The first reason given sounds so petty .Looking forward to the written judgement.I have no doubt that Ms. Burke was wound up,and understandably emotional in the circumstances,and perhaps a better admonishment might have been applied.But,to cancel such an important case on those grounds is reprehensible.How was the judge,Marguerite Bolger,allowed to claim that there was no reason to recluse? She maybe wrong. Who checked her in case there were indeed double standards? This comes across as (please excuse the vernacular,) a cop-out.

Can the Burke keep bringing cases to the various courts at minimal cost since they are barristers or do they have to pay for the court? If they have to pay, what kind of costs are involved?

In the army, that is known as 'Conduct Unbecoming' & 'throwing the Armed Forces intio disrepute'. Is there not similar legislature for Solicitors/Barristers ? The Matriarch too, has a gob on her. Such disruption, I would have considered be vetoed, albeit instigated by Miss Burke in both the call for the application to be heard by the court, & ,to (courteously) allow the other side(s) to make their case. That it has been dismissed is wholly unsurprising, &, I suspect that the Labour Court will come to a similar decision when it is convened. Everything that the Burke family stand for is the antithesis to common sense, dignity, & sober demeanour. I'm sure there's a large enough Islet off the coast of Ireland, whereby the entire Burke cabal can be deposited with supplies dropped by parachute, monthly. It would help, Mr. Browne, if you could at least spell Burke's name correctly - proof-positive that you were not paying attention in ,the first instance; as to your assertion that the Judiciary are corrupt, then I suggest you review the entire Burke vs State cases. Each & every opportunity was afforded this family by the courts - & with with two members of (that) family being lawyers, rather than working thru' due process of law, they elected to shout down, not only the Judges, but opposing counsel too. Are you seriously trying to suggest their behaviour, reasonable ? In regard to your point on "Gender Identity", Burke's own gender is not at issue - rather, it is his reluctance to acknowledge another's gender specific rationale, &, for a family of devout Christians, one of the first edicts of their bible is to promote kindness, compassion, & egalitarianism - & under that 'umbrella', respect for your fellow humankind. I suspect you're either incredibly young, naive, & ideological, & as such, know little of the machinations of legal infrastructure. When you can present a cohesive argument, then we'll discuss the matter; currently, you're ill-equipped to argue the case, because clearly, you're not fully acquainted with all the facts.

Might very well be a empty feeling of knowing that they can never return to those occupations they desperately tried to protect and that life has moved on and they are still fighting an old war in the same manner an old military general is fighting yesterdays wars. Hopefully the Burke family costs do not come from the public purse. That family should be banned from courts unless they sign up to following proper procedures with respect to all concerned. I do not think that judgment was correct. Abuse of process was not a valid ground to dismiss the proceedings in this case. The evidence and arguments should have been heard in so far as possible and the case decided on the basis of that evidence and the arguments. If these were lacking or deficient in some way and the court did not have sufficient before it to find for the plaintiff because of the behaviour of the plaintiff that should be the basis of the decision. The case should have been looked at on its merits in so far as these were apparent and decided on that basis. I have to say that these types of cases are always very badly presented and the plaintiffs usually lack any understanding of what is required in terms of procedure if a case is to be successful.

If Ms. Burke had been able to remain silent long enough to listen to the solicitor for the company she use to work for, then her case would have gone ahead. But, when you disrespect the Court in this way, she knew what was going to happen. She has, after all, studied Law.

@@johnduggan8656 Isn't she a solicitor ? Lesson on day one, you must instructe your client to respect the Court. And what did Ms Burke do ... she disrespected the Court, by constantly interrupting the Court proceedings. So, she she was fully aware of what was going to happen when she interrupted Court proceedings. The Burke's crave public sympathy, it's their go-to tactic, but it has never worked on the Irish Public, because these people are renowned for this type of behaviour.

@@fionafromireland1054 Yes she is a solicitor and should have known how to properly present a case, more so in the WRC. My point is that the court should have decided the case on the merits as apparent (or rather not apparent) to the court as a result of what was presented (again, or not presented) to the court. The judge could have said “I have no evidence before me as to ……” or “No argument has been presented to me which I find persuasive…”, “Therefore, I am finding against the plaintiff”. I suspect she simply reacted to the behaviour of the plaintiff and then had to reserve judgment. I agree Ms. Burke may have intended this outcome all along in order to generate publicity. There appears to be no other explanation for the manner in which the case was presented.

@@johnduggan8656 The Court/WRC works on the grounds of mutual respect. How is a Court supposed to proceed, when the claimant (ms Burke) continually interrupts these proceedings. Well it couldn't ... but, do you think the Burke's would be able to accept this. Their belief is, there's a law for us and a law for everyone else.

Arthur Cox dismissed Mz Burke because of her family's activities...she wouldn't renounce her family publicly before the WRC ,,who would have had to give her the decision ,, remember Cox employed this type of unorthodox solicitor in the first place ... something that has gone missing in all of this ...constructive dismissal aside ,Arthur Cox has abused the system as he had every intention of using this type of unorthodox legal counsel in his law firm and setting them on the public.

This case was notable because it is quite common for lay litigants at the WRC in particular to engage in obstructive and disrespectful behaviour. The ruling is important because it affirms the rule of law in the administration of justice is paramount. You may be 'obsessed' with coverage of this family's conduct but the things they're doing are worthy of coverage because this behaviour is precisely the sort of post-truth, conspiracy-based, solipsistic nonsense that's poisoned the well of public discourse in countries like the US and it must not be tolerated here.
