Jamie Windsor made an awesome video about it on here somewhere. I fully get that if someone assaults them or damages their camera that they are still within their rights and the other person is the offender. However, they couldn't be more obvious and they're acting like arseholes. They're wearing tac vests, gopros, filming on their phone and using a camera. Which suggests they are trying to provoke a reaction or (more likely) they have been hurt or had equipment damaged before. Which is not surprising given their current attitude towards this whole thing. Those Police do make a valid point that some hard man could stagger out of a pub and not like that he's on camera and smash it up or hit them. At which point these two are gonna be calling the Police that they've just been incredibly rude to and then they're duty bound to do something about it. When really they've just had a mega dose or karma. You can be a nice person and still exercise your legal rights.
@GutS7u65 жыл бұрын
I completely agree. I understand he law regarding filming/photography in public places, but to turn to the PCSO/police or whatever and tell them to 'turn your back on me and ignore me' is just plain rude. A decent person/street photographer would just wait until the guy with the red thing had left the scene and then carried on. The guys filming here seemed to be a bit up their own arses and should have handled the situation a whole lot differently. There is no point knowing the legalities of what you are doing if you are not willing to explain/discuss politely what or why you are doing it. Most people will be accepting of what you are doing if you are open about it. And if someone asks you not to record/photograph them then why carry on? If someone asks you to delete a photo, then why not? You have lost nothing, unless you were hoping to make money from it, in which case you should really have a model release contract signed. If I had the inclination, I would do a timeline (like above) with every rude and snyde remark made by the person filming. People like that give photographers a bad name, and that will only result in less people being tolerant of candid street photography. And wearing a tactical jacket with a 'recording in progress' patch (half hidden by the go pro mount) is just like those bikers that wear vests similar to motorcycle police but theirs say 'POLITE notice' and have official style chequer decals on their helmets. The other 90% of bikers just tut and shake their heads in shame at them. Yes, know your rights, but don't abuse your rights. What is so important about filming 'that person' that you feel justified in doing so and causing them distress. It is not just a matter of what is legally right, but also what is morally right.
@00Ryder5 жыл бұрын
@@GutS7u6 I actually know the guy above and he's not an ignorant guy and someone who you can engage with. I didn't know he'd seen or commented on this vide until I looked at the comments. Pure chance really. I honestly can't put it better than Jamie Windsor, who (in short) states that whilst you don't need to ask permission and you've no obligation to delete photos we all have our own moral compass. His stance seems to be that if the a person is unhappy at being in a photo, he will delete it unless that person is not the subject and just a passer by and the photo isn't something he can replicate. I would encourage anyone to know their rights and exercise them accordingly but there's no need to be such an insufferable arsehole. They expect to treat the Police like they're beneath them but expect NOT to be treated that way themselves. It's complete double standards. If I was homeless then my pride would most likely get in the way and I wouldn't want to be pictured at my lowest point. I guess what I'm trying to say is this guy is acting like a complete C-unit whilst simultaneously expecting not to be treated like one.

@@00Ryder Totally with you re Jamie Windsor. Also, the original comment that this thread is on just seemed a bit one sided. Yes the police were OTT with the response, especially with the rise of violent crimes in our cities (I am very close to London myself) and the original PCSO officers seemed very unsure of what to do... but the main guy filming was being very uncooperative. The timeline above only showed what the officers said, and the majority of the comments on this video are just anti police and 'go for it' towards the photographer. Not only was the guy rude to the officers, but he was also muttering things like 'see what the homeless are like in Nottingham' etc. There seems no point in commenting on the 'Police jut trying to make money' etc replies as there is a fair chance that it would just end in insults. DJshadesUK has obviously watched the video and paid attention to it, I just felt that it was a biased summary of what went down, but feel that a reply to his comment wouldn't be viewed as a police loving arse licking fascist opinion (which I don't think it has). I am not a copper myself (I'm a grease monkey), but I do have family and friends in the force, one of which is a very good photographer. I am a fan of street photography (although a bit shit at it personally), and have read up on the UK law regarding it as I like to know what I can and can't get away with. The video guy was legally in the right, I agree with that... but morally wrong and then made matters worse by be being a cockwomble. Everyone commenting can't seem to see it though, as they are so focused on what the drunk guy, the PCSOs and police did wrong . In the words of RIngo Starr... peace and love, peace and love.

