isn't the word Impeachment used only in the case of President?? should'nt it be removal of SC judge in the Prelims practice question mentioned here? I marked 3rd point as wrong because of this. :D

The Jammu and Kashmir High Court struck down that state’s iteration of the Beggary Act. In a detailed judgment, its Chief Justice Gita Mittal identified the colonial origins of the law and found it to be a gross violation of human dignity, equality, and freedom. The Beggary laws “begging” is defined as “having no visible means of subsistence and wandering about or remaining in any public place... in such condition or manner, as makes it likely that the person doing so exists by soliciting or receiving alms”. Thus, beggary laws provisions is not to protect public peace or prevent crimes, but to effectively “cleanse” these spaces of individuals who appear poor or destitute. People found “begging” can be arrested without a warrant, and after a summary procedure, thrown into “Beggars’ Homes” for anything between a year and three years. Upon a “second offence”, the punishment could extend up to seven years. The petitioner before the High Court, Suhail Rashid Bhat, challenged the Beggary Law, on the grounds discussed above. The government, defended the law on the ground that it was necessary to make “good citizens” out of “beggars”, and that it was necessary to maintain public order and argued “beggars” caused annoyance to tourists, and to crack down on “organised begging.” analysis The High Court then made the crucial observation that “begging and homelessness are indicators of abject, chronic poverty.” And poverty, the court noted further, had social causes: “Beggary is a manifestation of the fact that the person has fallen through the socially created net. It is evidence of the fact that the State has failed to ensure that all citizens have even the basic essential facilities.” The court, therefore, rejected world view: poverty is a consequence of individual failing.The court then addressed the question of fundamental rights. As “begging” was a peaceful method by which a person sought to communicate their situation to another, and solicit their assistance, it was protected under Article 19(1)(a)’s freedom of speech guarantee. The government’s stated justification for criminalising “begging” - that of turning people into “good citizens” - was vague and undefined; nor was it demonstrated how incarcerating “beggars” into homes would transform them into “good citizens”. The law also violated the constitutional guarantee of the freedom of movement. the court noted that there existed a large number of itinerant communities such as the Gujjars and the Bakarwals, whose very nature of existence - moving from place to place, and displaying none of the “conventional means of subsistence” - would bring them within the ambit of the beggary law. The legislation,noted that who have no support at all, institutional or otherwise and are bereft of resources of any kind”. This, coupled with the draconian processes under the Act, violated the right to life and personal liberty under Article 21 of the Constitution. Submerging individual rights “punitive constitutionalism”. Punitive constitutionalism seeks to submerge individual rights that an individual may be stripped of their rights if they do not do their bit to contribute to this project. For example, laws barring political participation to those who have more than two children (thus submerging the right to participate to the imperatives of population control), Rights, then, are no longer about being human, but about earning the right to be treated as a human. The beggary laws belong within this same family of punitive constitutionalism. The Jammu and Kashmir High Court’s judgment, therefore - which is explicitly premised upon the unconstitutionality of “invisiblising” a social problem by criminalising it (as though it is a matter of individual fault) - shows us the exact way in which our Constitution rejects this harsh world view. For that, it must be applauded.

Ans -1 Law on beggars is colonial hangover in India passed during British era called beggary act. It is draconian law in Indian constitution which violate right of individual. Beggary act provide very broad defination of beggar which inculde - no means of subsistence. - wondering . - seeking arms in public space . This act is discriminatory against poor people and it also target nomadic tribe such as gujjar and bakarwals ( move from one place to another in search of foof ,fooder etc ). Under this act any beggar get arrested without any warrant and send to detention centre called beggers home in the name of transforming begger into a good citizen to maintain public order in society and to prevent crime. Recently HC of J&K struck down the beggary act and declare it as unconstitutional beacuse begging is not just a failure of individual ,rather it's a collective failure of state . It also violate fundamental right of individual. Article 19(3) Right to movement (Right to wonder and right to seek arm in public places) and Article 21 Right to life and personal liberty.HC ruled that treatment provided in such beggers home is against human dignity .

