this is a great video. personally i think this is a multifaceted story and i appreciate you covering all the different angles to it and goes to show that many scandals often aren't as black and white as many would portray them. on one hand, i can sympathize with Wilson-Raybould standing up for what she thought was right, especially under immense pressure to go against what she thought was right. i can also sympathize with the position Trudeau was in, not just with regards to not wanting to piss off Quebec, but also with the idea that an entire company shouldn't have to pay for the actions of a certain number of it's employees. one thing to keep in mind is that it's almost impossible to do business in third world/devolving countries without doing some shady, under the table dealings. bribery is very much entrenched in these countries. i'm not saying it's right, but that's just how it is. if you really wanted to change that, it would probably be better to pressure the governments to do so rather than only punishing the business, because doing that really lets the corrupt governments that facilitate the culture of bribery and corruption off the hook.

I understand the need to punish SNC-Lavalin but it is not fair to risk thousands of jobs for that. If SNC-Lavalin was to be blacklisted, all those innocent workers would lose their job.

@Kevin Goetz I don't love Trudeau, I hate him. But still, all those employees, do you think they deserve to lose their jobs? I don't think so. I don't know where you live, but if you live in Alberta, I'm trully sorry for the situation you're curently in. If I was in that situation, I wouldn't want it to happen to other people. That's why I'd only punish those involved in this problem, not all the company.

Attorney General of Michigan should not be involved in case against Dam owners as she was one that prevented them from lowering water earlier that would have prevented the flood.

They tried it in the US in 1987 and its called "independent counsel". It didn't work out. Just search about Morrison v. Olsen Supreme Court case.

the real scandal here is the fact it took a decade to even get the ball rolling. if these charges had come up closer to the actual crimes, it would have been cut and dried. but no. the thing here is that when you appoint someone to serve as the guardian of the law, you have to expect them to do that and let them be to a large extent. if you're not willing to, you need to actually make a stand. so the other big thing that would piss me off is this silent pressure campaign. if you want her to do something and she refuses, you have two options 1) accept that you appointed someone to exercise this judgment and stand by their decision or 2) fire them on the spot and take ownership of it. It would have been a few days of "oh my, the PM fired his Attorney General!" and the rejoinder "I'm thinking about the jobs." is pretty convincing if you just take ownership of it. In short, the Prime Minister is going through pretty much exactly the same general type of scandal that generational politicians like Hillary Clinton or Ted Kennedy here in the US got into. You get to thinking you're so good at playing the game watching your husband/brothers/father play the game and then doing ok at it yourself that you overreach, overplay, and you lose everything.

I just don’t understand why do other Canadians hate Quebec so much , there’s a lot of people in our province who think that Quebec deserve less power in the federation. And for the scandal, A lot of people do not support SNC Lavalin because of the corruption that they did in the past. We have other « Fleurons » in our province that makes billions each year. It’s just sad how us, Quebecers see other provinces like our friends, but you see us like traitors ...

I'm not Canadian but from the sound of it it seems like the kind of scandal who's root is not the actors themselves being corrupt (even if they are) but the underlying system that allowed them or even forced them to make the decision they made. I think your point that the company would not face charges no matter what party was in charge seems valid. It's one of these things were the opposition gets to complain about the government without having to commit at all to changing any of the systematic errors that created the scandal in the first place.

The Utte! Canadian politics are very cyclical in that sense. The opposition party is always incredibly theatrical and blows up everything to make it seem like a crisis. Meanwhile the government is always pretty incompetent and engages in shady and ethically dubious practices.

The opposition have nothing to gain from criticising underlaying causes and systems and all to gain from putting all blame on individuals in the government for what they will later do themselves. Just look at Democrats and Republicans shouting at each other for Gerrymandering while being much less inclined to push hard for a ban on the concept. My country (Sweden) is the same. Unfortunately this is is a cause for mistrust in the 'establishment' to begin with.

My thoughts exactly! I can't say I'm any more decided in how I feel about the issue, but I certainly feel like I understand it a lot better. It's so nice to have a source that is looking to explain the issue comprehensively rather than just push an agenda.

