Yeah, I have the withered Bonnie and Foxy plushies from them (that was before official withered plushies became a thing and I didn’t feel like waiting anymore). And It’s honestly pretty telling if a bootleg company can make better quality FNAF plushies than Funko. Funko really doesn’t try with their FNAF plushies half of the time.

If I had to guess, the "is it safe for children" and arguably the child labor claims comes from insecurity. Youtooz may realize they had a poor case since the only things that look similar are the collectible logos so they pulled the "think of the children" card. You can't get a worse claim as a company than child labor, right? Then again, I'm not in the FNAF loop so who knows. I'm just going off experience because I see that argument everywhere.

As someone who collects plushies, I believe the accusations about the plushies themselves not being safe for children might be about the fabric or stuffing. Most children's toys have to be fire resistant in certain countries, so they may be accusing the fabric of not being fire resistant? That's the only thing I can think of other than bad stuffing you can find in Temu bootleg toys that's got plastic chunks in it that could make a plushie unsafe. Some people may say dyes could cause issues, but those mostly wash out or would be a more public issue if those were bad since it's harder to cover up rashes caused by toxic dye work.

When it comes to "safety standards", it could refer to the quality of the materials that is used in the plushies' construction: chemicals in dyes, possible lead levels, contaminants in general storage of the products, etc. These are problems in bootleg products in general.

In a reddit thread, he said that knockoff companies that manufacture products in china COULD use child labor, but he wasn't specifically talking about xsmart, nor did he definitively say that anyone used child labor. having grown up reading badly translated versions of vocaloid songs and bad translations of different asian media, i feel like the xsmart rep really just doesn't have the best handle on english. the sentence structure of different asian languages are very different from english and so when someone's trying to translate from language to the other in their head it definitely is gonna come out in a structure more similar to their original first language. i highly doubt the guy was trying to go 'yeah kids have the ability to do these difficult tasks' with the 'do you think kids can do this shit' type question. it reads as a 'come on do you really think this is a plausible accusation?' type sentence.

I have the prototypes and if the manufactured plushes are the same then you’ll be getting not 1 single print on any of the plushies, really soft suede feeling fabric, and really firm plushies, like they’re stuffed really good. I used to be in a factory that creates custom plushies, pillows, cups, etc. And while some do use CL, other places use people with severe disabilities such as blindness, lack of limbs or extreme case of autism where a person just can't talk at all and has a strange face that's like, dismorphed. It's sad to see it but they get paid, right? Well, not much sadly, those people landed there because the government just said "sorry, we can't help you but you can be a sweatshop worker". It's a mess and I'm not saying that Xsmart is doing it, I'm just saying that this is a common practice around the world.

Quite a few bootleg toys use lead in their paint, so that is also the type of safety they mean, along with choking hazards, etc.

If the child labour claims aren't true, Youtooz needs to get dropped by Scott. This whole thing feels like a fat power trip from the CEO. Yeah, they're bootlegs, and illegal, but to say "Raah, they stole our design!" when the plushies are literally not even remotely similar is so weird. If they genuinely had good intentions for calling out XSmart, would they not tell Scott about them, or at least someone else more fit to dish out a lawsuit? And to randomly pull "You use child labour!!!" out of your ass when the lawsuit isn't even about that seems really fishy. Don't get me wrong, I'm not at all saying that XSmart is 100% innocent and there is no chance they ARE, but it just seems so weird for A. Youtooz of all people to dish out the suit B. Youtooz to say that a Withered Bonnie plush which looks nothing like theirs is a stolen design from them and not just FNaF C. Youtooz randomly making child labour claims appear from thin air D. Youtooz to say that plushies... somehow, don't meet the safety requirements for children. I don't know if anyone has brought this up yet, but Youtooz technically filed a false copyright claim. Yes, they have a license to create fnaf products. However, they do not own the copyright to fnaf. That falls to Scott himself. And, under US law, the only person who can legally file a copyright claim is the copyright holder thelmselves. So, Youtooz has 0 legal right to file a copyright claim/takedown in this scenario.

A couple of things: I believe the CEO of youtooz made a comment in a q&a about bootleg plushies using child labour and sometimes containing toxic dyes, flammable stuffing, and other hazardous materials. It may or may not have been him vaguing about xsmart (this is a real and provable concern for the funko boots you see on places like wish and temu), but I don't think it was unreasonable of xsmart to interpret it as directed towards them considering the DMCA. Secondly, I interpreted their rebuttal to that as essentially "we're not going to deign to respond to an allegation like this without proof". But their poor English makes the whole thing read weirdly. Either that or it's them not actually being able to 100% deny it because they don't have enough oversight over their manufacturers to fully say for sure - again, a real and provable issue in the garment/fabric industry.

The main reason I’m hesitant on even believing the child labor claims is the sole fact that like………..Xsmart is a bootleg plush company that has a pretty good online presence and seems to hire other KZbinrs specifically Fnaf plush KZbinrs to market their plushies, so if they were also committing child labor………..thats just very bold?(I think that’s the word, if not someone give me another word for scummy confidence) like you have to be very confident that ur not gonna get caught at any point especially since your already selling bootlegs that can be copystriked at any time by the original creator.

If you don't know why Youtooz is issuing the DMCA, it is because they brought the license to use those designs, and Youtooz, under US copyright law, have to defend their right or they would practically lose their license Scott on anotherhand, can pull a Tolkien estate, and file a law suit for profit years later for a good profit, because he is the creator well and alive and is continue to creating more of the IP

IMHO: youtoose plushes so far have been hit or miss. They either hit somewhat mediocre and look just ok, or they are ridiculously weird and unappealing looking. I've been dissatisfied with their statuette designs for years at this point and seeing everyone loving their fnaf products is so disappointing because they are not that good looking. I just never said anything because everyone was so overwhelmingly positive about these products so I didn't want to snuff up the excitement. BUT, now it's fine, because releasing ugly figurines and plushes is one thing, but targeting products that are, while unofficial, are way better then their lower quality, unappealing, derivative of basically every cutesy design on earth, that should have flopped back in 2021 leading to the closure of the company. Selling that and then stirring up dramatically with people making actually cool stuff: THAT is something else entirely and shouldnl not be tolerated. I am genuinely thinking that the only reason youtoos are still afloat is because of Scott's poor licensing decisions, and that's why they are acting so desperately now: everyone has finally looked at their products and saw how nothingburger they are and stopped purchasing them. Honestly, let's just hope youtoose is finally closing later this year
