Thank you for the information Ma. It’s encouraging and comforting to know that the court is on our side and the side of our children. However I don’t feel like that when we’ve been left with no maintenance for years; no food, electricity and water disconnected , children about to be kicked out of school yet the father has money and lives a luxurious life with mistresses. Our case keeps on being postponed. I’ve got Rule 43 court order (pending divorce) stipulating what he has to pay but he doesn’t. Tried warrant of execution and the sheriffs claimed they couldn’t get hold of him or the cars etc to attach and sell. So recently we applied for contempt of court and it’s more than 8 months and nothing has happened. He changed the matter from uncontested to contested at the last minute then it had to be put off the roll. Applied for a new date and now am told him and his lawyers are refusing to file the heads of argument. So my question is can that cause the contempt of court application to be struck off the roll and delay it again or not? If so, what other remedies are there? Your response will be highly appreciated.

This is very helpful information. I will be prepared for my appointment in January after the father of my kids failed to pay for 2 months. I've already completed the form for failure to comply with a maintenance order.

My child's father wasn't cooperating from the get go. Distance is also a factor. We live in different provinces and I dont know his original home address. All I have is his contact details and ID number. With the amount of technology going on I don't understand why the maintenance court official didn't arrange a zoom meeting or something😂😂😂. The man literally told them that he won't be attending any meetings and told them to back off and they did. From what I heard from the investigators he was insulting them🤦🏾. So I also gave up🤷🏾. He was fired from work in July 2023 and I opened a case in August/September 2023, hoping that they will force him to share his pension funds with his kid but that didn't happen. They even tried calling the company and it seems like that was also a dead end. Maintenance court can only help so much, we need to be honest about that. People default and they are let of the hook just like that. No arrests, nothing. I have very little faith in the system after my experience.

I can relate ,I struggled even at home affairs for his signature on unabridged certificate he never wanted to sign and write his name and surname .I do not know why this was changed because early 2000 you could write the father s name .Now if he doesn't want to he doesn't.

Good Day Ms, in case of section 32, i have applied for sect 32 on the 25 February 2022....as we speak we currently still going on, I was cross examined on the 5 July 2022 ,the responded have legal representation. I have been to court for more the 13 months, the proceedings kept on being postponed without any valid reason.I will be in court again on the 3 April 2023.And I know it will be postponed again.I truly feel that the court isn't on my side.due to the privilege the responded has, he doesn't even pitch at the proposed court dates at times.Kindly advise what I can do

He pasy monthly maintenance which is 1000 rands.he was supposed to pay extra 2000 in June,Dec and Jan.but last year he has skipped all those months.i think because he buys the stuff for winter,and Xmas and now school he feels he can't pay..am I wrong to say he is not suppose to skip,cause he didn't even discuss this with me he just took a desicion on his own..and I don't know but am hurt and I feel like because he earns more he takes advantage of me.

I am dissapointed at court because the could never make this guy sign becsuse he never attended court.He would pay when i go report him at court.So I approached court the process is draining becsuse everytime he must appear at court he emails sick note all the 3years

@@advocatepuleng The clerk who s been handling my case says the cannot garneshee him if he never attended court ,they would be in trouble.I raise these many times with him .When he they send supoene documents he sends money ,whatever amount he wants to pay.Infact it's 8years of struggle

They have so many pamphlets on their walls🤦🏾 and I suggest that they should also put one more typed in bold big letter saying "PLEASE NOTE: IF YOUR CO-PARENT IS NOT COOPERATING, WE CAN'T DO MUCH TO HELP YOU" that way people can decide if it's worth the hustle. I gave up and decided to go and do whatever I can to feed my kid. We can't force people to comply🤷🏾 unfortunately.