As a Canadian, I appreciate your coverage of Political Issues within the Country, I often find it hard to Politically Educate myself with so much information that's quite biased. So I enjoy your typically very neutral delivery of facts. I had seen this scandal all over, but I wasn't really sure what happened. I had thought that Willson-Raybould had done something terrible, but I think that goes to show how living in a heavy Liberal Province (Nova Scotia) can paint the picture they want people to know. Thanks again!

Hey JJ, I am currently living in Ottawa for school and have been trying my best to follow the scandal. I personally am still dumbfounded that SNC isn't facing more reprocussions - for example, they got the bid to do maintainance on the LTR trace here yet there were better options with sounder track records. This reflects the longer standing tradition of chosing Quebec based corporations over others. I think Justin should've let the prosecution go and then focused on how to mitigate the 9000 jobs lost. Show everyone that he would stand for our values and make the workers a priority. Side note; Andrew sheer calling for the RCMP to look into this scandal is so ridiculous in my mind and such a political ploy for his base.

Oliver Understand your point but there is not a whole lot of compagnies hiring 9000+ canadians like SNC did. The '' long history '' of favoring you are talking about is often referred and mentioned but ppl tend to forget to highlight the economic importance that Quebec has in this country. 20% of Canada's GDP comes from that singular province, so from a political point of view it is completely logical to see elected federal officials trying to implement policies that favor that huge political base. I am not saying it is the right thing, I myself am from Quebec originally and I despise the idea that we should receive favorable treatment. But from a political standpoint, it is logical and there is a not a government around the world making policy that could make 25% of your country population hate the party it is affiliated to. That is the only thing that I think is missing when people talk about Quebec, they tend to avoid mentioning how important the province is to the rest of Canada. The best exemple for me is when JJ spoke about elected officials having to speak french and that generating an career advantage for french speakers. First, he failed to mention that this precise phenomenon is basically non existent in province governments, meaning that a PM in Alberta is not required to speak french (even though he does really well) for exemple. Also, he failed to highlight the fact that QC is 25% of Canada's population, making it completely logical that parties would want their representatives to be able to communicate to that 25% in their mother tongue. A lot of problems in ROC-QC relationships are endogenous to the way our country is made ; not always because Quebecois wants something more out of our federal system.

I'm not the biggest Kenny fan but clearly the province isn't divided over this. Rachel Notley has been one of the worst premiers in Canadian history and has been very vividly anti freedom of press and speech because she gets criticized. Shes costed them billions and tens of thousands of jobs. Wild rose is dead so Kenny will be elected.

Let's be honest, the only reason that the NDP were able to win an election was because of the Wild Rose Party splintering out of the conservative party awhile back, and even then it took a couple of elections to get into power. Now that the two conservative parties have been reunited as one and are no longer splitting the conservative votes, the NDP don't stand a chance as far as I'm concerned, regardless of which side is better or worse.

@@thinkabout288 Most historic rule is with faults, I would prefer to be avoided. Systems that offer training before the job appear to be more stable (hereditary monarchy, meritocracy... even the offices, that are prerequisite to roman would offer some training). Obviously there are limits to the extend of training possible outside of office and I would Imagine Trudo has those parts and therefore surpassed many historic rulers.

J.J, I am new to this channel and I have to say I'm still in shock and surprised to see this video that actually makes the best example of what is missing in today's media. John Stewart Mill was right in his quote "if you only know your own side of the case, you know little of that" I don't make value judgments and I rarely see a single issue on the media sources that I use to make a decision based on the fact that pure judgment has been engaged as a way to keep your critical thinking skills active. Cloud Strife this is actually very interesting point. Neither JWR or the prosecutor have explained their logic. We’re just supposed to take it for granted that they made the right call and that no subjectivity exists.

