The fourteenth amendment says the state can take away your life, liberty, or property only after due process of law. Taking away liberty in this context means put you in prison. It’s so obvious that this is a procedural guarantee and not a substantive one that I’m amazed lawyers can honestly think otherwise

Thomas is right. Any decision based n the oxymoronic doctrine of substantive due process should be overturned. They won’t be though
