They also said STW would be free in 2018 yet here we are. While FOMO marketing is definitely problematic (like Epic's FTC case showed), that's a separate issue from breaking specific advertising promises. Yes, their EULA says they can change things, but consumer protection laws can still apply to clear marketing claims regardless of what's in the terms. The Save the World comparison is interesting but different legally - that was a future promise about their plans. Battle Pass exclusivity was a direct marketing claim used to sell something at the time of purchase. FOMO isn't great, which is exactly why Epic changed their policy for new passes. But retroactively breaking old advertising promises isn't the solution - it would actually undermine consumer protection laws that help fight predatory practices. They can (and did) stop using FOMO for future passes without having to break past marketing promises that people spent money on.

In their EULA, they state, “You and Epic agree that You may sue us in small-claims court in your choice of the county where you live or Wake County, North Carolina (if you meet the requirements of small-claims court)” They literally use the word “sue” in that sentence. The requirement to sue them being that the claim must be $5,000 or less. A battle pass costing $10 would mean it meets the requirement. If the small-claims court were to rule in your favor that the reinstatement of old exclusive battle passes is unfair for those who bought them originally, Epic would have to agree on a form of compensation with the plaintiff.

The moment I became pro bringing back old battle passes & could care less if any OG owner is upset is when I saw a comment on X where someone wanted the Marvel skins from CH2 S4. They couldn't play at that time because they were undergoing chemotherapy & someone replied to them saying "Oh well that's too bad". I understand that these skins were promoted as exclusive & I remember the comparison you made about your Optimus collector's edition (although honestly I think it wasn't a fair comparison to make because that's a physical item where as skins can be brought back at any time at the click of a few buttons). However, even though it would be slimy for Epic to go back on their original word to not bring these back, I think it could be a huge positive in terms of profit because at the end of the day Epic is a business, morals are not at the top of their priorities. On top of that I think it would be a win for a majority of players who either couldn't play at the time due to personal reasons or honestly some of them not being old enough to play to obtain these skins. I truly understand both sides but taking ethics out of this particular situation & it does apply to both stances but they are just cosmetics in a video game. If they return people will still be fine, if they don't people will still be fine it's just a game. Unfortunately I will be taking the stance on bringing them back because I personally think it would be a celebration of the game & add more to it's longevity.

Underneath old battlepasses they say that they are limited to the seasons they were released in & would not be available outside of that season however, it’s also stated in the T.o.S that Epic in its sole discretion can modify their content whenever they please. When you first signed on to play Fortnite we all agreed to the terms of service therefore they aren’t legally bound to keep skins exclusive it’s just a matter of public opinion & as Klarque stated, those who were able to complete the old battlepasses may be upset that newer players can earn them. I own a majority of Chapter 1 skins & I could honestly care less if someone else gets Peely. Tbh I think the Peely reskin problem would be solved if they brought his original style back. While situations like that are tragic, I do feel that the few people having those problems is not worth epic going back on their word. They rolled a 1 on their dice to obtain those skins, and they should be able to deal with that. Not everyone gets so lucky (I know, I missed out on many seasons I wanted), and that is okay. Also, I don't believe this would profit epic games that much. By bringing these skins back, they lose much of their value and much of their demand. Epic might see a spike in sales when these are released, but it would drop back down pretty quickly. They would spike a bit in profit, but they pay for it with the trust of their longest time supporters and their credibility.

This and the culture around exclusive cosmetics that he talks about is way more toxic than he thinks. This isnt just about keeping old iconic cosmetics away from new people but also keeping mainstream pop culture characters locked away in an expired battlepass. Add this with the inherent toxicity that naturally comes from an online multiplayer game and buying second-hand accounts being against the TOS and it’s easy to see why so many people want old battlepasses to come back. This also hurts Epic’s metaverse approach of letting people play whatever they want as who ever they want. They care way more about gaining new players than they do keeping old players. Them bringing back OG was due to its popularity with the entire playerbase, not exclusively nostalgia from the old fan base. Having digital trophies in the form of time-exclusive content can’t work in the new system and approach that Epic is now working towards.