I was actually scrolling the comments looking for someone mentioning the DPA. I wish this video would have delved more into that. I have heard that given the seriousness and repeated offences of SNC Lavalin - a DPA would not have been an appropriate course of action. Of course we cannt hear this directly from JWR but this is a probable speculation. To be granted a DPA a company has to show genuine remorse and change of ways.

The way that ministry has operated historically and still kinda does is very ramshackle, bureaucratic, and historically racist overall. She believed that trying to put her in charge of that would be like having MLK Jr. run pro-segregation campaigns or having Nelson Mandela force apartheid.

Seumas Schmieð JWR has a very confused philosophy in regards to how individual aboriginal people should interact with the aboriginal services bureaucracy. She seems to bounce back-and-forth between whether or not it is defensible to engage with it on pragmatic grounds or whether or not it should be just undermined entirely as a racist abomination.

If only someone were available for that position who was motivated to improve the lives of first nations people.

As an Albertan I can say many in my province are strong supporters; particularly those directly employed and/or benefiting. Those opposed (probably a minority in Alberta) have the attitude that many outside the province are accused of having. "I'll take the better government services while not acknowledging the subsidies the oil industry provides to other taxpayers". If it were not for oil royalties Alberta would need higher taxes to pay for its quality, but relatively expensive, public systems.

Thanks for making detailed yet still concise videos. I don't know all that much about my own country's politics to be honest and this is a good first step to fix that. I also really appreciate that you manage to be engaging but don't get bogged down with distracting editing or trying to come off as "likeable" and "entertaining" like some other channels.

Your description of what deferred prosecution agreements are and how enacting them is actually bringing Canada up to speed with the rest of the developed world was key. A lot of people are missing that point. If they opened up the Criminal Code to see the section on remediation agreements (the Canadian legal term for DPAs), they'd realize it does not mean letting a corporate criminal off scot-free.

I love how you handled this. It really gave both sides of the argument and where everyone was coming from. I can say Trudeau could have handled it better but the reasons behind the shuffle and where everyone ended up made sense so I dont think its quite as diabolical as people were saying.

Personally as a Canadian living in Ontario. I have to say that the Attorney General should not be appointed by the PM, but by the Justice Department. As a Conservative, I agree with JT but WR stood up for what she believed in.

This might be a bit of a stretch since they’re completely unrelated, but this scandal reminds me (to a certain extent anyway) of the whole mess that Brexit has become over here across the pond. Every side of the argument has valid points that are *probably* correct, yet every side is also just so intently focused on their own individual agendas, whilst trying to save face in the public eye that no solid conclusion as to what the right action to take is can be reached. Every side is right, and every side is wrong. And there is no clear answer as to what the right path is to take. Welcome to the scummy world of politics, lol

I agree that if the price of doing business in the 3rd world involves corruption and bribery, then that price is too high. On the other hand, there needs to be a statute of limitations on how far back you can go to prosecute certain crimes, and whether the crimes were committed before or after certain legislation was passed. And on the third hand, it is indeed screwed up that the AG department is part of the executive branch of government. It should probably be administered by the judicial branch, with certain appointments checked with a confirmation process by the legislative branch and with a certain amount of immunity granted to the executive branch via executive privilege. as for Lavscam, maybe the best deal is to conduct a non-criminal investigation so that recommendations can be made on what went wrong and how to prevent this from happening again in the future.

@@spearheadbt9601 Third world countries are a lot less likely to be democracies and much more likely to be run by dictators (real or de facto) who have little or no accountability to the press or an independent judicial system. This is born out by the "Corruption Perceptions Index" which routinely lists Canada as among the least corrupt and various 3rd world countries as the most corrupt.

But we like to pretend that it is not (or negligibly so). Plus people around here are much better to hide the corruption, because you need to. Not so much the case in 3rd world countries run by dictators. My point is that it is ridiculous to play the offended virgin when it comes to corruption.

Canada is consistently in the top 10 of least corrupt countries in the world as rated by a consensus of independent international organizations. Now you may disagree with the mainstream experts, but your opinion means little without the same amount of data and research which they have presented. So, show me your empirical evidence of what differentiates the various qualifiers of corruption, and why Canada is classified as one type rather than another, and counter-examples for other countries on said scale. Cheers.

