From what I understand the conservatorship essentially ended at the age of 25 but no court filing was ever done to officially close it. Mr Oher apparently has been acting on his own for years and years.

Maybe since they never had to use it, they never activated it..Keep in mind Michael did NOT have anything to build an estate..This document was merely done so he could get into college..Once he got into college they should have ended it but maybe there never thought about it again since it was not being used..

I don't care when he knew because he shouldn't have ever been put in a conservatorship to begin with. I'm not taking what he said about the book as fact but the movie does say he was adopted. They asked him if he wanted to officially be apart of the family and make it official. If it doesn't say adoption, then it heavily implies it. How many people have conservatorship in order to get into college. Tennessee adult adoptions can be done quickly, but why did they STILL have the conservatorship in place?

IN MY VIEW Michael Oher's story about the Tuohy's taking advantage of him is believeable. He was young, vunerable & trusted them. I hope his lawyers cut the Tuohy's completely off from making ANY money connected to his name.

If these people are so honest, like this lawyer says then why haven’t they ended the conservatorship and made sure that Michael knows and knew that it was never an adoption? It’s bull that they were not out to get everything they could for as long as they could, or they would have ended the conservatorship. Why would a 37 year old man need a conservatorship? They knew exactly what they were doing.

According to Oher’s own book, he knew he was in a conservatorship and even explained in his book why it had to be that rather than an adoption. I’m not saying the family didn’t defraud him of money at any time, but he either lied or has a bad memory about his conservatorship because he wrote it himself in his book he released years and years ago.

They didn't explain to him it was not an adoption, it was placed as if because he was over 18 it would have been necessary a conservatorship but it was going to be the same thing... Years later he discovered he was not adopted, how disappointing is that for someone in his shoes?

This lawyer has to do better than this if he wants to help the Tuohys because this conservatorship was shady from the beginning. There are a lot of questions the Tuochys need to answer about this shady conservatorship and about the way they handled the contract for The Blind Side movie. Also, why were they okay with the inaccurate, demeaning way Michael Oher was portrayed in the movie?

@@Chicago48 It just depends on how much "liberty" is taken. Michael says that the movie depicts him as dumb and slow, which wasn't the case. Then they made out like bandits from the movie, yet he didn't get one red penny. They should take out what the family paid for from age 16 to when he started paying for his own, and pay him the rest...his "share". This isn't some chump change; each person got $225,000 plus the family got 2.5% of net proceeds from the movie...Oher didn't get a penny. End the conservatorship and give Oher his share of the $$$.