When you buy something you are making an agreement with the other party. The other person has to hold up their end of the deal or else they are being scummy. Same goes for you. So if you are married and you cheat on your partner you are going back on your end of the deal. If you sell battle passes and say they are timed exclusive then remove the timed exclusivity then you are going back on your end of the deal. The way most people who want the skins back see it this way. They've just started playing Fortnite in Chapter 5, and they see all these cool skins. They think "Wow, I can't wait for these to appear in the shop" only to discover, that they're blocked by a giant wall that just says "Should've played back then" We're getting to a point where people won't be able to obtain skins because they became exclusive... before they were born. How is that fair? That's not "Should've played back then" That's "Should've been born faster". They own all of the BP IPs from C1 and the chapter is coming back, why not the BP. On paper they’re not valuable because technically you can’t sell your account. If they come back illegal accounts will lose value. Only downside is gatekeepers crying because another person has a digital skin.

There's this hostile and prevailing consideration among the "OGs" that people who were in early should be treated and respected better than those who came late, as if it genuinely matters like a level of classism about when you played and paid for cosmetics on a video game. The reality is a sense of self-status that doesn't really matter anywhere else but for a locker selection screen and showing people you played longer than they did. And yet this of all things is one of the most toxic subjects as of late in the community, a genuine sense of entitlement to respect and honor players that frankly are just not doing their same respect to anyone else. Reminder that this is the same game that had kids bullying others over being a Default skin and not paying in early on. Don't forget that you pretty much previously declared that anyone who was ready and willing to buy old battle passes as reaching into their parent's wallets and acting entitled to have whatever you want as a counter-argument. That's.. that's not even remotely comparable to actual lack of impulse control or entitlement. Hell, the OGs that feel slighted at the smallest inconvenience of some "exclusive" cosmetic returning always demand compensation out of Epic, like they straight up _are_ the people that have to be catered to, no one else. _That_ is entitlement. Enough of this crap. Everyone is going to enjoy everything in different ways, and no, cosmetics are not a marriage, it's not some sort of commitment, it's a transaction from a business to a consumer for a digital item that isn't even non-fungible, timed and limited to bait you into buying in on impulse. Respect the community, it respects you, but no one is going to respect someone running around as the Black Knight or Superman and telling everybody else who missed out to go away because they weren't there for it. Honestly, I Agree with you here to, This Subject is Really Touchy and Messy, If Epic took one Season to Dedicate time into Making Remix Skins or Reskins of all the Old BP Skins or Exclusive Skins (For Example Visitor or the Scientist, But in a Lava Series or FNCS Series Form) I Wouldn't Mind Not Having them As long as they look good. Heck I have made simple Concepts for Alternative on how they can Bring a Legal Version of Paradigm Back to the Shop when they cant do the OG Skin, And Epic has Proven they can do that (Renegade Raider > Blaze, Rust Lord/X Lord > Roast Lord, Midas > Shadow Midas) But they do it for Skins that Almost Nobody Really Cares except Dumb Children, Look How Many Peely Skins or Cuddle Team Leader Skins there are, Or even Jules, Or Ruby, or Brite Bomber skins, they do those "OG" Skins but nothing for Fan Favorites (Someone on Twitter Said that the amount of Peely Skins we have can make 2 Full Season Battle Passes, that shows how milked he is) How Epic can do skins related to those but nothing for more Obscure or Fan Favorite Skins is Beyond me, They don't even need to Tie into the Storyline Just Give us a Shadow Series Variant of the Foundation as a Cosmetic in the item shop, it doesn't need to even be Part of the Story, at least it would Give people a chance to get some sort of Variant of the Character they like if the OG isn't Available, and it would keep the OG Variant Exclusive, i know its not Exactly what people want but its better than nothing. To preface, this was a comment I made on Clen-‘s video about this same topic where he said that the people who wanted these old skins were merely jealous of those who had the cosmetics. Clen made a comparison about people being jealous of a KZbinr having millions of subscribers and one channel didn’t, he also made a comparison where he said that he had a pc that would be better than any of his subscribers and how they would be jealous of him. The comment I wrote went like this “The thing is, you can work to get those millions of subscribers, we physically can’t get these skins without breaking TOS by buying or selling accounts. You can work to get a better PC that can run Fortnite at max settings, 180 fps, but it is impossible to get skins like Peely, Drift, or Omega without settling for the reskins, that to some, are infinitely worse than the original. I would be willing to pay double for the original battle passes but there is no way to do that. I would be willing to grind out to tier 100 every month if it meant that I could get these skins. If they made us grind for tier 100 in just a month, that would be almost the same amount of work as people 7 years ago had to, maybe even more because of the month limit. I’m not complaining because people are showing off their skins, I’m complaining because abusing FOMO is a horrible business practice that locks content to select users who may not even use the service in 2 years and because the items that are locked behind are actually something I would want to use. Many of the people that own skins like Peely or Carbide don’t even use them. There are thousands of players that don’t even play the game anymore that were some of the only people that owned those skins. In the future there will be some skins that no active players use. This is the same thing that retro video game players have to deal with, there are thousands of games that nobody can get legally anymore because the developers aren’t selling them. Because classic Nintendo games aren’t sold on Nintendo consoles anymore and Nintendo doesn’t care to archive them, people are going to pirate the games and emulate them. Its a divisive topic because OGs want to keep their skins and newer players feel entitled to them. I didn't buy Renegade Raider but I never asked for it to come back to the shop; it eventually did with alternate styles, which is totally fine, and Epic has remade pretty much every OG skin at some point. If Epic made a skin trading system that might be a solution, but at the end of the day getting in early always has advantages.