A few things Lavscam has made apparent: - Attorney General needs to be a non-elected office which is completely separate from the Justice Minister and from the executive and legislative branches of government. - Clerk of the Privy Council (as a bureaucrat) should be objective and not a persuasive communicator between the PM/Justice Minister/Attorney General. - It is difficult to establish that the Scott Brison departure and subsequent cabinet shuffle forced any move at the Justice Minister/Attorney General position, despite testimony given by Gerald Butts. He explained that she was offered the Aboriginal Services portfolio, but did not adequately answer the question "why?"

The main scandal here is that anyone can believe that businesses do not need to face full legal repercussions for their actions. Money is such a choke point in global politics, but in North America it seems to make it even more difficult for anything to be done. Presidents, opposition leaders, political parties seem to be distracted by the interests of the wealthy as if they were dogs being thrown a tennis ball. They will run after it, fight over who gets it, and dutifully bring it back to their master, sitting obediently to run after it again. This is not healthy. SNC should face full charges for their crimes pertaining to the previous Libyan dictatorship, no questions asked. Their conduct is undoubtedly shady and they deserve no business in forward thinking countries worth their weight in salt. Ultimately, if they are dismembered by the results, it should be seen as a warning to companies willing to exploit unstable nations, cooperate with oppressive autocrats and ultimately prey on the populace in any nation they do business. My father works for a company that takes construction projects from government, but if evidence came up that any business in Barbados, Ghana, UAE, UK etc was gained illegally, exploited or had other such criminal notations, I would feel no guilt in rallying for full and overarching justice, even if my family is implicated in any such scandal, provided it can be proven true. Businesses who disobey the law in any way should be sanctioned by the law. No doubt in my mind.

@@louisd.8928 Yet the ugly truth is that he did not need to, because Kinder Morgan would not have sold it to the federal government had Trudeau declared the pipeline in the national interest. Now it appears that the TMX expansion will remain in foreseeable future because of the legal challenges. Then again, I wouldn't expect Quebecers to realize this because of their insular and coddled nature.

As a Quebecer I appreciate the balanced approach you took to explaining this story! You used the term "Fleuron" and, unfortunately, in Quebec this designation is often used to justify many dubious political decisions - Example: Getting the Caisse de Depot to provide Quebecor financing (at very favourable rates) in order to purchase Videotron just to keep Rogers from purchasing Videotron. That said, there is the Realpolitik factor that comes into play. The new management at SNC have cleaned up a lot, the law does make provisions to acknowledge this and to cut the company some slack provided they allow a watchdog to monitor their business activities going forward -similar laws exist in the US and UK... In summary, from the looks of it, the AG chose to ride her high horse and not even consider any form of compromise. The AG position is, sadly, somewhat political and that is just a fact, like it or not.

Would be interested in the corruption they have done inside of Canada. I get that foreign nations can be impossible to do business when they are swimming in corruption and lawlessness. So lets look at their record in Canada. From a relative who works in a building built by SNCLavalin they have MUCH to answer for including bribery, cost overruns and shoddy work.

Speaking on corporate personhood; well In the U.S a corporation is a person. Its controversial to say the least in the U.S. The U.S. Supreme Court declared corporation a person a few years back and it gives them full right in the U.S as any individual person would have. It was in the case Citizens Vrs United. It lets corporation make laws that would violate a persons Civil rights; such as firing a LGBTQIA person or a corporation didn't have to pay for birth control in its healthcare plan because it was against it on religious grounds as Hobby Lobby has done in the U.S because that would be against the corporations religious beliefs :ie a Christian corporation . As many outside the U.S might not know we that live in the U.S get our healthcare insurance from our employer and not for the government as Canada does. I do the like the idea that the Attorney general in a nation is separate from a president, primminster or a king or queen because we have seen to many abuses of power in history has has happen in the U.S. Also in the U.S companies tend to want to give money to a politicians campaign, done by the way of superpacs, so when elected the person will support laws in favor of a company and industry. Which all leads to crony capitalism. So to me it looks like Justin Trudeau is involved in crony capitalism by favoring a company over justices and also putting Quebec interest over justices also because he is talking about what would have there if the company pulled out of Canada.

