The Supreme Court declared that adultery is not a crime and struck down the anti-adultery law, saying it was unconstitutional as it dented the individuality of women and treated them as "a personal possession of husbands". The apex court's five-judge Constitution bench was unanimous in striking down Section 497 of the Indian Penal Code dealing with the offence of adultery and holding it as manifestly arbitrary, an archaic law which is violative of the rights to equality and equal opportunity to women. A five-judge bench comprising Chief Justice Dipak Misra and Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra said that unequal treatment of women invites the wrath of the Constitution. Adultery was punishable by a maximum five years in jail or fine or both.

Some men are panicking that they won’t be able to exact revenge from their wives now. Some women are panicking because they also wanted this revenge tool. Both husband and wife would’ve have then gone about putting unmarried third persons in jail while still fighting each other in their home. Then surely the children would’ve received very good parenting. The institution of family would’ve been awesome.

Kudos to Aishwarya Bhati. A very positive submission and the way she elucidated the very idea of gender equality as "letting the women just go about their day without the patriarchy acting as shackles" sums up the whole idea for everybody.

Damon Salvatore Adultery is still considered a civil wrong , it has just been decriminalized. There were lots of dubious aspects in this section 1. The man who had intercourse with a married woman would be taken as the offender and woman the victim, this was done to save the "institution of marriage" as if the woman would also be charged then she would have been jailed too, hence destroying marriage. (Discriminatory against the man to be treated as the only offender) 2. If it was done with consent of the husband it would not be considered adultery , reducing the woman to somewhat a private property of the husband (Gender subjugation , woman subject to her husband's will) 3. There was no mention of the husband being indulging in Adultery. For example the husband has intercourse with a prostitute or unmarried woman , he cannot be charged, this was also done to save the "institution of marriage" because if the husband is jailed , again the institution would collapse (Gender Discrimination , Men Immune any criminal proceedings, can have intercourse outside marriage not subject to woman's will) 4. Violates Article 19 & 21 . Any Adult Person can have Consensual Sex with another adult (Even of the same gender after decriminalization of 377). By committing yourself to a marriage , a person doesnt give away his or her's fundamental rights of expression & life. SC has given a very apt judgement. Adultery remains a civil wrong , He or She can go to the court and get a divorce if their spouse indulge in it

@Pooja Nayak Maam you made a good point which I realised now but in my opinion also for a society like India where we had so many laws on rape but even then they are increasing and needed to introduce more strict laws , I believe we need to develop fear among masses. For ex,traffic laws with paltry penalty I doubt how effective they would be. A failed marriage because of criminalization and PUNISHMENT can atleast set example for the local community. I maybe wrong but just fear of divorce is not good enough for most Indians to save the structure of family culture. Of course what I say depends on conviction from legal system but atleast have enough penalty if convicted.

@Pooja Nayak wonderful point sister, I totally agree not everyone has the luxury to afford a divorce, I totally understand the point where people want to criminalise it but as you said if we have to criminalise aspects related to marriage then it's a weak institution in itself, having said that I do believe there should always be a provision for criminalization for habitual offenders.

Important points:- 1. Evolution of supreme court itself with respect to interpretation of laws over time 2. Marriage being a civil contract should be dealt in proportionate manner 3. Vishwas Meena He focused mainly on the sanctity of the marriage. He argued that while striking down the section, there is a possibility of downgrading the value of marriage. In our society/culture marriage is a sacred institution which should be perceived as so. And if we malign the institution by adultery it should be a criminal offence. Instead we should have done something to further strengthen the sanctity of marriage as a institution or practice. This is what he told.

Judges are learned persons. They have years of experience. This is correct judgement. Without knowing facts, with out reading 243 pages of judgement it is not right to comment. Let Judicial System do their job for the betterment of Society.

Why people are getting this decision wrong, SC just made Adultery a civil offence from a criminal offence. Marriage is a civil contract and Adultery should be seen as a civil offence. SC didn’t allow Adultery, it just stuck down IPC497

I think Saurabh , one probable reason is tha we think in our mother tongues and for my mother tongue it has no seprate word for ideas like illlegal,criminal and civil wrong. This causes confusion.

