A judge's job is to find the law in the constitution, not to interpret the constitution. The constitution was written to limit government power. If it is not written in the constitution the law is null and void.

This is exactly what happened in New Mexico. And it’s happening all over the United States. I learned about water rights. When I lived in Idaho. Every single week. A certain day of that week and you got to block off and allow your property to be irrigated. People were shot and killed over this because without water we die

When I purchase my property in a subdivision of Downing Downs My realtor sat down and explained about this Water right. You get a block it off and you have a timeframe you can flood irrigate your property. If that hasn’t been explained to you go to I guess City Hall Would be my first place to start and go from there it’s gonna take a lot of literally footwork on your part documenting people you spoke with times dates. If that doesn’t answer your question, and I have an answered it to your satisfaction Please contact Trinity Vanderacre. Since he does live in Montana currently along with his ranch, he’s now speaking to. And you can find out more. A lot of these corporations are coming in and suing for what is their naturally And for All to use And the prime example Trinity use was you can have a computer and how somebody can hack it and take control of it and then expect you to pay them for them to release your personal information on your computer. @@apriltracy1523 He means you are required to take your designated allowance of water, as dictated by the irrigation district you get your water from, and allow it to irrigation your property over a set period of time. This can be done by blocking off the main ditch by dropping a gate or other method and opening access to your property, or just opening a gate that taps into the unblocked main ditch onto your property. From the secondary ditches on your property you can water different parts of your property depending on where you need the water to go. When your time is up, you unblock the main and close the access to your property to allow the water to go to the next recipient.

These are bad laws and need to be changed. We the people need to make it a priority. I could listen to this Montana rancher for hours. He knows a lot about ranching, people, and life. Farmers and ranchers are the best people. They shouldn't be sueing each other. That's what the legal crooks do; they pit the little guys against each other. We need tp clean up the legal system all over the country! Bless these ranchers + farmers. They provide the public with food. ❤

Using an Attorney, makes you a ward of the court. Why do that when you can get your name registered to do your own business. Handle your own legal business, by mail and shut them down. People don't seem to understand, we have the Administrative Proceedure Act 1946, to learn how to handle our legal business.

Everything in the west is water. Not gold! Colorado wouldn't even let you harvest rainwater till about 4 years ago, and today it's only two barrels. There are tons of folks all along the Colorado River in CO and UT who can't even use it because Californians will sue them. And that was all divvied in the 1920s. It definitely needs updated.

Why wasn't a meeting organized with all the farmers in the area who would be affected and invite a specialist like his boss, as well as a lawyer, to explain the implications of the upcoming legal fight over the water rights and how it would eventually affect every one of them? All for one and one for all. I thought farmers were a tighter knit community than that. If we don't stand together, the 'powerbrokers' will run roughshod over everyone's rights and freedoms.

Counter sue for your legal expenses, or file in district court for them to pay your water court legal expenses if they lose. I’ve tangled up with people in federal courts.

It is usually not the court systems that are at fault for this "watertheft", but the state legislatures that are controlled by corporate lobbyists. The courts are supposed to follow the rules set by the Legislature and their bureaucratic departments. These departments are easily influenced by guess who?

It's all about power and control. Beat the people out for the water rights. They think that because they have a ton of money, they will they can control it, and then the people have to pay them to use it or not. Even tho it's on their land and the owner of the land need it to be successful. They are trying to swing all the laws in their favor. The land owner can't afford to do that, so screw them. Just not right.

Wow! Shyster Greedy People and their Attorneys! So wrong! - I was told. My Great Grandfather was one of the Surveyors who Surveyed land in West Montana back in the very early 1900's - Arthur Woods. He and my Great Grandmother Agnes and Grandmother Margret lived at Fort Shaw when it was a U.S. Calvary Compound back then at the time when he was surveying the Montana land for the Government. The Native Americans would set up their T-pee's right outside the fort during winter and sell moccasins and other things they made and Doc Brown (female) who always brought her small dog with her and would drive her buckboard wagon about a half days ride out to Fort Shaw and do check ups and other medical procedures for everyone including the native Americans. My grandmother was a child back then.

I just found out recently some bottling company bought the land across from my farm thinking it had water (underground springs) which it didn't. So now they're sending letters to us asking if we would sell all or part of our land (which does have a spring)

71% of the earth is covered in water. Desalination is inexpensive and done in many parts of the world where water is scarce. Countries should put in the infrastructure so water is never an issue. This is a political and control issue, not a supply issue.

I think it would be wise for ALL US farmers to start to petition for protection laws against invasions of companies trying to steal long time land owners from these types of situations or it will never end and I would also suggest that they should not be allowed to keep filing as that seems to be harrassment if you ask me. People have put up with way too much here and you got to out wit the fox today unfortunately because people forgot integrity and neighborly kindness. My heart goes out to everyone who has to fall prey to these vultures cause believe you me Ive been held under for years and its devistating to work so hard and never get anywhere for it, its the passion for life that keeps me fighting and this is just plain wrong. I wish you guys the best, Id stand 100% behind you all on this one.

70 year old lawsuit over water in San Pedro River in southern Arizona, is being used as an example to settle other cases, if there are no records recorded on your land, you will have to jump through a lot of hoops to secure your water rights.

My thoughts exactly! All must band together in this fight (and all the other issues which are too numerous to list). Storming the courthouses with each issue independently as a “unified front” holding those doing harm accountable. A UNIFIED FRONT that WILL NOT BACK DOWN is the only way as I see it!?

Every state in the west has a separate set of water laws. In Wyoming we have an abandonment process but it is not used very often. Also, in Wyoming it is very difficult to sell you water right. Bill gentle

40 feet of drop over 4.5 miles is quite a bit of drop. Roman aqueducts only drop 3 feet every 10 miles.

Is there no such thing as “Compelled Performance” in your country? In law, no one can compel to you to do these kinds on things on the land as they would need a contract, all law is Contract Law and Contract makes the Law… you need to look into Secured Party where you can express your lawful rights

Perhaps this is simply my ignorance showing but if they are driving on his, the rancher's, land. Why couldn't they create ponds on the high ground around them and use gravity to move the water to where it's needed? But then I am also very partial to the idea of rotational grazing instead of older ideas of grazing.