I think both side have some merit. I think the AG wanted to make a name for her self for bringing down a large corporation.On the other hand I think the prime minister wanted to save the jobs Quebec due to the fact he is from there and it was an election year. One question I want ask is if it were a different company located outside of Quebec would the prime minister have try to stop the charges against the company or let fall because it not in his home province and would in turn make him look like he is tough on big business?

George Gomez - research the interview with the SNC CEO from Thurs night. I think it was on CBC? (I don’t do tv, have my own network system) Jobs were never discussed in this issue. You would be correct. This is federal election year. His voter base IS QU. He needs votes as in the recent provincial election, QU voted in the Coalition Party, unseating the previous Liberal party. (NB that the BIGGEST hole in the border allowing a steady stream of illegals into the country is at the QU border - which this gov’t has basically done nothing to stop the flow)

I think the concern about defending 10,000 jobs is highly admirable but its complicated by the fact the company is an established enterprise of a state that wields significant influence over the prime minister and is a state that is at odds with the rest of Canada due to its unique french rooted identity. What makes even more challenging, I think, is this notion of precedence for future corporate scandals and how they will be dealt with especially those that put alot of jobs in jeapordy and would influence politics significantly depending on the consequences of its prosecution.

Angelo Busato - in the most recent interview with the CEO of Lavalin, he said none of this has ever been about jobs. Jobs were never discussed. The CEO stated that there was no concerns about jobs as these engineers would be qualified for other companies doing similar work, that is what it was never an issue. Even though the latest charges were in 2015, their bribery track record goes back at least 20 years. This is the 4th time this PM has been investigated for ethics violations in his tenure. This AG allowed the justice system to apply the rule of law. She was approached about 12 times by various liberals to pressure her to interfere to have the DOJ change their ruling. She refused + wanted them of interference and obstruction. She was shifted into new cabinet position. Other resignations started and the whole cover up began to peek out. Still much more coming.

Excellent presentation, especially looking at SNC-Lavalin from the point of view of how an international construction company obtains contracts in dodgy third-world countries where its competitors also offer bribes (US companies not least). There is another aspect too. What was Jody Wilson-Raybould's role in the (still-continuing) prosecution of Admiral Mark Norman? The Admiral Norman case began because the incoming Liberal Government attempted in Nov 2015 to halt a contract to convert the freighter 'Asterix' into an urgently-needed RCN Supply Ship. This RCN plan the Department of National Defence at the end of Harper's time in office had agreed to, but it had not finally signed the contract. Leaks about the Liberals' attempt to undermine the programme (and as result leave the RCN with no supply ship until 2022) reached the press and the contract was hurriedly signed. The 'Asterix' was converted by 2017 and is now in operational service, but the Admiral who had set up the contract is being prosecuted on very weak grounds as he is suspected of backing the leak (though plenty of other people knew of the Trudeau Government's initial intention). The prosecution of the most senior naval officer in Canada could only have been commenced with the Attorney-General's agreement, and the A-G was Jody Wilson-Raybould. The Opposition doesn't seem to want to mention the subject of the Admiral Norman prosecution because they want to lionise Jody Wilson-Raybould over SNC-Lavalin.And on the case of Admiral Norman, JRW does not appear to have clean hands. It does look as thought her reticence now about speaking (even in the House of Commons) reflects her awareness that if she gives press interviews the Admiral Norman case will be raised with her, and she will come across as the woman who ordered a prosecution in the interest of her party, not the country. The Admiral's lawyer, the effective Marie Hinein who won the acquittal of Jian Ghomeshi in 2016, is moving for the case to be dismissed. If it is, Jody Wilson-Raybould will be under the spotlight for having pursued a case for political reasons.
