I don't believe that's a fair statement based on what I've seen lately. The right to be silent and not have it used against you at least in some instances (apparently not all) had better first be explicitly, unequivocally, and directly, be invoked. In other words, by expressing words to the effect of: "I invoke my right to be silent and not answer any questions." Also, there might be the issue of potential booking questions while being booked if and only if booked.

IDK... We should support paid study time. People always say school keeps thugs off the street. I just started practucing dialysis after 10 years nursing in a different field. They paid me up to 40 hours anytime I felt like clocking in to study for 2 months. If you understand the history/funding of dialysis this is basically universal state sponsored professional education. Dialysis was the first non-drug miracle cure invented during the post new deal, space age, ascent of American Empire etc & we said "America! F YEAH! bet we'll go to the moon too! All Americans should get dialysis cuz we're crazy rich & the fruits of public funded tech advancement should belong to everyone!" So... law education for storm troopers seems equally important to be well funded.

@@nedrow0 People will pay it if it's a moving traffic violation, but when it's something like a broken tail light, the prosecutor will usually dismiss the fine (or reduce it) when shown proof the issue has been repaired.

No, THIS IS HOW IT SHOULD BE! Officer arrests/tickets you, the penalty should be established. Let's say 30 days in jail. If the person arrested/ticketed is found innocent then the officer does the 30 days!

The driver offered to go to the hospital for a blood test. That is the most reliable test for drugs or alcohol. It was the Police Officers who refused because they know he has not been drinking or using drugs.

That's because an officer has to arrest a driver on suspicion of DUI before taking someone for a blood test. Also, some states automatically suspend your DL for refusing roadside testing.

Never justify why your eyes may be glassy. Never say anything. During trial. I watched an attorney ask "what do my clients eyes normally look like? " The cop could not answer. The attorney stated and asked and gave 10 reasons why eyes could be glassy. Shower allergies. Medical issues. Bam not guilty

Innocent people think they're being helpful when answering questions, including if they'd been drinking. You are NEVER helping yourself by answering any question, including "Where you headed?". If you think remaining silent might imply guilt to a juror in court, it won't. The prosecution, including their witnesses, are not allowed to tell the jury that you exercised your 5A right and refused to answer questions. FYI, some states, including Georgia, have laws to automatically suspend your DL for refusing a roadside test. Additionally, in Georgia specifically, a driver who refuses the tests, can be forced, yes forced as in limbs strapped down, to a catheterization at the jail.

Officers nor lawyers can ask a citizen the same question over and over again in court. It’s asked and answered or badgering the witness. Why be allowed to do that on the street and it not be considered harassment?

@@saltyolbroad2962 It actually depends upon individual state law. Georgia recently passed a law making it illegal for the PD to confiscate a driver's car if the tag has expired. It was ONLY changed because a state senator was pulled over for an expired tag and had his car towed. He didn't tell the officer he was a senator until after the officer wrote the ticket and had called for a tow truck -- PD bring in huge dollars in their contract with a local tow company.. No state legislature is ever going to pass a law making policies at individual public libraries prosecutable laws. If they did, you're saying there's nothing stopping a library from banning people with blue eyes or brown eyes or tattoos as long as it's "Written policy"

When I was in school we learned that we have a constitution, but was never told what it is to us how important it is to know your rights. While growing up we are told always do what cops say, tv makes us believe that you always do as cops say. We have been programmed to obey that is why it is so hard to get people to stand up for our rights. I have listened to what has been said and researched and learned that that what you have been telling us is the truth. Thank you for sharing this with us.

They stop so many folks who don't know their rights, that I am surprised they don't cut guys like this go after a couple minutes so they can continue their road piracy on less knowledgeable people. This is another reason you're one of the top rated investigators on KZbin. You're always trying to help the smaller channels which again helps the transparency movement. I call it the movement because I pray that someday so many people will find it normal to just take out their phone and record the police interactions with themselves or bystander and this is the only way we can force the dirty cops the tyrants to act accordingly. Most of these officers think that it's okay to fat finger someone's license plate or lie about not being able to see there tail lights from the required distance or saying their brake lights are out etc etc just to pull them over so they can go on a fishing Expedition and find any reason either fine or lock them away even if it means creating a reason. How many times have you heard officers getting together and conspiring to try and find something to arrest somebody for even though there's a law against conspiracy . The true reason the Constitution or case law isn't taught in the academy is because then there would be no excuse for qualified immunity because they would already know better. Thanks for not only pushing the movement but going above and beyond.

Miranda is irrelevant in this situation. It's only applied AFTER you've been placed under arrest. What the Miranda rights are the rights at one point law enforcement was required to tell you of upon your arrest. That didn't mean they wouldn't violates those rights before or after. And I'm pretty sure reading Miranda rights upon arrest is no longer policy/required.

They'll put arrested suspects in the car with no heat (or no AC in midsummer) too. On at least one occasion they left someone handcuffed in the cruiser on the railroad tracks to be hit by a train.