An issue that's not being addressed is that a lot of players did complete the passes, but did not have the currency to pay for the premium pass during the first couple of seasons. You are able to eventually save up vbucks to pay for the premium pass if you completed multiple battle passes, but you don't have the opportunity to purchase the previous passes you completed.

I think you are totally stretching and bending your arguments to try to demonstrate your point, not all the relationship have or need gatekeeping and most of the times that gatekeeping is pretty toxic, and I certainly don't want to marry to Epic. The people how pay for cosmetics are not the ones who invested to helping the game at first stages (cosmetics in BR come quite late in comparision)... The FOMO from battle pass exclusivity is an anti consumer practice and I'm glad its gone now. I think the only real thing keeping old BPs from returning is people's entitlement from the "promise of exclusivity" Epic's made. Like it or not, Epic games is a business. There are plenty of people who are willing to spend money on old BPs and Epic shouldn't have to put up a wall because of your feelings about these old cosmetics (most of which ur probably not running that often anyways). OG is coming back permanently and it's the perfect opportunity to rerelease old BPs. This still technically follows the same terms, where the bulk of the argument for old BPs not returning stems from.

I see your point, but at the same time, I feel like the people who played and supported the game at the time already got rewarded for it. They got “early access” to these cosmetics, as well as a massive discount on them (in the case that battle pass items return as normal item shop offers). You’re right that sometimes gatekeeping and exclusivity can be a good thing, but there isn’t really a solid reason why this has to be one of those times. Epic’s already lost a ton of trust with the community, especially those who have been playing for a long time, and at this point, things like this are almost just expected. If they bring them back, they make a ton of money off it, people who really wanted certain characters can play as them, and honestly, very few people who had them already would actually be upset. It’s nearly a universal win. Also, I feel the need to point this out because some people are brain dead, but I’m an OG with almost every single battle pass in the game’s history maxed out, so I’m not just biased because I missed out on everything.

@petram8050 I watched him give 2 comparisons to this discussion that are only comparable in the basic premise. The second you scope out his party example or relationship example are just so wildly different to this. Epic going against their word is bad sure, but when people are asking them to do it it's hardly a break of trust. In the Party example, if 20 out of 29 of the people who went to the party want to do another one and include the guy who missed out then why not? And that's such a misleading example, it's as if 30 out of like 200 who were invited went, not 29 out of 30.

