In 1844 one cell in the old Tolbooth jail held 24 prisoners and a visiting judge condemned the "wretched' and 'fearful' conditions. This new prison, opened in 1847, had a modern design which allowed for solitary confinement constant observation and hard work; the chaplain could preach to all the prisoners whilst they were still in their cells. From 1888 it was taken over as a military prison.
The Church was consecrated to a holy relic, a splinter of wood believed to have belonged to the cross of Jesus Christ - the 'Holy Wood' or, in Old Scots, 'Holy Rude. James IV, James V and Mary, Queen of Scots, all worshipped at the Church of the Holy Rude, and it witnessed the coronation of the infant James VI in July
1567. Its walls show the battle scars of later bloody sieges of Stirling Castle by Roundheads and Jacobites.
Until the 18th century those guilty of sex outwith marriage would be made to sit upon the Penance Stool located outside the doors of the Church of the Holy Rude, to be shamed before the congregation.
