Scammy as tcg's are, you at least have a physical item, that even if the game loses all players and the cards lose all value, you can still use it to unlock your bathroom door or to block overspray when painting your rims

You should watch the Legal Eagle about copyright of NFTs. He raises a valid point that that the contract may only with the original purchaser, and does not necessarily transfer with sales on the secondary market. Because at the end of the day just because Bored Apes say they something, does not mean it is legally binding.
@michaelcornelljr2 жыл бұрын
My hope for this story is that Seth Green paid the guy to "scam" him, then post it and purchase it on his alternate account for 200k. Now the IP is instantly worth at least what it was purchased for at the rate of 200k thus artificially driving the asset's value up from it's original value of zero and the added benefit of free publicity for the show.

The entire premise of this video is false. Buying an NFT does NOT grant you a copyright to the image. This is something erroneously believed by many people. For example, a group of people bought NFTs that consisted of images of an unused Dune script. They thought that,because they bought the NFTs,that they were going to be able to produce a film based on the script. Then they found out that they couldn't do that,and buying an NFT does NOT grant you copyright or intellectual property rights. The contract written by Bored Ape Yacht Club does NOT grant you LEGAL IP rights. That contract is not recognized as legal copy right or intellectual copy right,BECAUSE the original owner or the artist that made the NFT art would have to have filed a copyright for each and every one of the apes they made. If BAYC does not have a legal copyright for every one of those apes then ANYONE can legally Save as... and do what they want with the image. TLDR.. If the originator of the NFT does not have a legal copyright for the image,then they do not have any legally recognized property rights to be transferred upon purchase of the NFT.

Both behaviors are despicable and make you a bad person. I lump people that think they're better than other people because they have a lot of money into that same group. We all end up exactly the same in the end. Dust.

I think in the legal argument Green is probably right but it is completely unenforceable. I think that fraud ( i.e. the stolen art being sold ) negates any rights. This all applies to real art and theoretically it would apply, I have seen stolen property being confiscated from the buyer with no recourse so I can't see why the same wouldn't apply here. Of course like I said, it's probably impossible for a court to enforce because it's not just a physical thing they can take away.

Hmmm, I do agree 100% with NFTs being trash, I just feel like the analysis of perceived value can be applied to almost anything, to be honest... At least in regards to 'brand' items. Why is a chanel purse worth 261 thousand dollars? Even if it has quality, most of it is definitely hype and perceived value... Or even cars... Why is a lambo worth millions if not by perceived value?
@22Arcana2 жыл бұрын
Well for the lambo there is the time, money, materials, manpower, etc. that was put into making it that is part of its value. With things like Bored Apes its something a bunch of guys made a template and threw it into a randomizer and pressed the button a few thousand times then minted it on the blockchain. The only reason 1 Bored Ape is worth more than another is cause of some arbitrary drop rate for certain characteristics that is completely in control of the ones that made it.
@u_ub2 жыл бұрын
@@polster1404 you can always sell a lambo for scrap metal
@bachpham68622 жыл бұрын
Yes, it can more or less be applied to everything. However, "brand" is different because they are desirable from a cultural, socio-economical view: a Lambo is expensive because we associate owning one with being rich and successful. In this way, it has real life personal utility (as a bragging right). However, NFT (or at least the current version) exists for speculative value, and it really is not having any real utility value (and even for projects that claim to have, the question is why on the blockchain). In this way, NFTs are closer to Herbalife or Amway: when was the last time you see people actually consuming their products for health benefits? Or are the seller just trying to offload their inventory to someone else by promising speculative value?
@qwerty2269nd2 жыл бұрын
Because you can just simply copy and paste an NFT, then make your own identical NFT.

Most luxury goods have a base value and have spent money in marketing to create a brand. A brand value is the equivalent of a famous person signing a product. Nfts are essentially Lamborghini stickers that you can buy for a dollar
@Gaijins2 жыл бұрын
Since it’s not regulated he could simply just make the show regardless. If you’re not protected against theft then the copyright laws for it are also nullified. No regulation means no regulation.

How in the hell did nfts ever become a thing? Like how do you start something like that? "Hey buddy, I got a super special picture on the internet I can sell you for a couple grand." "Oh cool, that must be quite the amazing picture." "Nah, it was my son's art project from the 4th grade. But there is only one in existence and you can own the exclusive rights to it!" "Couldnt someone just screenshot the picture?" "Yes, but you would be the true owner!" I'm probably missing something here, from what I've heard of nfts they sound too stupid to delve into the full concept.

The true irony is the marvel and uncertainty of NFTs make them ripe for scammers, hackers, and other thieves and the best advertisement they were ever going to get was going to be this TV show...imagine the amount of buyers it would have brought in for NFTs but in the end it just showed more people how shady the community around NFTs is, and if the show ever does pick up it's history of Seth getting hacked is only going to be even more mainstream.

The problem with end user agreements of yacht club or whatever they are, is that, that agreement is only made beholden on the original buyer. The other buyers then on are on contract with the predecessor owner. And the thing with smart contracts is that, they are not acknowledged by the law. Just because I tie a shotgun to my bedroom door and make it deadly to enter my room, doesn't make my room legally against the law to enter. Just because a computer program is meant to do something, it isn't recognized by the law

I think Seth Green has more of a case here than you think.

Intent is the biggest issues here. I had over 20k of tools, a car, and a trailer stolen from my business. Despite camera footage from the city, because I do not have footage IN MY BUILDINGS, which were dark because it was at night....the aspect of it being an "intentional theft" doesnt have enough weight for legal action, for physical goods. I was the one who located my stuff, over 2 hours away, on the premise of an auction place and a drug house. I got about 60% of my belongings back. But yet, 2 US states will not charge the perpetrators because they "cannot prove" intent. This happened last year...
