She doesn't have to agree. Her job was to defend the dictates of her boss in court. Lawyers often get hired by people they know are guilty, but they are required to defend them in court all the same. When she refused, she should have stepped down. That she didn't, and was forced to be fired instead, speaks volumes about her character.

h8; the first job of any public official, is to uphold the constitution, not to defend whomever hired them. The US constitution does in fact apply to immigrants entering the country. On a purely moral level, the founders believed that ALL MEN, rightfully possessed certain rights and among those rights is the right to not be assumed guilty of a crime, absent evidence of guilt. Is there some part of the word ALL, that you do not understand ? I understand your desire for our nation to be a safe place, but we as a nation, have been warned of the consequences of prioritizing a little security, over liberty. Did you miss that memo, or are you just a partisan hack, who will throw all principles to the wind; even constitutional principles; in defense of political party ?

Alex Perez you do realize that your sentiment that the Constitution applies to immigrants entering the country has nothing to do with, and has no bearing on the president's authority and responsibility to lead the country right? things like the specific power to govern and protect the country utilizing the resources and information available to the president, exist so he can actually do the job. Is it truly something you don't understand, or is it just more liberal dishonesty? Truly, I am perplexed. Sally yates' argument is ridiculous. it's tantamount to stating that the president cannot declare war, or sell nukes to iran, or enact sanctions against a truculent nation, because somehow our Constitution grants it's citizens the right to come here . The moratorium on allowing a specific group to enter America exists as a tool of national security, as a soviergn nation we exist by identifying threats and dealing with them. Regardless of who or what may be a threat at the time. was America's entry into WW2 an invalid ruse to discriminate against Shinto and Buddhists whom might one day wish to come to America? yeah... immigrants, once properly vetted, and in accordance with our laws, cannot be discriminated against, that in no way grants the global populace some right to come here. if the president deems you a threat, you can't come, that's it. once whatever threat diminishes and the moratorium is lifted, you are free to reapply to emigrate here. it's so simple even a leftist should get it.

James Guilford You're assuming a lot of things. For starters, I'm not a Republican, so don't bother calling me partisan. Secondly, the Declaration of Independence is not a legally binding document, but a statement of intent. Further, you're taking two documents, the Declaration and the Bill of Rights, and pretending that arguments in one are meant to hold up the other on a worldwide scale. The US is not the policeman of the whole world, and we can't go to every country to ensure they give their people a fair trial. The idea that our founding fathers wanted indiscriminate immigration into the US is so far fetched that you might as well say that they wanted to return to a monarchy. Alexander Hamilton: "To admit foreigners indiscriminately to the rights of citizens the moment they put foot in our country would be nothing less than to admit the Grecian horse into the citadel of our liberty and sovereignty." Who is giving up liberty on this issue? I'm not. No other American Citizen is being asked to. I do agree that the order went too far in asking that US Residents on Green cards be denied entry, but show me where the Bill of Rights and US Constitution declares that free movement into the USA won't be infringed. As far as Franklin saying "those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety." You keep using that quote. Even better than these clips from the hearing shown in this video, came right at the end of Cruz's questioning with Yates when he asked her (in his usual smug, overwrought demeanor) if she was aware of any other time in history where the department of justice was ordered by the attorney general not to defend an Executive Order that DOJ's own office of legal counsel had already determined to be lawful. His expectation of course was to catch her off guard and force her to admit this hadn't happened before in history, and she freely conceded as much, that off the top of her head she could not recall such an instance, but then she said she also could not recall an instance in history where the White House had directed the office of legal counsel to withhold all information and details about a potential executive order from the Attorney Generals office and other top Justice officials until after that order had already been issued. She only found out about the order after seeing it in media reports. Her clear point being that all prior attorney's general were able to voice their concerns and recommend changes to an executive order to make it more legally sound long before it's ever issued, something that did not occur hear (where the White House was actually doing the opposite, in hiding the order from the AG).

Duck Speaker I'd be willing to bet that if you're so easily presuming that people don't understand a basic conversation about constitutional laws then you don't understand it either. I'd also be willing to bet that the majority of people with even a middle school education can at the very least follow the debate enough to gather all the relevant information and take a side based on that information. I can make this bet because I'm just some dumb student from the UK who doesn't understand the majority of UK laws or politics, never mind those of the US, but I easily followed the debate going on here and was able to make an informed decision that Ted Cruz did indeed get schooled.

Cruz brought up the law that authorized the executive order, and Yates did not recognize it. She then answered by referring to another law, which does not supersede the first. She then tried to argue that the order was unconstitutional, but Cruz pointed out that her argument was a partisan one, driven by her own policy views. She then claimed no court would enforce the order - which is contradicted by the fact that one actually did.

Sally said she doesn't care about what one law says, because there is another law she thinks is more important, even though she agrees that the legal office ruled the authorization legal, she says she looks past written law and can read Trumps mind. Not what he wrote, which she agrees is legal, but she goes to what he was thinking which she FEELS is illegal. She reads his mind and knows it is thinking bad thoughts. If you think this is destroying Ted I would say it destroys her respect for the law, which is her profession. Most Senators at some time leave the room after their turn, that is normal. They have other things to do. Time for you to use your good sense and think about what is happening. I'm not crazy about Ted Cruz but this is not his destruction, it is closer to Sally destroying herself and her profession. The law is the law you can't judge by mind reading.

she is totally out of league. she is not a supreme court judge. if she had ethical problems with the directive she had two legal options. let it be known that she had a problem with it and then enforced it, or resign. she did not have the right to overrule the legal direct order from the president. period