@@GutS7u6 exactly. Its almost pointless trying to argue with any of the comments on here. You'd just be wasting your breathe. The fact is most of the general public don't know their own rights or the law and so it angers them when people dont act the way THEY expect then to. Which leads to the Police being in a no win situation. Here's a rough example of most Policing situations: Bystander 1 "Why arent the Police doing anything about it, what a waste of time they are. Utterly useless" Bystander 2 "Bloody Police brutality this is. Were you bullied as a kid where you. You should go pick on some one else. I use to love photography but this is why I don't do it anymore. On one occasion when I was taking pictures of my own children MY OWN CHILDREN!!!!! I was approached by a women who told me I couldn't take photos of kids. She was a member of the self appointed pedo police (not to be confused with the self appointed anti terrorist squad). It's just cowardly moral positioning (I've got to be careful not to go off into a rant here). Anyway....it was me who felt violated and it left me with something I couldn't scrape off.

Sad really that the self-righteous officer at the end is almost implying that any possible drunk and disorderly behaviour or acts of assault, against you by a person, could be somehow expected because they've consumed alcohol. As for the hobo at the beginning... he needs to address his alcohol or drug dependent issues; and get off the streets.
@ELAR154 жыл бұрын
The reason why they were approached was because they stayed in one place for too long. They caught so much attention because of their camera that was set up on a tripod. I had the same experience over a year ago when I was just starting in street photography. All I did was photograph a god damn street art in a public park using my mobile phone that was set up on a mini tripod. The next thing I discovered was 2 security guards were standing right behind me asking questions as to why I was photographing the innocent and lifeless walls. That was my first and only nightmare doing street photography as my hobby.

The police were not baited into anything. They should have just told the guy that the law States he's perfectly entitled to take photographs. And one persons complaint being upheld is a thin end of the wedge. If the majority of people complained, and the police upheld their complaints, then nobody could take photographs in public.

The tit had already upset 1 member of the public by sticking a camera in their face, the police were there to try and prevent a breach of the peace. He'd be the first one crying to the police if a member of the public smashed his camera up because they were drunk and he antagonised them by filming them when they didn't want to be filmed. While it isn't illegal to film in public, it is seen as rude and poor etiquette to point a camera at people and film them without asking and just like any other bad manners some will get annoyed by it.

Typical Muppet police...a lot of the time they have NO idea what the law is...and that goes double for PCSO's..I was stopped in Trafalgar square because ( according to them ) 'you can't take photo's in Trafalgar square if you are using a Tripod...'cos it means you are a PROFESSIONAL Photographer', ( you CAN by the way...providing you don't use the images / video for 'commercial reasons' ...for that you need a permit since it is Crown property ). But the cops looked and sounded a 'bit' pissed of when I told them that according to what they had just said it meant that my 12 year old niece was also a Professional Photographer...since I had got her a tripod for her birthday!
@clickrick5 жыл бұрын
To be fair, a tripod in a busy place like Trafalgar Square would be likely to cause a trip hazard, and anyone tripping over it would have cause to sue you as a result, but that's a completely separate (and civil) matter.

Apart from myself the cops were the only other people on that side of Trafalgar square! But that's not the point, the point is that THEY thought that simply because you were using tripod it meant that you were a professional photographer...and even that makes little sense since there would still be no bar to taking photographs ( with or without a tripod ) In Trafalgar Square so long as it was not for commercial reasons, if it was for commercial reasons you would need a permit since Trafalgar Square is Crown property.

At 9’50” in. One of the police officers says “So you’re just taking pictures, there’s nothing wrong with that, but there’s no need to be rude about it.” Stop and think about this. A Photographer taking pictures in a street which is open to the public is approached by half a dozen police officers over a period of half an hour some of them tell him he’s not allowed to take photographs of people because it’s upsetting and others question him wanting to know his name, date of birth and other details as if he is doing something criminal. Yet it is the police officers who turned to the photographer when all is said and done and say “there is no need to be rude about it.” If anybody out there can you think of a better example of the pot calling the kettle black please let me know.
