It's an asset flip. Almost every environment object comes from the Unreal Engine store. Using assets are okay. Using entire asset packs as the base of your game and claiming they were made from scratch isn't okay.

Yeah, using basic object assets are fine if they are optimized and maybe edited. But they paid (I guess) $300 for the whole city. Or parts of it what they used to put something together.

It's played on a smaller map, with no one else, on an internal server, with very few AI.. and often times, it's scripted. You can fit in so much more detail in those trailers. They probably were "real". As in, a real playable Unreal Engine scene, not a real game. They might have slapped them together with some asset packs for a small scale demonstration of a single system that worked, probably only single player and then recorded it and showed it as a trailer. Then they tried to convince everybody it's a real game. So the city map looks like a worse version of the trailer because they just copied it from the trailer scene and used in the final game (I use that term loosely). What I wonder about is how many of the things shown were just asset packs (I don't care enough to check) and how many actually included some work on their part. The whole situation kinda reminds me of the Earth 2 Car trailer to be honest.

When it comes to defending video games, I've found the best test is to compare that defense to a different kind of product. Imagine buying three tacos. When your food comes out, you're only given two. Do you think "well they're still tacos! They never explicitly said THREE!" is a valid response in this situation? For some reason only video games (to my knowledge) get this kind of extreme leeway from consumers, and I have no idea why. Don't be afraid to get upset if you buy a product or service and don't receive what was advertised.

Since they got people to buy it, The Day Before is a SCAM. They knew it was being released in unfinished condition and it was completely different than what they said it would be. Fntastic is FINISHED. They need to be held accountable, they MUST refund any money they made off of this since yesterday.

They have to be running afoul of some government regulatory stuff for business ethics, marketing, advertising and basic quality control. Especially in Europe that tends to be more pro-consumer about this sort of thing.

I once almost applied to a job posted by this "game's" developers. I am glad that I didn't, but after seeing just how bad that final product is, I am partially convinced that the job posting was a scam within a scam to make it seem like The Day Before would be a legitimate product.
