neither state or cth wants to remove it coz it's just expenses - so this enabling power they have the option to do nothing so i agree no inconsistency happening!

state law is only regulatory - cth is going to win anyway if state (vic) stopped the cth to remove it - so yes the inconsistency will be operational.