Satya Prakash has given some nice points. The sanctity of marriage depends on loyalty. Marriage as an institution should maintain a social order. Criminalising only a third person that too only if wife doesn't seek consent is archaic. So there's a provision for divorce on grounds of adultery. Merely criminalising the other side doesn't seem the solution for granting equality. Thus in my opinion it's a good judgement in accordance with article 14 and 21.

PLZ take back this law or else sons will stop respecting their mother. It will be confusing for new born babies to figure out who is the father when they grow up. Who is the supreme court to decide whether its criminal or not if my wife makesout with someone with/without my consent. This is not a courts job to make someone behave in a certain way. A marriage is a RELIGIOUS UNION of a guy and girl. If our constitution is too complicated that it cant invoke the religious teachings then fine, make equal laws for the man and women--- ADULTERY SHOULD BE CRIMINAL FOR BOTH MEN AND WOMEN. Where have we come , what days we will have to see. oh god. DAYS OF HUMANITYS END IS VERY NEAR. We all should read or watch religious videos for a few minutes per day - these issues will go away for sure. Peace.

CJI Deepak Mishra ji as the CJI will be remembered as one of the best CJIs of India. Many important judgements came during his tenure. It astonishes me that opposition parties were trying to remove him from the office a few months back.

This verdict of Chandrachud that marriage does not bind a woman or man from being sexually promiscuous is the major issue. At one commenter stated why not take a divorce and then have extramarital affairs, but staying within the confines of marriage and insulting it?

Keep aside this law ⚖. First : When any man or woman will indulge in adultery? Most commonly only when he/she is not happy within the marriage ⚭ and is not able to fulfill his/her physical desires. So, of course adultery is not a cause of Divorce ⚮ but a consequence. Sanctity of marriage is based on intra faith and not on these laws.

What is this! -Adultery is not a crime.Are the judges out of their mind ?I think they have only the degree to be a judge. They don't know the real meaning of education.That is reason they are passing this law.Are they trying to encourage sex .I agree that discrimination must be removed.But by encouraging sex is not going to solve the problem.It is going to help increase more on social crimes like suicide, rape,killing his wife or husband.Their view is very narrow.They are considering only on few families.They are inviting more bloodshed.They should learn the Bhagawat Gita or any other holy book and must seek the true moral character.Passing this law means a husband or wife can have sex as many as they like with many other man or woman.With this ongoing What will happen when a husband have sex with their in laws and have child .Who is going to take the responsibility.Same condition is also applied to a wife also.This is going to encourage sexual relation between persons related by blood.Are they able to welcome a friend who going to have sex with his wife in his house?If yes do it to your house only .Don't pull others to follow you in your crime and sin.Lets assume this law is accepted then one general question is that "Who is your father?"Is the answer going to be" I don't know or it could be anyone or you."Let's leave all this out and let us look on the more important question -What consequences can it bring? =)1)Trust between a couple will be broken. 2)Every opposite gender is going to look the other as a sex object. 3)Increase in the social crimes. 4)Marriages will going to have no meaning. 5)Increase the number of homeless child. 6)Deteriorate the foundation base of a home which will deteriorate the future pillars of our nation. 7)Increase mental disability of both genders as well as their children. 8)Respect between the members of a family ,among elders and young,among members in a society. 9)Suicide ,torture,revenge and oviously divorce. 10) It will provoke youngster to perform such act. Are we animals ? If yes ,why do we are call as human beings?Are they sold out their souls to the evils?Such an act can be done by only those who soul is enslaved by evil and don't care for their . responsibility towards their family members and to the nation.Lastly ,please learn the true meaning of Dharma and what functions do religions have in our society.

Straight to section 497 IPC If Adultery is a crime then there should be same right to the wife to give a legal knock as husband can do? Probably, your patriarchal perspective will never allow to say "YES" here. If you are saying - " It should be and that deceived wife must have right as her husband have, because marriage is an institution where both contributes the same." It should be abolished or amended as prescribed above.