I don't know if it is because I was adopted in a different state, but I got adopted at 21 by my family, and I was adopted, not put into conservatorship. So that's BS. Where there is smoke, there’s fire. I’m only looking at legal & judiciary responsibility. The Tuophys lawyers are taking Oher’s 2011 comment about conservatorship completely out of context. If you read the actual comment he CLEARLY states that they (Tuophy) explained to him that it was like adopting and a formality for adopting him since he was over 18 - that 2011 comment in the book SUPPORTS Oher’s belief/their misrepresentation of conservatorship. Unreal the lawyers twisting the actual printed comment but that’s what lawyers are hired to do. Major red flags: 1. The SAME close family friend lawyer “Aunt Debbie” represented all 3 parties in the conservatorship which is ethically a conflict of interest. 2. A judge signed off on the Conservatorship knowing Oher did not suffer from “limited capacity” and he was NOT a minor and the SAME lawyer represented all parties. A ward must have their own separate lawyer. Did they know the judge to? 3. Under Conservatorship the Tuophys are legally obligated to submit annually all and any assets transactions done on Oher’s behalf and if they didn’t, they’re in trouble - if they did, they have ongoingly participated as his conservator 4. They have stated and their lawyers, they only did this due to NCAA - why didn’t they dissolve it after he graduated college? 5. As Oher’s conservator they had a judiciary responsibility toward their ward to act in his best interest BUT the contractual agreement with the film company ONLY stipulates the Tuophy parents and biological children NOT Oher. It doesn’t matter if they say “but we split it 5 ways”. They did NOT fulfill their legal obligations to include Oher into the agreement of a film based on his life as well. 6. Again, the lawyer that represented Oher in the name & likeness agreement is “Aunt Debbie” acting again in another conflict of interest. 7. MATH does NOT lie! If anyone can please explain to me how 2.5% of net profits from approx 300m only comes to less than 500k - please explain. Even if the Tuophys didn’t defraud Oher but the film studio hasn’t paid the residuals correctly - Oher is NOT wrong to file suit because now the film studio will have to provide the accounting. 8. SJ himself disclosed very interesting info on a live broadcast (paraphrasing) “I hope Michael gets all the money he’s legally entitled to because that will also benefit me to know what I’m entitled to as well. Michael filing was not a surprise and we knew it was coming, we just didn’t know when. Michael started asking our parents questions after he retired about the money in 2016. I started getting residual checks from my parents in the last 4-5 years about 50-70k.” Don’t you think that’s interesting timing after Michael started questioning the parents suddenly SJ starts getting residual checks - interesting timing. Film released 2009, residual checks start to be distributed in 2010 if not late 2019. Where’s all SJ residual checks from 2010-2017? 9. The lawyers now adjust their story because the age doesn’t align with the Tuophys original comment “Oher refused to accept the residuals so we put it in his son’s trust”. Now they are saying well he deposited the checks then started to refuse them because they know his son was born years after the distribution of residuals so the timing of the trust vs residuals don’t align - the son wasn’t born yet. Finally- 10. According to SJ, Oher started questioning the parents in 2016, they had 7 years to handle this privately. I have no doubts Michael tried to negotiate discuss etc what he felt/thought he was owed due to the numbers of 2.5% net gross not to mention the disappointment, shock he must have felt to learn the agreement only applies to the 4 Tuophys not including him. Saying, just pay me 15m is NOT blackmail if he feels he’s entitled to that # when he’s trying to get to bottom of 💰 and has been attempting for 7 years for them to disclose and negotiate. Hiring Marty Singer, one of the most powerful CRIMINAL attorneys in LA who wheels immense power and influence when it’s a probate case, VERY interesting & telling. Of course, Michael Lewis the writer is going to defend his childhood friend Sean Tuophy - though Lewis has no legal obligations toward Michael, he entered into an agreement with the Tuophys that on paper ONLY apply to the 4 Tuophys and not inclusive of Oher. NO ONE can justify that - it doesn’t matter that they say but we split it 5 ways - you should have and had a judiciary responsibility toward Michael as your ward to have his name included in writing in that agreement. By them not including Michael in that contract agreement - it ROBBED/stripped him of legal & royalty rights on a film that is based on his life story with them. The film studio is not required by law to have a direct agreement with Michael especially after signing his name and likeness away to the film but studio is suppose to compensate for it. Again, as his conservator they had a judiciary duty to perform their legal responsibility to do what’s best for their ward without personal monetary gain. THAT is a huge legal issue under the laws of a conservatorship and can be deemed criminal hence hiring Singer.

Follow the money! Sean’s childhood friend wrote the book and Collins’ sister-n-law and father-n-law produced the movie. they certainly kept the money in the family! Then Collins’ father-n-law donates to her mom’s charity. I am grossly disgusted! Collins Tuohy married Cannon Smith (son of Fred Smith). Cannon Smith is the brother of Molly Smith (daughter of Fred Smith) who is the Executive Producer of The Blind Side. Alcon Entertainment is the production company of The Blind Side. I actually heard Tina say the opposite in an interview. That violent scenes were left out; I can't recall if it was her decision or the producers. She said she was VERY involved in the making of the movie; trained the dancers, etc. Unlike Michael who was not included in the making of The Blind Side. That alone is very strange.

You can be adopted without changing your name. That is a separate part added to adoption. Adult or older children can be adopted and keep thier last name so they don't have to be confused.

