I have a buddy who insists that he knows the law and if any drone flies over his home he is allowed to shoot it down. I use the term "buddy" loosely. He's very concerned about the privacy of his backyard, but I've seen his backyard... nothing worth hiding at all. No secret malitia training site, no secret bunker, no nude sunbathing, nothing that would demand privacy at all, and yet he thinks all drones are *GASP* SPYING ON HIM... and a lot of people feel the same way. I guess my point is this: These videos spelling out the fact vs fiction of drones is good, but only people who fly drones are going to view them. Other people who know nothing about drones all THINK they know everything and won't "waste their time" viewing this kind of video. So the question remains... how do we teach people who don't want to be taught?

Misception 1 is the one I had someone approach me about this summer. I was recording footage of an outdoor concert for my company, which was presenting the show, and someone walked up and asked if it was my drone flying around. I said it was and she told me she didn't like it that I was spying on her. I explained what I was doing and she as much as said (she mimed it) that a good use for a gun would be to shoot done the drone. I recorded footage for 9 concerts this summer and that was the only somewhat negative incident, so that's not bad.

6:19 A few weeks ago was flying on Sunday morning over cranes at construction site in L.A. when I got home I noticed a humorous sight in window of local hotel. It has north facing rooms and seems like zero residents close their curtains. (I mean this is LA, even the tourists are beautiful and you can use your imagination this was Sunday 6 a.m.). When I’m flying, it’s about my interests in architecture and landscape, not spying on someone else boring life inside some dwelling 😂

Lots if great points here. It is important to note that many points raised are specific to the US but most countries have similar but not the same aviation laws. That might be one more misconception “I know the US drone laws and have a US license so flying in another country I am good to go.”

Brilliant truth! Thanks Greg! Love the set, too! ;-) T | Another common question we hear is, "How should a drone operator best interact with law enforcement, city officials, and members of the general public when being approached during a drone flight operation?" (Perhaps a future episode Greg? :-))

Hi Greg. On a side note. I was out flying Air 2S above my property. My ADSB was not giving me any warnings of the small plane I heard coming into the area. I may have been around 300 ft. I immediately started down full stick. I knew once I got down to the 120 ft tree line I have around me I'd be okay. Then the plane appeared. It kind of shook me up that it seem extremely low that we could have been in the same area altitude. Even my neighbor commented that it seemed really low. Are they legal to be that low over residential area? Am I missing something about their 500 ft. requirement? I'm not close to any airports to be in the approach pattern.

Do you have an airport nearby? If not, 1000 feet is the lowest they should be.

My city (Roseville, CA) has three designated park areas (established in 2018) where drones are “allowed” to fly given you pay a small annual fee. I’m going to pay the fee just to be compliant, but I’m 99% sure I can legally fly my drone wherever I want; so long as I follow FAA registration. Thoughts?
@PilotInstitute
@PilotInstitute 2 жыл бұрын
They can only restrict what you do on the ground because they control the land. So if you're operating to/from their parks, they can tell you there's a fee. But if you're outside the park on public land, nope!

@@PilotInstitute My understanding is that some municipalities have passed laws banning drones from their town. They either do not know or do not care that they do not have jurisdiction over the airspace. In fact, you can legally fly over their town as long as you maintain line of sight from a control point outside of the town. However, you may be arguing this point from inside a jail cell!
@PilotInstitute
@PilotInstitute Жыл бұрын
@@johns7734 Correct, they do not care. They can't enforce the laws but are usually trying to scare drone pilots away. They need to be taken to court.

Do you have to take the 107 test if your flying for recreational purposes only? Or is the TRUST test good enough?
@PilotInstitute

No need for part 107 if you're flying under recreational purposes. For that, TRUST is what you need.

Hi Greg, About flying over other's property, have you looked at the Utah law that is in effect making flying over a fenced area without permission criminal trespassing?

@@codycummings92 So the key here lies in the "AND" at the end of the first line: (a) the person enters or remains unlawfully on or causes an unmanned aircraft to enter and remain unlawfully over property and: (i) intends to cause annoyance or injury to any person or damage to any property, including the use of graffiti as defined in Section 76-6-107; (ii) intends to commit any crime, other than theft or a felony; or (iii) is reckless as to whether the person's or unmanned aircraft's presence will cause fear for the safety of another; Intent is very difficult to prove for (i) and (ii) and proving (iii) would be pretty difficult unless someone was flying recklessly (aka by breaking the FAA rules).
@codycummings92
@codycummings92 2 жыл бұрын
Thanks Greg, I think I'm more concerned about section 2(b)ii which doesn't have any clause about intent, and states that a fence is enough warning to not fly over property. I could be misunderstanding how this works, but section 3 makes it seem like you can break 2a or 2b independently.

The issue isn't with those who follow the FAA rules, regulations and laws. Your incorrect when you state that a home owner doesn't own the air space above their property; They actually do. HOWEVER; The FAA consider's "DRONE'S" to be "AIRCRAFT" and as such, they are allowd to "FLY'. The crux of the matter of the word "FLIGHT" is, it doesn't include "HOVER". So a drone flying over your property is allowed, but it can't stop in route. Because "Any and all DRONE'S" are considered by the FAA to be air craft. The pilot is required to have a license and just like any aircraft, the drone must also display indentification in the form of letter's and or number's. As I stated the issue isn't with those who follow the rules, it's with those that don't.