My Arguments on verdict on section 497: I request Honourable SC to look back on its verdict on 497: Instead of removing 497 section, better, it would have done both are culprit. Because now both are free, I mean according to new verdict - They are not guilty, If they do whatever they WANT, in between the FOUR WALLS, bcz that's PRIVACY MATTERS! Let's see 1.Person now goes to SC claiming that he interested in Animal; will it allow him? It is also privacy nah?! 2. Another one will claim I'm interested in INCEST , will it allow?! Modernisation, privacy, liberty means, not doing whatever we want....The progress must be in constructive manner, not destructive. That's why we have tradition, rules, regulations, and laws. We must respect them and follow them.(Ex. Traffic rules) If it goes like this-I mean decriminalising criminals-there is no bound between Husband and Wife. By making culprits, may lead them to think twice or thrice about what they are going to do... May also stop them committing that. let's say at least 50%.That feels good nah?! See, Swami Vivekanand said "Person with rules may commit 100 mistakes, instead doing 1000 without rules" Mind you-Talking about modernisation seems nice, broad minded, but when it happens to us or our loved ones ; then the real feelings exlopres... Choose yourself which is better 100 or 1000? Let's see....

I think what supreme court has given verdict should taken in the spirit explained at 21.25 - 22.00 min. It still is a social sin.but we can't put someone to jail for that. In that case the couple should settled on divorce. But as rahul ishwar said we should educated the families to upheld the sanctity of marriage.

i think this verdict will be modified in future becase it violates art21 live with dignity..how..?,answer...if wife commit adultery then husband can not live with dignity in the society and vice versa...........my sugestion is that it should have criminalised both men and women who are commiting adultery rather than removing it............you can not bring logic and rationality all the time...

क्या कोई मुझे यह समझ आएगा कि इस तरीके से अब चोरी करना अपराध क्यों माना जाए क्योंकि कोई व्यक्ति जो कि भूख से व्यथित हो चोरी कर सकता है जो कि नैतिक रूप से सही माना जा सकता है । इसको भी राइट टू लाइफ के अंतर्गत रखें आईपीसी की धारा से बाहर किया जाना चाहिए।

It's not practical to punish women. A lot of times women just claim they were raped instead of admitting guilt. Also the husband might not file a case if he already has children with his wife. What is the use of a law if it is not used? However, they could make it reciprocal i.e. a woman can also file a case against other women who sleep with their husband. But I doubt if MPs will pass it, since they (being rich and powerful men) are also prone to committing adultery themselves. But keeping marriage aside, PATERNAL CERTAINTY is an issue only for men. If 10 years after having kids, you find out they are not yours...your life is irreversibly spoilt (esp. in Indian context where second marriage, that too at a later age is too difficult). Women don't have that problem. They should have kept the law. P.S: What is with the 'if I can't have it, you can't have it either attitude'?!

In 2010, a pending case of IPC 306, was filed by the IPC 497, where a married police ASI promises to give a Police job to a another greedy married woman, and continuously forced to her father-in-law to commit suicide by threatening the IPC 498A section, then what law protected the victims? Who is the responsible for broken family? One couple believes in marriage and another is unbelieving in that respect, then who is responsible for that?

quite a good question. I also have the same doubt. My opinion - if a wife is convicted in adultery she should be liable to pay the alimony to the husband in case she is earning just like the husband or has the property on her name. If women can have the same rights in property like husband she should also be liable to pay alimony to her husband in case her conviction in adultery is the base of divorce.

Supreme Court is hailing towards more liberal prospective in recent times ( Section 377,triple talaq and now Section 497) which puts more and more responsibility on the morality of citizens. In today's society , women are more liberal and truly complement the male side in all aspects. That's is what society is supposed to behave.There should not be worry about the fear of loosing Indian Values as now the onus is now on citizens to protect Indian ethics and culture.I think marriage should not be dealt with perception of adultry as there can be many other ways for broken marraiges. Notwithstanding, adultry continues to be civil offence just it is removed from criminal offence.

Marraige is a social and civil institution and already adultery is a civil crime. Then why people want to criminalize a civil offence. Verdict is in right direction coz the punsihment should be as per the intensity of crime which in this case is of civil in nature.

I dont understand why feminists are celebrating it? Is it just because wives were considered property of husband? For that law should have been made gender nuteral. Everybody, these panelists, judges, just keep yourself in that situation and imagine your wife/husband indulges in adultery and all you can do is just walk away from marriage. All the emotional and financial investment that a person does for years go in vain, social stigma associated it in Indian society, mentally person feels cheated and carries it for rest of his life. All these things have no value? On the other hand your partner, man or woman, who broke the marriage can move on with new partner and live happily.

