In a case of murder it was found by the investigators that son killed his father because of lunatic. Yet the police did not add S-84 of I. P. C in the charge sheet. Are the police prohibited by law from using general exception sections in charge sheets?

Yes, certainly they can file charge sheet under private defense proviso. Some how similar situation of private defense was already dealt by our HONOURABLE Mr. JUSTICE S.NAGAMUTHU in Crl.O.P.No.17837 of 2012. In the matter of "Ms.Anuj Jermi vs State By Inspector Of Police, T-14, Mangadu Police Station, Dated: 01-08-2012." Very excellent judgment.💐

They are defenses to be taken by the defense side only during trial. Alibi, insanity, lunatic, under the influence of alcohol, private defense are all a matter of evidence to be seen during trial. They cant be considered even under a petition filed under S. 482 of crpc before HC.
