Excellent Video Sachin Ji. 1 Question - For a property worth >50 lacs, what if the NRI owner has given Power of attorney to an Indian Resident and I have to pay to the Indian Resident? Do I deduct 24% or 1% TDS?

Sir Thanks for clarifying this complicated topic in simple way. I will have 2 question related nil tds certificate. Question 1: If I have intention to invest capital gain again on residential property to avoid capital gain tax then how can this be done during Form 13 filing because the property I want buy will only be possible when I get enough money from the sale of this one? Even if in your video your example you mentioned below 12% its hard to get but is there a way we provide some declaration or Sale agreement of new property i want to buy to save LTCG tax? Question 2: Is it compulsory to have Registered Sale agreement to be provided in Form 13 or Simple or Notarized Sale Agreement will also work?

Hello Mr sachin,Many thanks for detailed video. I just want toclarify a discrepancy in your explanation and your calculation in your example given. The 24% TDS is applicable on Net capital gain/loss ,which in this case is 1.2 cr ,but in calculation of net tax rate ,you have used selling price of property,which is 2 crore ,but as per your explanation ,you should use the figure of 1.2 crore and calculate the 24% tax of this for TDS calculation. For lower tax rate deduction,what %of this net capital gain should be used for lower TDS calculation. Is it 12 %? Thanks

Hello Mr. Sachin. First of all, thank you very much for detailed video on this topic. Indeed, many NRIs are not aware of this process & they un-intentionally miss this point while planning to sell their property. I have a doubt. What if the long term capital gain after indexation comes to negative ? Does it mean there will be 0% TDS liability ?

I understood from the video that TDS will be applicable based on the capital gain & in my case there is no capital gain. So, why & how much TDS will be applicable ? Nice video Sir... 2 querries.. 1. if the there are 2 buyers then each buyers has to deduct half the TDS 2. Can we pay such high amount of TDS like you have said 48L online?

sir main ek property buy karna chahta hu, seller bolta hai ki wo nri nahi hai aur 1% TDS deduct karne ko bol rha hai, lekin wo amount transfer ke liye Indian bank account na dekar NRO account de rha hai. Sir mujhe(buyer) ko kaise pata chalega ki seller nri hai ya nhi...aur agar main 1% TDS hi deduct karu to mere upar income tax ka kuch action hoga?

Very well explained Sir. I have 2 queries, please advice: Firstly, if we apply lower tax certificate online, do we still need to present physically in front of AO once? Secondly, if NRI's PAN is not migrated to international wing yet, do we need to first get the jurisdiction changed or can apply directly to current AO?

Mr. Sachin, In you vedio you are saying for 2 cr after index cost deduction the tax is 24lacs. But buyer is deducting tax at source on 2 cr. ie 46 lacs. Am I right? You are saying 24 lacs that is on 1.20cr. Long term capital gain.

TDS is required to be deducted on capital gains and not on sale proceeds as claimed in this video. If there is no capital gain, TDS would not be deducted under section 195.

Sir, In the sale deed we need to show the amount of TDS deducted. So what amount of TDS we will show in the sale deed. because for getting a lower deduction certificate we have to provide a copy of the sale and purchase deed to the assessing officer.

Sir property sale value is 1.2 Cr from nri, if 2 buyers jointly purchasing it, then individual share will be 60K then what will be the surcharge added by each individual during tds ? Is it 10% as individual share is less than 1cr or 15% as total sales value is more than 1cr ?

As you said It is mandatory for buyer to apply for TAN to deduct TDS. can I also deactivate or surrender TAN after deducting TDS on purchase of property from NRI? because once first TDS return is filed I become liable to file return regularly for every subsequent quarter even with declaration for NIL.

Thanks Sir for such h informative video. I actually paid Advance of 2 lakhs to NRI seller and then he applied for Low TDS certification and he got the certificate. Can you tell me what TDS% Should be paid on the advance payment of 2 lakhs, which was paid before the Certificate was received? And I didn't deduct TDS on this 2 lakhs.

What to do in case if seller provides NIL certificate. Meaning the Rate is shown as 0.0 . So there is no need to cut any TDS?

Hi sir , Need your help .. my husband and I jointly buying a property from NRI .. total agreed value - 2 Cr and 9 lac …. we had paid 2 lac at the time of MOU and then 3 lac at when Agreement done.. now the seller has applied LDS so rate has come 2% .. 1 - 1 % each for total Amt 2 Cr 7 lac. Not able to understand the calculation. Why it is on only 2 Cr and 7 lac .. y not on total Amt on which we agreed .. and also what will happen to the balance 2 lac .

Hi Sir, I have one query.. if owner are more than one (2 in my case) 1 is NRI other is ROI, both are Mother and son.. On NRI share i am getting LOWER TAX deduction certificate from seller but for mother share seller (NRI) is demanding payment in his account instead of ROI co owner.. He is saying that his mother is gifting his share to him through gift deed hence mother share directly to be received by NRI is not subject to sec 195.. so shall i deduct TDS under 195 for the ROI share to be paid directly to NRI??

Hi sir, Nice video.. Just one question how tds is applied in case of 3 seller(mother,father and son) and if 2 seller(mother and father) is in india and son has moved abroad for work and has pan card in india. Father has GPA on behalf of son. All transactions will happen to fathers account.

There is surcharge of 22.88% for one of the slab.if advance TDS is deducted 22.88% and by investing in LTCG investment option we make LTCG 0 then we can take refund of all advance TDC by filing ITR but in this case what happen to additional surcharge 2.88%.is 20% or 22.88% TDS is refunded in case of if effective LTCG is NIL?

Sir if the if the transaction value of the property is more than 50 lakh and is bought in joint name under 2 TAN Number by single Seller who is an NRI than will the TDS percentage either 20 % as in single TAN it will be shown as 25 lakh each and the TDS percentage will be 20.60% or it will be 22.8%. Sir needed help , I was looking for a property where there are two owner joint , one brother and another sister , as per sister brother lives in another state he has aadhar and pan and aadhar has same address of the property which we are purchasing , now as per Sister brother will give power of attorney and other legal deeds to sister so I can pay all amount so Sisters bank , am not sure if brother is NRI even he is not mentioning it , he says he can have 50% in his Indian Saving account , I'm having some confusion as I think his brother can be NRI , what can be done in such cases

Sir I have 2 queries 1. My brother is NR with OCI holder. When he got PAN many years back status was of resident and address shown in India. Now he is NR and address is of abroad. Should he surrender this PAN and get new PAN or apply for correction in this PAN? 2. Property was acquired by mother in 2013 and inherited through registered will by brother in 2022. If he sells property now, Period of holding property for brother will be from 2013 or 2022, treatment of capital will be LTCG or STCG?
