Prof Githu is real teacher. I have no background in law but I totally understand hi argument very clearly. I remember his submission at the Hague. He was excellent and very eloquent.

Prof Githu Muigai is one eloquent man and Dr mutunga though brillinat lost this one due to lack of cohherence! in my opinion. Now give us Prof Githu Muigai VS Dr Otiende Amollo. This will be a quite something interesting.

AG. GM's line of thought is spot on. My take form GM's arguments - it is down to a combination of prudence, progressive transformation and being pragmatic whilst shunning away from wishful thinking, over excitement and the textual approach to the interpretation of the constitution.

A great debate. Surgical review of the Constitution as to whether we have a theory of interpretation or not in implementing it. "Doctrinal' is a theory 'Purposeful ' is an approach! To quote Prof Githu.

I agree he articulates well. He is gifted and well learned. However the debate was btn living law and theory. Which one you take is upto you

@@pn2074 , well you cannot discredit his articulation on the basis of failure to pronounce a single word, more so given that he has probably mentioned the word constitution his entire lifetime. i still hold my position, he is a great legal scholar.

Both! Prof Githu and Dr Mutunga are intellect. But Githu seems to be more articulate and eloquent maybe due to his legal professional application in teaching! This debate to me is one of the best Deliverances ever recorded! Similar debates deserve to be held on for public acknowledgement! A job well done!

Very refreshing debate here. It takes us forward to a situation where universities are leading in promoting a culture for decent dialogue. It takes me many steps forward in understanding Constitution and Law as foundations for Sustainable Development.

It's very apparent Willy Mutunga cannot express himself well despite having immense knowledge and great Ideas. Public speaking and oratory skills are God given talent that cannot be acquired or taught anywhere in this world.

Prof you are right. We have no theory of constitutional interpretation in our constitution. No philosophy, believe etc contexualised from our history and experience underlines our constitution. I agree that it was a reactionary as opposed to a living document.

Somebody mentioned something to do with local tribunals. Can any of them comment on the same because I believe that is a Very important issue, beyond the theory of the law. Somebody said that the law is an ass, please explain. I believe that the law is not always fair and I can elaborate if I were to be requested to explain my position.

Great debate indeed . Although I tend to think the threshold of 50% + 1 was to advance that every vote (including minorities) counts unlike in the past. At least it recognizes broader appeal and effort in the first round. Broader base to accommodate national leaders is legitimately a different issue and quite relevant given the outcome so far. But how far will that proposition go if the progressive values in the constitution were entrenched properly. An audit , also arising from the experience of a different political leadership, may establish and inform a change to the supreme law.

I respect both legal minds and their views regarding our contitution. However, Prof Githu Muigai's presentation skills that hit differently and right - regardless of whether you have studied law or not! This is making law accessible to other technocrats and the layperson.

Infact I admire prof Githu arguments, it reminds me of Ogola a lecturer who took us through commercial law then. He said the constitution is the skeleton and statutes are flesh.

Broad based GNU is a good proposal. For gender equity, let the electorate vote parties then the parties nominate representatives based on 50:50 gender rule.

As a Kenyan I think we need such publick forums ,to educate the normal mwanainchi in this very important issue of the constitution ..so that anytime we have any amendments kenyans can be aware and a part of those changes rather than always finding this issue a s a very strange killer enemy.. You shouldn't contemplate reviewing the constitution every 5 years... that is not in the interest of economics of justice and certainly not in the interest of the country. Constitution must be let to mature in my view... things must be done mos mos.