His mother was right there in the court and the Touey family didn’t profit millions from that movie. They didn’t choose his college for him, but they did pay the fees not covered by scholarships, they didn’t negotiate his contract with the NFL. He had his own agent. And they didn’t profit from his work. It sounds like someone told him to be mad.

Maybe they wouldn’t have met him if he didn’t play ball, but I bet they weren’t walking around the slums looking for poor big boys they could get into the NFL. It certainly isn't out of the realm of possibility that the Tuohy's believed it was fair for them to profit from Michael's story their generosity towards Michael Oher. Apparently they also believed no one would ever be the wiser.

Conservatorships are supposed to submit an annual accounting to the court and show all the expenses they’re paying for the beneficiary. There shouldn’t be any mystery to funds received and funds spent to benefit Michael. Wonder why he waited so long to petition to end it; he could’ve pursued that years ago.

I read it was not a conventional conservatorship agreement, NOT overseen by a judge as per common practice. Who would ensure or evaluate if he understands. I don't know if that is or not the situation here. Oher was 18, I don't think it's unreasonable to think an 18 year old could think 'conservatorship' is a legal term or part of 'adopting'. If represented as during discussions. Believe non parents looking after children is 'guardianship'.. their 'guardian' which he may have known with his family history. Oher may have just come across it now or as retired less distracted, more proactive with paperwork, Touhy's did alledge he stopped checking in checks.

The explanation wasn't good enough. Just because he wrote it in the book DOES NOT mean he knew the definition. I didn't know until recently. They openly said they made money. Even is ut was 14k they SHOULD OF NEVER KEPT A PENNY. And there is a huge difference between the two. One is control of a person. One is a member. This lawyer didn't convince me. Fire him and get a new one

Michael wrote his own book back in 2011, looks the family and their lawyer told him a convervaship was just like an adoption for adults, since he just turned 18yrs at the time. After college there is no reason to have a conservatorship unless he is mentally or physically ill. I imagine as a young adult coming from a terrible background they did a plan like this to protect him from some of the vultures that were around him that made him homeless to begin with. The parents are very hurt by this i imagind. Why all of the sudden is he wanting millions when he surely has a wonderful home, cars and several millions in the bank. The family was well off before Michael came along. Its sad that money is coming between them. Its always the cause of evil, Let him out of the conservatorship firstly. Get an accounting of all deals and make sure he got his fair share. He was homeless kid who could have ended up dead or in prison hanging with who he was hanging with. He should be happy they took him in. What a slap in the face.

He was a foster child that lived with his uncle. He went to a Christian school and received scholarships from several universities. He received shopping sprees and money from the Touhy's from age 16. He moved in with the Touhy's after his 18th birthday. It sounds like the Touhy's were doing something illegal being boosters for Ole Mass.

Your assumption that he was just hanging out and he should be just grateful is diminishing his fortitude. He was a hard working young man. I know this because he is exceptional and exceptional is not just talent but hard work. He was an All star player in two sports. That means he’s constantly hustling. Colleges were already salivating to take him for his athletic prowess . Because of his circumstances he was working twice as hard as the normal child with stability. What was filed was to end the conservatorship and provide the legal obligation the family signed up for. That they met the financial best interest of Michael and provide proof of this.

And why would he need a conservatorship to make a choice in schools that makes no sense and if that's so then why did the family go on to make contract decisions and make MONEY under his name and why wasn't the conservatorship ended once he finished college? As a conservator of my husband who has Lewy Body Dementia and is in a locked facility for nearly 5 years, I can attest that a conservatorship over the person, dose not allow control over the estate/finances. That is a totally separate conservatorship altogether. For that type of conservatorship, you need medical PROOF that the conservatee is unable to manage their finances/estate

@@privatepo5876 the lack of everything follow up accounting as well it looks like the judge was bought or someone was because it's obvious this conservatorship is completely fraudulent from the lack of guardian ad litem to no check in on the conservatorship ever and they had full right to make legal decisions for him for his financial well-being but never no accounting ever? I hope the bar association gets involved on this because it disgusting the way the judge acted.