Most og players have grown up and adapted to just using what you like , the fact there are some who haven't grown and wish to gatekeep old cosmetics from new generations because they want to feel "special" when they log into fortnite is so childish and humorous at the same time to me 😂

As someone who's been playing ever since CH1 S3 I sided with exclusive battlepasses for a long time. It made me feel special having rare, OG skins. But after a while I realized that I didn't just buy the battlepasses with the knowledge that one day they'd be rare, I got them because I wanted unique skins that added to the fun of the game. This realization only increased as more crossover skins were implemented into battlepasses such as Spiderman, Darth Vader, Carnage, Optimus Prime, etc. Yes, I still like the idea that I have skins that show my long commitment to the game, but if that exclusivity is coming at the cost of new players not being able to play as some of their favorite characters just because they didn't play at that time, then that is where I draw the line. I think that most people who are holding out on their skins just because they want to keep their exclusivity are petty. In general, if more people have a certain skin that they genuinely just want, then that's going to be better for everyone and make the game overall more fun which is the entire point of the game. If you play Fortnite just to feel exclusive and gatekeep items, I feel like you're playing the game for the wrong reasons.

Here's my take. My first season was ch. 1 season 5. played every single season after. Other than fortnite crew, enlightened/extra battle pass styles, starter packs, few save the world skins, level up skins and 1 time sales and nearly all collabs i dont really have anything really rare. The crew has been rumored to come back. Collabs come back sometimes. For me, OG black widow, i felt kinda cool being lucky annoff to have it, and it came back. I only have 2 skins other than battle pass earned that was exclusive to the season that I'd consider rare. OG Paradigm and Dark Vertex. I got Paradigm only because i really liked the visitor and knew i couldn't get it because i didn't play back then. Dark Vertex was a happy accident. He's normally sold with a console for like mabey 300. I got him for 60 in a Vertex controller. O ya, i got minty axe. Is that even rare? The visitor, The Reaper, Black Knight, Omega, Wildcat, and psycho bandit are the only skins if i had a chance I'd like to have. Renegade Raider.....eh......over rated. I do think the game would be weird with a million black knights and Renegade raiders running around. It's nice to feel unique, but it's also unfair to be left out. Um....thats life, guys. You can't always get what you want. Is it fair that there are guys living in mansions driving sports cars, banging super models, and not you? No, but that's life. I always liked redesigns for popular characters. I think its a fair compromise. Dont have spider man? Heres a different yet similar version. Rant done.

I’d say the standpoint of Epic going back on their word isn’t exactly correct. They’re more or so twisting what they said to their own benefit, as technically the only thing stopping these CH1 passes from returning is a line of text that says. It can only be obtained in their retrospective season, but with these seasons returning it is possible for CH1 passes to return without Epic necessarily lying to the player base

Besides that I do agree with the rest, but I’m biased as I did earn certain passes during CH1, before losing the account so I would like to have the chance to re-earn them if they would come back

No, you are not investing in cosmetics. You are spending money or just wasting it... You cannot invest if there is no option get a return of it. At least that you count your happiness or the enjoyment of using them, that I don't think is the point. Is not just a digital item, is that when the game close you totally lose the access to it. And it is totally prohibited in the EULA to sell or buy account, then it is more funny when someone said: "my account will lose value"... Not, your account still have the same value: zero. Any day Epic can ban your access to the account or delete it! You signed it in the EULA.

I have all the OG battle passes except 1-3, and I don't care if they return. I've seen way more OG's saying the same, than OG's who are upset about their rare skins. Just give us a style and move on. 👍 Releasing old battle passes along with ACTUAL chapter 1 will be the most hype thing Fortnite has ever done.

@BlkBornSeed I have been playing since 2017 and basically have everything and battle passes since then, not sure what this other person is going on about, I'm not crying about anything and the rarity of the skins never really mattered all that much to me, I just find it amusing they think Epic WOULDN'T when they already changed gear so many times end of the day so many times and made terrible decisions the community hated them for yet that didn't stop them and people still kept playing, this will be the same, it's actually a loud minority making a fuss out of this most rational people won't care so it's not a big loss on Epic's end and besides they will be mad and stuff but likely still come back and play the game and spend money. People casually sign a TOS not bothering to read anything and then get surprised when the game does something like that, and for the millionth time Epic won't get sued over something like this, not by little kids, teens, grown ass adults who don't have the time or money for a lawsuit much less afford at least one really good lawyers against Epic's massive legal team or better yet this even getting in the court and not be dismissed off the bat for either it being a complete waste of time because it's so petty and because you signed the TOS, again TOS is also subject to change but that's on Epic's terms not anyone else's so it wouldn't benefit you either.
