The whole justice system needs to be scraped and start over. The state holds all the cards. You are innocent until charged. After that you better have deep pockets and prove you are innocent.

#3. Steve Czengros, the prosecutor for Parke Co. has allowed a lot of cases go forward simply because he has the backing of the county and this is one of the poorest counties in Indiana. That's pretty much the reason he does that. A lot of these prosecutors need to have a meeting with Mr. Luigi because those people are really what we'd term Judicial bullies. They wanna make the cases outlast the defendant's bank account.

I’m here in Florida and I see a similar attitude at times-where they have all the power and feel like they won’t be challenged by the poor people, so why not? It’s sad

That’s a judgement call but I’ve seen some pissed off judges who have wondered out loud why the prosecutors thought they could bring such a weak case

That's why you have to approach every case as if you are ready, willing, and able to go to trial.

Yep I've had to defend things that never happened. So how could there be evidence of anything? Even when I pointed out that the evidence was non-existent (I didn't own the car described, the road does not have the features described in the accusation, etc...), that just made the judge mad, because "how could police be wrong?"

Oh btw the court house and the police station are in the same building. They all know each other, and they all get paid to be there in court. I had to travel to another state to a small town to defend the charge, cost me just as much to go there as the fine. They have a go at you thinking you'll never turn up, and then just lie when you get there.

And they're just like "Where's your evidence?" Why would I have evidence of something that didn't happen? I went in with all my research about the law and the road and that didn't count for anything. A lot of what I tried to say was just objected to before I could even finish saying it. I don't know why. Their evidence is their official looking paperwork that they wrote themselves - that's it. What an absolute farce. There's no winning against the system.

The system certainly has a lot of rules and if you don’t know & PRACTICE them they will have no mercy. Being innocent isn’t enough, you must have good representation

Your statement should be all the proof you need to realize what people call government doesn't exist because it's nothing like the government created by the constitution. You should also recognize the fraud when a fictitious entity takes you to court and the crime doesn't exist. If you can't make up any charge against someone and they have the obligation to prove they didn't do what you claimed then why would you assume that you would have to prove that you didn't do as they claimed?

@@jgcrimlawdoesn't matter what their rules are because no authority was ever given that granted authority to any branch of the government that makes the people a subject of the government. If the people are the sovereigns and everyone in government are public servants then there is no way the servants can obligate the master to comply.

You either end up being recharged, or get to be on unofficial probation until the statue of limitation on the charge runs out. What I mean by "unofficial probation" is basically drawing zero attention to youself by law enforcement, if you end up on the radar again they will charge EVERYTHING possible, this gives them leverage to bully you with down the road. I would presonally refuse to allow a charge to be dropped in this manner, either full dismissal or verdict. Our legal system is a nasty disgusting place if you get right down to it, its designed to be adversarial which is good for the individual, but its not perfect and leaves things like this floating around.

In Florida criminal cases that is not quite the right terminology because many times either side may file an appeal and challenge things

#3 Prosecutorial Discretion - This is when Alvin Bragg (NYC) and George Gasgon (LA) decide not to prosecute major felonies because of race or ethnicity. OK, maybe not dismissed but reduced to minor misdemeanors.

I’m not deeply familiar with the cases you mentioned I practice in Central Florida so I’m just reporting what I see here and the reasons they exercise discretion here are too vast to list (half the time I’m not even sure they know exactly why they’re doing it…)

a technical point: that heavily patterned shirt comes off as 3 dimensional. it looks like chain mail when you move. if you were taped with an old school analog video camera it would shimmer in a rainbow of colors.
