Here's the full text of the amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

CORRECTION: 'Defamation" laws allow for CIVIL damages to be awarded to the defamed party. NOBODY goes to jail!!!!!! It is not a criminal offense to "defame" someone.

Here's an idea;; If you're going to make a video about one of our constitutional rights, present that right as it was written before you go into all the "limits" and "interpretations" the gov Has put on that "right". The Supreme corrupt court is the branch that's failing us more than any other. They consistantly allow individual liberties to be limited by overreaching gov which supports/ represents only the wealthy few

In regards to social media being private entities, they can't use their freedom of speech to sensor others freedom of speech, that's not compatible seeing as they are the new public square. Section 230 protects them from the speech of their users so there's no reason to sensor speech unless it's a crime like threat or iligal activity. They have taken policing of speech to levels that interferes with the first amendment. That's what's being fought right now with Trump's lawsuit.
@David888B2 жыл бұрын
You are wrong about all of that. Public squares are owned by the government, social media companies are not, they are not bound by the First Amendment. They censor speech because they're businesses, they don't have to censor speech, but they want to, and that's protected by both the 1A and 230. The First Amendment protects speech from the government only, not from Facebook. Texas just stopped an anti-censorship law because it's unconstitutional. Look it up. Trump's lawsuit has zero chance of winning.

@@David888B businesses have to abide by the constitution. They can't own slaves, child workers, they can't beat or underpay women. So why can they stomp on our first and most important right? They can't. Soon the 2nd amendment will need to hand out reminders. Make sure you're on the right side. I won't hesitate

@@David888B WRONG!!!!! If they censor speech, then they CAN be sued for any speech posted that defames a third party. That's the law!!!!

@@David888B Yes and no. A PD in Hawaii was ruled to be in violation of the 1st amendment for deleting comments on their FB page. Any social media account by a public entity should be treated as a public forum just like when a public entity rents out a space in a strip mall, that space become public property. The 1st amendment should apply

I believe in (almost) absolute free speech, but I do believe it is HOW it is said that makes the difference. I am also a firm believer in the saying, "Your rights end where mine begin". I think a good litmus test for hearing how it is said should be a 'courtroom test.' In other words, if you could get away with saying it in court to a judge, then it is free speech. If you could be whisked away in handcuffs under a contempt of court charge, then it is not so. In other words, a lot of the so-called First Amendment auditors should not be allowed to get away with some of their antics. If you think about it, many of them claim to be 'journalists' while acting like commercial production companies. The last I checked, there are some limitations to 'news' and 'commercial production' (eg--obtaining permission to film and film in public just to name a few).
