I'm an attorney but not licensed in CA. But I know some CA laws and know Dr. Disrespect lives in CA. CA is a two party consent when it comes to recording another. Monitoring and using texts are considered recordings. I think Twitch banned him and the reason for the settlement is was because it's a two-party consent state, and he didn't consent to the monitoring of the Whispers.

The most likely reason Twitch settled with him, is that he brought a civil case on Twitch for illegally monitoring his whispers (which without warrant is considered private). They realized the damage this could have if countless streamers left them for fear of being illegally watched and the criminal possibilities derived from predatory behavior using their private messaging, so they settled hoping it would all just disappear.

Here is the thing about the doctor disrespect alleged case, it would involve penal code 288.3. the issue is even if they had proof that he was having inappropriate conversations with a minor, unless the conversation were completely explicit with doctor disrespect stating that he was planned to do one of the underlying crimes in section A, it will not stand up in criminal case. The Doctor Disrespect situation is easy to figure out in all honesty: He's using vague legal mumbo jumbo because he's being 'technically correct' in what he says. Did he message a minor? On screen, yes. In actually, no. The guy who posted saying he was the head whatever whatever of twitch is either the individual or was seeing the screen of a close individual posing as said minor to the Doc so when in court Disrespect said there was no proof or whatever of him messaging a minor and it should have been impossible to find out he was even messaging one anyways because of the 'chat encryption', he showed that either: A - there is either no encryption or a very very weak encryption or B - there was no minor, it was an employee which is how they were able to pull up raw text in the circumstance that the chat is encrypted. So when he says no wrong doing was found, it's because Amazon had to show their hand that it was an employee who was messaging him, so therefore whatever he was saying was not to a minor because they had the raw chat logs on their own end OR that they lied about their encryption so if two minors were talking to each other or a minor just started blasting terrible texts to an adult that any twitch employee could look at it and/or try to twist a situation incorrectly against whomever twice may not agree with (for example if someone streaming is a known Republican or Republican aligned individual and twitch being parented by Amazon, a very liberal (until it comes to profits and pay and monetary growth) company, they could initiate a sext with said streamer then claim that the streamer asked for it or whatever and the chat log or partial is in plain text from their own end). None of this is a defense for Disrespect. Whether a minor or an adult posing as one, he messaged them inappropriately or at least replied and therefore engaged in such messages and conduct. I'm just pointing out why he talks in such legalese.
