A brother wishes sister will share the responsibility of his parents, but unfortunately a husband doesn't prefer wife to take care of her parents in any way. They expect only a one way flow of dowry, gifts and lavish marriage . Ofcourse, I do not want to generalise the gender, it could be the guy, his mother anyone having these views. Society needs to change.

@jyo it is the women who leave home after marriage to live with inlaws. It is the men who take physical and financial care of their parents. In our culture, woman's parents wont even accept a penny from married daughter. It is the son who has to pay for his own marriage also, and also all the debts that parents took for sisters marriage and all the rituals throughout life. Because parents think their daughter is too delicate princess , and they should not take anything from her. They think son is superman and he should pay for everything whole life.

@@Rahulpriye that's what I am saying you got it all wrong. The question is what is going to happen with the ancestral property. Who is going to take it? Everybody wants more money and nobody wants to let go what is there's. It is never about survival. Will people start donating their property when they are going to die? What if father wants to give all his property to only one of his children even when all his children are settled. Will the other children have no right? And if they have what is it actually? It's never about survival it's about your right and what is yours.

just because hindu civil laws are codified, we get these progressive judgements and interpretation as days goes by. within a generation entire hindu society may be reformed. It is high time that Uniform Civil Code be formed, so that all religious laws are codified and 'rule of law' enters as aspects of our lives, as Jawaharlal Nehru said, "democracy is a way of life."

@@ranitbiswas680 what my concern was that through this law the public should get more sensitive towards women rights and not misuse it and there should be some precautionary guidelines in this law stating strict actions of its misuse eg. The law has been violated as I mentioned in my first point so that this law cannot be used as a tool but rather a path where there is no looking back but to move forward with it.

The law should now look in to duties of daughters. Every right comes with a duty attached to it. Law should insist that daughters also take the share of taking care( physically,, financially, emotionally) of the parents in old age. Otherwise this law is not a balanced one. Rights and duties should always go together.

@@nehamegharaj388 I get the sarcasm in your write up. All I am saying is, any right should come with duty. It is not about parents staying at daughters place, or taking money from her. A lot of effort goes in taking care of elderly people. ( I know this first hand, I have taken care of my bed ridden mother for years, and I am with my mom in law who is 90+.) It takes a lot of physical, emotional and financial difficulties. Daughters helping in some way or the other must be mandatory if they can claim equal rights. And what is wrong in staying in the daughters house? Isn't she born out of same womb as her brother? The son in law must agree if he wants his wife to get her share of parental property.

he Hindu Succession (Amendment) Act, 2005 (39 of 2005) was enacted to remove gender discriminatory provisions in the Hindu Succession Act, 1956. Under the amendment, the daughter of a coparcener shall by birth become a coparcener in her own right in the same manner as the son. The daughter shall now have the same rights in the coparcenary property (ancestral property of the Hindu undivided family) as a son. This amendment also repeals Section 23 of the Hindu Succession Act which disentitled a female heir to ask for partition in respect of a dwelling house, wholly occupied by a joint family, until the male heirs choose to divide their respective shares. Section 24 of the Act which denied rights of a widow to inherit her husband‟s property upon her re-marriage has been repealed. This Act has brought about a central amendment which is applicable to all the state governments. aug 11 judgement had given by retractive manner .. thanks do covertion about the hindu successive act 2005. but this district court will meet more plea cases ... 😊😊😊😊😂

My father have 3 sisters one have american citizenship and other two are married and govt employee and all of them agreed to my grandfather and will accept whatever he gives and on this faith he never willed anything and my father start his business on our ancestral property leaving the portion given to his sisters and now from 2013 when they saw my fathers business is growing they are claiming equally which will include my fathers business which he setup on his own ,what about this situation because if so happened our source of income will be taken away how will our family survive how we will pay our depts doesn't it count under fundamental right of article 21 right to protection of life and liberty becz that business is our lifeline without that we will be bankrupt my brother and me and parents soly depends on that why this kind of situation aren't taken into consideration.Becz my father on faith started his business and even leaving out the portion my grandfather promised to his daughter's and about my NRI aunt how can she claimed property when is not a citizen and my father pay tax to this country and a responsible citizen and what about our right my father do not have any job how will be afford our academics .

Dowry was only abolished in 1961, it was legal before. Hindu succession act came in 1956. What happens if daughter was married between 1956 and 1961 and dowry was given for marriage? Daughter gets both dowry and inheritance but son only gets share of inheritance. This might be case of disadvantage for sons. Also, will the gifts given to daughter in marriage also count as part of inheritance or will she get equal share of rest of property might cause contention in courts.