He’s legally entitled to end this conservatorship and request them to produce the fiduciary financial statements that acted in his best interests under this conservatorship. They literally signed up for this.

Oher was a homeless kid, the Tuohy's took him into their home, gave him a room, a warm bed, and good food to eat, clothes, and vehicles. Even Oher credits the Tuohy's for helping him to be able to focus on his academics and sports, and not worry about anything else. He was not adopted, so what, the Tuohy's gave him everything he needed to succeed.

I always rooted for Michael and bought his first book in which he talks about the conservatorship in detail. The Tuohys took him in, got him a good education and loved him as their own. I can't imagine why he turned on them like this. It's a play from the Colin Kaepernick School of Gratitude.

Well clearly you can’t read. Go back to the book and read the actual statement, paraphrasing the content “they explained to me that conservator is just like adoption. It’s just a formality to being adopted” The Tuophys had their lawyer “Aunt Debbie” representing and explaining Conservatorship to all parties - Michael & his mom. That’s a legal CONFLICT OF INTEREST. Just like a prenuptial agreement- one lawyer CANNOT represent both parties.

The reality is they could have adopted him but they didn't. Adoption would have established a familial relationship and helped to support his transition to adulthood but it would have also opened him to their money. I don't think they wanted that. If it really was about helping him and the need for conservatorship was just because they needed something quickly than why not adopt him in 20 years. Every way you look at this they are wrong

Fascinating the comments fall into 2 camps. 1/ The “adoptive” family did him a solid by taking him out of poverty so how dare he question their motives/actions. 2/ Something does not add up here.. I am in this latter camp. A conservatorship implies a person who cannot make their own decisions.. This clearly does NOT apply to him. I hope the family filed an annual report reporting earnings/expenses.. The trial will divulge this. Did they rescue him ? He was already an MVP in HS as another person commented. So he would have gone onto NFL likely with or without them.

The family attorney is now claiming they never foresaw his success so couldn’t have been motivated to have a conservatorship financially. Okay, so what about all the years where he could manage his own affairs? Why not close the conservatorship when he finished high school or college? There’s zero reason he needs a conservatorship at age 37. They could’ve done this long long ago. A child cannot fully understand legal contracts. Why doesn’t this broken system require an Attorney ad Litem to represent any conservatee. Why is anyone okay with taking away the autonomy of others without some sort of oversight and accountability.

It was a " movie " , not a documentary. IF it is shown he was " shaking them down ", he loses all credibility. If he thought the movie was non-factual, why say that now, Hmmm? If his current financial condition is weak, that will be interesting for sure. The conservatorship issue will be interesting. This will play out and things will become very clear, very soon.

The CourtTV is presenting this is biased. They gave the Tuohys' lawyer first shot at setting the narrative, then this white woman from the Daily Mail reminding us all to avert our eyes from the racial dynamics and then reiterating the Tuohys' mantra doubting that Oher didn't know he was in a conservatorship. Any of us who aren't lawyers, much less 18 years old, and who had already developed a dependent relationship with the Touhs would probably not see the difference. If they told him they were putting him under a conservatorship because he was no longer a minor, doesn't it beg the question why they didn't adopt him in the preceding years? Because if he had been adopted when he was 15, when he turned 18 they would not be in his business, directing his finances and negotiating a movie deal. I can see how they could tell him it was their way of adopting him by a different name and he probably wouldn't question it. They basically acted as a crooked manager would, doing the negotiating and boxing him out. It will take some digging int the particulars to see what the numbers are, but I see red flags everywhere. The Tuohys' lawyer had the gaslight on high, implying his clients were transparent but he was just not getting it. Why wasn't he there on the set? Red flags flying, but CourTV is not pushing back on any of these suss assertions. Why isn't Oher's attorney in this interview?
