What is family trust embezzlement? -- Embezzlement is a form of theft, and it is a crime. In the case of family trusts, embezzlement refers to misappropriation of funds belonging to the trust, or to the decedent that should belong to the trust but were stolen before their passing. A trust litigation attorney handles the civil litigation (monetary relief) aspect of an embezzlement case, not the criminal case. Any beneficiary or trustee may choose to only prosecute an embezzlement claim in a civil court, without asking for criminal charges to be filed. IMPORTANTLY, you cannot threaten to have someone charged criminally to gain an advantage in your civil case. That will only expose you to potential criminal liability yourself.
Can a trustee steal from a family trust? -- A trustee is the individual or entity charged with managing the trust. It is the trustee’s duty to make responsible decisions with the trust fund assets. A trustee typically cannot take any funds from the trust for him/her/itself - although they may receive a stipend in the form of a trustee fee for the time and efforts associated with managing the trust. If trust beneficiaries feel that the trustee is stealing funds, they should ask the trustee to account (report on what they’ve done with trust assets). If through the accounting, or otherwise, beneficiaries learn that a trust stole money, they can charge the trustee with breaching their fiduciary duty and have them removed and surcharged. The beneficiary’s goal here is to recover the funds for the trust, and if successful the trustee may be allowed to recover his/her/its attorney’s fees and costs.
How can I tell if a trustee is stealing from a family trust? -- To prove that a Trustee is stealing from a family trust, we would typically look for evidence that the trustee made transactions or payments that benefited him/her/itself but did not benefit the trust beneficiaries. The most common misappropriations we see are “loans” to the trustee or other “friends,” personal property that suddenly goes missing, and overcharging for legitimate services that simply don’t cost what the trust is being charged.
What is criminal misappropriation of property? -- Criminal misappropriation of property is a charge associated with a criminal court case. It is not part of the civil case proceedings. In our experience, while most beneficiaries are frustrated with thieving trustees and what the wrongs righted, the vast majority do not wish to see the trustee incarcerated or even prosecuted.
What is a breach of trust? -- A breach of trust most commonly refers to a trustee’s breach of fiduciary duty. A trustee is required to act prudently and consistently with what a reasonable trustee would do in a similar circumstance. Trustees cannot play favorites, act in a manner that does not benefit the trust beneficiaries, etc. In essence, a trustee has a fiduciary duty to put trust beneficiaries’ interests first, and when they do not they most likely will have breached a fiduciary duty.
When do I need a trust litigation attorney? -- The moment you suspect a breach of trust, embezzlement, or a trustee stealing from a trust, it’s time to contact a trust litigation attorney. Many trust lawyers will offer a free consultation, and many won’t charge you a thing unless you obtain a settlement or are successful at trial.

You have great, Clear, concise and very informative content! Thank you. My sister I believe is violating her fiduciary duties of being the trustee. She is being secretive, not unveiling anything to me as the beneficiary and basically ignoring all my requests your the trust and will documents, the original attorneys name and or contact info of the trust creator, also taking valuables out of the my mothers house with no logging of what she is taking. Also, refusing to let me in the home which I inherited but letting her and my Other sister go in and just take whatever. Im the main beneficiary of most of the assets. What can I do? I'm same problem with both my sisters, your lucky my sister had me arrested twice on bullshit stuff. She allegations against me. My parents sold two house in cash. They both went on help themselves to black box. They put cameras around the house. I have been in court more then nine months, their trying to break me. They did good job my kids are being evicted next month. The lawyer did terrible job he lost petition, so he appeal now 5 days before. He said let go , u will loose n cost more money. What do I do. When you forge signatures in order to receive something that is not yours, understand that you were being watched the whole time. From the people you paid off, the transactions like cars and trips, as well as homes you bought. You were being watched the whole time trying to make someone else feel like the outsider. All you did was create a hole you and everyone else is going to be in. Lawyers, officials who are now unofficial, family, and people you paid off are doomed. You were super sloppy because the paper trail is super long. Utterly disgusting.

It really sounds very good, you’re presentation reminds of a guy I knew. He was a used car salesman you know the kind that will tell you what you want to hear to make a sale. They always leave out the fine print for fear that it might sever the deal. I’ll make this very short and to the point. Most people who are in this situation don’t have the money to hire lawyers and since these are civil matters there is no help for the ones who cannot afford to hire lawyers. You might find some that will work on a contingency fee, and that is another issue that becomes a problem. If you want to help people then start helping people who can’t afford to hire an attorney. There are many ways to help low income people. Get a grant to help balance out the expenses. People are being wronged everyday because of this. Talking about a trustee can’t do this and can’t do that, you know as well as I know that yes they sure can and do because who is going to stop them ? Not the person that doesn’t have legal counsel because they can’t afford to pay one. So what happens is the court sides with the trustee and you are just out of luck. This system needs to be changed in every aspect because it’s over before you have a chance to start.

At this point in my life it's not totally about the money but it's about justice My brother recognizing what he did and being held accountable for it and if it would have been me in control he would have put me in jail because he was already talking about I was stealing things when I went over to the house and was selling a few things but he gave me permission but there was never an inventory but I know that there was over a half a million dollars worth of homeowners insurance just on the personal belongings but so all those personal belongings were mine that's what my mom wanted she wrote it in the letter and my brother disregarded it and said I'm not going to acknowledge that being abused your whole life by your older brother closes you off and shuts you down when he starts throwing his control in power around and you feel like you're a little kid and and you have to just accept it and that's what I did for years I would give all the money I received from it to other people in the same position that I'm in just to see him prosecuted and held accountable for all the illegal action he has done how can you do that to your own sister and she's the only other air air to the estate and then he was trying to lie saying that they're trust were dissolved and then he tried lying saying that the trust was no good but he then turned around and stated that he had a protect the trust but why protective trust that has nothing in it because you want to take it because you put yours belongings in all your stuff in it already My mother came to me 6 months ago and told me Jennifer nail his ass and that's what I need to do I need help I will go on Dr Phil I will do whatever it takes to tell my story and to get some justice

What do you do when the banks and the lawyers are involved and the judge is corrupt taking bribes. I can't even hire an attorney in the state of Oregon because the Oregon State bar. When I go to get a referral they give me an attorney that work for the same law firm that embezzled money from my father's estate. It seems if you work for law enforcement in Oregon you can still rite from your own family. And the judge will help you. I have the paperwork to prove it I took it to the corruption department in oregon. The reply I got from them was if we take the case we will get back to you. How come they're not going to give me an answer if they're not going to take the case. It seems I have a right to know and I have the paperwork that I turned into prove it.

So I am holding paper work that shows me being the donor of an irrevocable trust, there's 300,000 in the trust and no one will explain to me how someone could set up a trust with myself giving assetts to other people. 3 beneficiaries. Me the donor the signature is not mine . How could a bank account passing assets even be set up if I never gave anyone power of attorney and never ever asked anyone to write a trust that has me giving cash to anyone ?

it start where I left off this is the first I've even looking into anything and if you want to even call it that this is all I can do right now I've been too stressed out I can't even handle it myself even know how to get because as far as the fraud I'm I know that it's got to be way past anything I could do to find out even because all I just know how bad they are and how bad has always been my dad signed his death certificate if anyone out there wants a real kick in the head and something worse than they've ever even heard of this is it trust me just trust me on this I don't even know how anyone would locate anything as far as even being was supposed to be in this so-called will that never would have never been done had it not been and then he died without even checking into anything I
