The Home Office Is Not Always Right. How To Successfully Appeal A Refusal

Absolutely. Lawyer is so right. Everybody must respect the laws of the land. I have lived in US for 40 years. I am still a citizen of Ghana but I have residency. That does not make me a citizen of US. We have a saying that ignorance of the law is not an excuse. His children can appeal for him if they like but there are penalties that goes with that.

My question is on which basis was he living in the uk over all these years? He was just living without any specific leave to remain? What leave was he leaving on?

Exactly what l said when l heard the man’s case. Lawyer has confirmed my assessment of the case. The man’s explanation doesn’t make sense and when l heard him on Good Morning Britain, it seemed he knew what he was doing. Anyways, let’s see if he’ll be considered.
@brighttetteh499926 күн бұрын
Exactly me too. I was wondering if he applied at the time. But the fact that you have stayed that long, does not make you a citizen automatically. For 47 years, you did not even tried like when you stayed for 10 or 5 years or your first marriage. Its sad though but the law is clear.
@katelynn254825 күн бұрын
Me too. He came as a student and never left. That does not make you a citizen. You may be a resident but not a citizen. He needs to be careful that they don’t deport him. If you break the laws there are consequences. I feel sorry for him but he can still go to Ghana and come back. He still qualified for his pension. He worked and so he has those benefits

You can live anywhere in the world if you don’t apply for it how can you become a citizen or what’s was the status he came in with why didn’t you seek it? It was cheaper then , maybe you BS Ghana for 🇬🇧 until you find out the real McCoy.

That does not make me a citizen of US. We have a saying that ignorance of the law is not an excuse. His children can appeal for him if they like but there are penalties that goes with that. If they allow everyone who have stayed longer then there will be a lot of lawsuits where people will cite discrimination if they are refused that same request.

Folks, he made that decision. He probably did not intended to return Ghana from the beginning. But he forgot or he had to regularize his stay. His total faul Ignorance of the law is no excuse

But what about his date of birth he was born in Ghana 🇬🇭 before the independent that made him British During that time we are all British under the British rules thanks God bless
@brighttetteh499926 күн бұрын
The fact is simple. He never registered to be a citizen. Colonization, does not make you a citizen even at the time.

WHY DO PEOPLE FEEL SORRY FOR THIS MAN ? WHAT THE HELL WAS HE DOING IN 47 YEARS, MARRIED TWICE TO ENGLISH WOMEN, WITHOUT MAKING CITIZENSHIP HIS FIRST PRIORITY. ? HOW CAN HE JUST ASSUME THE CITIZENSHIP WILL COME AUTOMATICALLY TO HIM, JUST BECAUSE HE HAS LIVE THERE LONG AND PAID HIS TAXES ? NO MATTER HOW YOU TWIST AND TURN IT, IT DOES NOT MAKE ANY SENSE HE NEVER BOTHERED ABOUT IT IN 47 YEARS. HE HAS HIMSELF TO BLAME.

Rather the law don’t make sense. Common he can’t force the law. rather the laws force their power on people. He is a Ghanaian and Ghanaian are humble and respectful people we obey any thing on earth. So I don’t see how a civilized world will do this to someone who have lived 47years and have kids with English women payed taxes served dined of a visa. Don’t make sense. This guy sunak
@KofiGreat-hb3oi25 күн бұрын
It is not as simple as you see it. The laws changed over time. At a point in time, he was a full British citizen, but the laws changed at a point that affected him. He might not have known that the new law affected him.

The man is stupid.. He never intended to go back to Ghana abinitio. There so many people in his position.

When they refuse you, they will say no right of appeal or administrative review.

Decisions are made on case by case basis. The same rules doesn't apply to every case.

@@kikikeel7695 Not necessarily true there law, guidelines and judicial precedents to follow.. He is even lucky not to be detained by the Home Office

@@samuelbediako3050 Yes, but each case are reviewed on their own merit within the confines of the law. A mitigating circumstance for one case could be rejected for another.

It serves him right, how can you stay away for 47 years without even visiting your mum, now he wants to come and bury her. These people don't want us here so he should have known better.

The US citizenship will change soon. They are debating now. He was a crazy man. You cannot assumed. Assumption is not law. Again, he did not even renew his Ghanaian passport. He did not visit Ghana, bring his children to Ghana, visit his mother but want to bury the mother. Why bother now. She is dead already. He is legal, and he has to pay taxes because he worked and earned income.
