Firstly,the way & the manner in which Mr.Malhotra has described,for the moment I thought he is a civil service aspirant😊....he explains very precisely & in a pointwise manner 😊 Secondly, According to my view the problem is not the weeding out the frivolous litigants but to distinguish between genuine & frivolous litigation.Our legal system is such,that for giving justice to one inocent person we let hundreds or thousands of convict go away..I think time has now came to modify some changes to that along with solving other problems as the panelists suggest

Pendency of cases due to, less judges population ratio, insufficient infrastructure, frequent adjournment of court proceedings,pil for publicity and technology glinches. Judiciary is a slow learner, genuen litigant suffers, justice is delay justice is deny. Wayforward -fullfil judges vacancy, special Court, resolve techno glinches, impose heavy cost against froud Pil.

There is urgent need for police, investigative & judicial reforms without which a civilized society worth its salt can not progress. Edward Luce who travel to India for 5 yrs observed : “the biggest problem is the gigantic backlog of suits in India, which in 2006 amounted to 27 million cases. At the current rate at which India’s courts wade through proceedings, it would take more than three hundred years to clear the judicial back log. It takes as long as fifteen years for some murder trials to be heard. By this time many of the witnesses are dead and most of the rest cannot remember much that would be admissible in court. A very small proportion of criminals is convicted. There is also an economic cost to India’s slow-moving courts. Almost $75 billion in capital is tied up in legal disputes. This would amount to roughly 10 percent of India’s gross domestic product in 2006. All that is tied up is money that could be invested in jobs and growth”. ( “IN SPITE OF THE GODS THE STRANGE RISE OF MODERN INDIA” Edward Luce, Doubleday Publication, NY, 2007 p 93-94) Luce further writes : "Almost 100 of India’s 545 members of parliament in New Delhi have “criminal backgrounds,” which means they have been indicted for one or more crimes, but not convicted. Once they are elected, it is virtually impossible to convict them, which is one of their main incentives for entering politics in the first place. In turn, the wealth and the muscle power of the mafia dons gives an incentive to political leaders.....to adopt them as electoral candidates". …”When the gamekeepers are poachers in disguise, why should anyone else take the law seriously?”

Issues: manpower ,infrastructure, resistance to adopt technologies, frivolous pils etc. Solutions:fillip the vacancies ,improve infrastructure by making judiciary to learn faster from the new developments and world best practices and take optimim benefits from specialized courts,adopt technology along with hybrid model of court ,fines penalty should be imposed on the party of guilt in case of frivolous pil and system should be developed by taking the help of machine learning and AI to reject automatically such pils and address the relevant ones.