Indian culture in matter of marriage is very sacrosanct and different from rest of the world so rather than strucking down adultery under section 497,it should provide both spouses equal power to bridge the gap of equality under articles 14,15,in my personal opinion, because it would have positive disciplined implications on society, because without mutual loyalty there is no any importance of this relationship, jai hind

If wife is not husbands property than why should husband give maintainance....people maintain there own property not some one elses property .... now court is saying both are equal than why only man give alimony after divorce

One further progressive step taken by progressive sc to get out of shackles of patriarchy,which is engrossed in our society due to some orthodox age old practices. Each co-panelist have raised some fundamental issues regarding judgement. Mr Jaiprakash - Rightly pointed out that there is ambiguity in chandrachud's judgement regarding sexual autonomy. Mr. Prakash rightly said sanctity of institution of marriage should be upholded otherwise it would create chaos in etho's of India. Rohini - Rightly pointed out that why women even in The 21st century (the so called liberal nd progressive century) should demand reservation for her nd equality.It is the govt. Of the day nd especially it should come from civil society as a whole. Govt. Of the day should uphold fundamental rights of women nd adhered to directive principles rather than to personal nd political interests. Govt. Alone can't do everything it is the responsibility of civil society to rationalise their thinking,built scientific temper nd it is their fundamental duty to do so. Nd govt. Accountable. Mr.Rahul - Rightly said that institution of family should be protected but not at the cost of women dignity nd equality. To create awareness it should start from home, penetration of education in rural areas,etc. Acco.t o me, India is the most liberal country in the world.

Adultery is some what right to privacy. Not supporting adultery, but the verdict is right, if two consenting parties indulge in an act what harm is it to the society and yes when it comes to marriage it is wrong, but we should just keep in mind here that it won't be treated as criminal case but surely as a civil misconduct. After all we should always respect our better half. Please correct me if I'm wrong at any point.

This judgement shows judges also in India are still affected by long period of SLAVERY. We are still following west blindly. Concept of united family destroying, another step to break further the smaller family. Now the culture of stepfather, stepmother, single parent or unpleasant relationship will prevail, future of children is kept at stake for fulfilling the sexual desire of man or woman. Government should bring law to criminalise adultery for both. I request u Frank sir if u could communicate this to rajya sabha MPs or government of india

Welcoming decision but we need new law to protect the institution of marriage .law assured people who are within the marriage not have autonomy to have relational with outsider both. Some people are saying rahul eshwar is right . what is they saying wrong. Try to understand what they saying . rahul is only person who represent other aspect and concerns not like other panelist just say right right.... They try to elaborate What's next to be done and make debate diversified .learn to respect other thought what you don't like.

It's implications depends on how individual will take it forward, without knowing sanctity of institutions like marriage and family, simply going by SC judgement blindly without using one's consciousness is danger and leads to disorders. If you see the verdict on fundamental rights perspective it is very welcome. It will leads to gender equality. One must excercise his or her consciousness to draw the line... 👍 Yeah it is only a civil contract, so no criminality is acceptable.

Is possible to broadcast episodes dubbed in Hindi too...??? As the show The Big Picture is outstanding, but most of the people who wish to see, are unable to watch/ understand the show just bcoz language. Also the prime importance of the show is to share knowledge of our citizens among most of those doesn't understand English well. Its an request to think over point & implement if possible.

The verdict of Supreme Court to struct down Section 497 of IPC and 198 of CRCP is a move towards equal and just future. Marriage is an intuition of sanctity and trust. It meant for the happiness or greater good of individual and society. Monogamy is the most beautiful concept in this. On the basis of gender equality as per article 14, no discremination on ground of gender, caste, religion etc., Right to privacy as per article 21 this is a logical decision. Institution of marriage can be saved only by teaching moral values or impotance of this to run a civil society to children in home and school and adults in college and homes. In conclusion this can be said that decision of court is a right step in right direction to make our society more liberal and fundamentals rights of an individual are of utmost importance.

These judges and activists have nothing to quote from indian philosophies on women related issues as if indian culture has only promoted discrimination against women. Even i remember a line of 8th class sanskrit textbook :यत्र नार्यस्तु पूज्यन्ते रमन्ते तत्र देवता:।(where women r worshipped,gods reside there). Rather than western nonsense of gender , they should try reviving Indian philosophies and then every assault and discrimination will disappear.

Yogini said reservation “by default”...I mean what ? Why by default ? She didn’t even mention whether or not she was talking of parliament reservation or something else