Sir for the question of CAG. ACC to Laxmikant, CAG submits 3 audit reports to appropriation, finance and public undertakings. So then the reports of CAG are considered by finance ministry? But the option was not selected. Please clarify d doubt. Thanku byjus

No ever and never because according to constitution of INDIA only this one applies on the removal of PRESIDENT in which required specail majority (toghest majority) two third member of the total strength of house.IMPEACHEMENT only for the PRESIDENT.

Strictly the term "Impeachment" refers only to the procedure of removal of the President, but colloquially it is also used for removal of CEC, SC and HC judges, CAG etc as well.

Dear Aspirant, Technically, the word impeachment is used only for the President and it has been mentioned in the Constitution only with regard to the removal process of the President. But for the process of removal of SC and HC Judges, CAG etc., the term impeachment is used in regular parlance to refer to the removal process of these constitutional functionaries as well. In a country where around 20% of the population lives below poverty line, the prevalence of beggary can not be ruled out. The prevalence of begging itself is an outcome of failure of state in addressing the issue and building up an adequate social safety net. Moreover the legislation on beggary in India are an outcome of a colonial hangover. It has it's roots from legislation made by colonial government as early as in 1920's when Criminalisation of Tribes Act. Based on this post independence various legislation like Beggary Act were introduced in the state of Bombay in 1958 and there after effectively throughout India in the form of various acts. There exists an issue with the intention of legislation itself. The intention of the law is to civilize the beggars as per the western standards and notion of being civilized. Secondly it amounts to constitutional punitive ism wherein the law aims to punish the individual for the failure of the state to provide the basic sustenance to the individual.Thirdly it doesn't take into account the special needs of certain tribes, like for instance certain tribes being nomadic like Gujjars and Bakhrwals are basically wanderers and Beggary Act criminialises the wandering. Thus making the legislation insensitive to the rights of the poor. Thus the recent judgement by J&k where it struck down the Beggary act uphelds the rights of the poor and prevents from any possible discrimination due to constitutional punitive ism adopted by the government.

As far as I know, impeachment is only for the president of india.then how CAG can be impeached?

No it’s not only for president. Some other high professional posts like CAG also has impeachment privilege, it can only be removed by parliament.

impeachment is also applicable to all judges of supreme court and high court. the cheif election commissioner as well as CAG re also removed in the same manner as Judges of Supreme Court & High Courts.

Sir 27:36 you said CAG submit it's report to parliament but in Laxmikant page 23.3 left side para 2 line-4 said that The CAG submits 3 audit reports to the president and president puts this report in front of parliament... Please clear my doubt...

Dear Aspirant, Technically, the word impeachment is used only for the President and it has been mentioned in the Constitution only with regard to the removal process of the President. But for the process of removal of SC and HC Judges, CAG etc., the term impeachment is used in regular parlance to refer to the removal process of these constitutional functionaries as well. Yes! The reports of the CAG are submitted to the President in case of the Union and to the Governor in case of the State who in turn cause them to be tabled before the House

CAG can be impeached.... On grounds of misbehaviour or incapacity

I have a doubt. The constitution of India mentions impeachment only for the President of India. The CAG is removed in the same way as the Supreme Court judge. As far as I am concerned, procedure for removal of a supreme court judge is not impeachment

Yes, impeachment is only and only for president and otherwise removal of the office holder .

Avian Botulism is an avian neuro-muscular illness. It results into paralysis of the bird and an eventual death. The primary cause for botulism is the presence of bacterium called clostridium botulism that produces and releases neuro toxins. The bacterium thrives well in any water body have low oxygen and high protein substrate. Thus wetlands which are shallow and narrow are rich source for bacterium. Moreover avian botulism is not contagious that is it doesn't spread from one bird to another but yet recently in Sambhar lake there has been more than 18000 bird deaths have been reported. The primary reason for such huge number of carcasses of birds is due to the maggots. Maggots are basically the hosts that carry the strains of avian botulism and a bird on eating the maggots get infected by avian botulism and eventually leading to their death. Thus the avian botulism has a huge impact on the migratory birds and can have direct impact on their existence.
