The 49ers knew exactly what they were doing. Ed Debartolo Jr. was notorious for outright breaking the rules, and apparently this was the one time the NFL actually called him on it.

@@jadalizmercedes7579 "All?" The salary cap started in '94, and the 49ers never faced any discipline from the league for "cheating the cap" as far as I know. Claiming their SB wins are tainted just comes off as jealous, and angry they were so successful for so long.

@@astrostar49 Meanwhile, back in REALITY, the 49'ers absolutely WERE disciplined for their cap cheating shenanigans, reported by the New York Times , Nov 12, 2000 (available online). Maybe they weren't cheating the cap, specifically, with Gagliano, but it's established FACT that the DeBartolo/Policy/Walsh 49'ers were CHEATERS, and this is exactly the same type of cheating they did and were CAUGHT doing. It's VERY plausible that they knew full well they couldn't sign Gagliano and simply tried to pull a fast one.

Yep, the 40 Whiners have a long history of cheating. They paid players under the table in the 80s I give them all the credit in the world for what they accomplished in the 80s They knocked the Cowboys off the mountain top fair and square. They got caught giving illegal benefits in the late 80s and a few of their players got busted for drugs Their 94 season CHEATING was the most absurd thing I. Professional sports. While the rest of the league had to play by the hard cap of 34.6 million the 40 WHINERS were allowed to CHEAT on the 1994 salary cap. They started the year at 55 million or 20.4 MILLION OVER THE CAP!! The first player they signed was Gary Plummer the starting middle linebacker and team captain of their eventual Super Bowl foe San Diego Chargers. Guess how much money they had under the ca at that point? $456.00…..not $456,00 Four hundred and fifty six dollars!! Yet after that they were able to sign Ken Norton who they said they were out of the running for after signing Plummer. They then signed Bart Oates, Richard Dent, Deion Sanders, Toi Cook, Rickey Jackson, Ed McCaffrey Charles Mann, not to mention Tim McDonald and even re signed Tim Harris who they let go along with Pierce Holt when they tried to STEAL Reggie White!!! Tim Harris was THE DIFFERENCE in the playoffs in 1994. They then TRADED their players FOR COMPENSATION after STEALING half of the 1993 NFC Pro Bowl roster. They got caught CHEATING on the Steve Bono trade to KC after cutting and re signing him to a more cap friendly deal for KC. They supposedly signed a bunch of HOF and Pro Bowl players to contracts that only paid them the league minimum of $162,000 dollars in 1994 and were allowed to defer the other $838,000 of their salaries to 1995. They then “restructured” the deals of the players they had signed at market value to keep adding more players INCLUDING DEION who they signed for 1 million or 3 MILLION LESS than he had been offered elsewhere for that year. Supposedly a bunch of HOF players survived on the league minimum for 6 months with all their houses and cars!! GARBAGE and THE REASON they were allowed to defer the money to 1995 was based on the contracts only becoming 1 million dollars if they made the playoffs…..GARBAGE!! The WHINERS also got caught CHEATING on the contracts of Brent Jones and Steve Young and THAT is what led to Eddie Debartelo being BANNED FOR LIFE from the NFL!! It would have been nice if in the 80s the Cowboys were allowed to STEAL Richard Dent, Mike Singletary, Ronnie Lott, Randy Cross, Eric Wright, and Fred Dean but it would have MEANT NOTHING if they didn’t build it themselves. The Cowboys were the last DYNASTY to build their own team. They should have been able to dominate the rest of the decade. Losing 45 players of their 53 man roster DESTROYED THEM!! I will ALWAYS HATE THE 40 WHINERS for what they did in 1994. THE BIGGEST FARCE IN NFL HISTORY!! And they still couldn’t win without Dallas spotting them 21 points in the first seven minutes and FIVE total TOS!! Jerry also GIFTED them William Floyd and Tyronne Drakeford for Shante Carver, cut Jimmy Smith and fired their Back to back SB winning coach!! And they STILL ouldnt win without FIVE HORRIBLE CALLS including the PI no call on Deion. PATHETIC!!!

Funner fact: Gagliano was the Lions starting qb on Thanksgiving day in 1989, and played so well that he blew away color commentator Bill Walsh away! Walsh remarked that he didn’t think Gagliano was capable of what he was doing, under Mouse Davis and June Jones in Detroit.

I was 9 and didn't watch football when the Vikings upset the 49ers in 87. I just recently watched the game and holy CRAP. That was a horrible performance by San Francisco, and probably the worst game I've ever seen Joe Montana play.

IMO It wasn’t a horrible performance by the 49ers - but an amazing performance by the Vikings. WR Anthony Carter made 3 or 4 spectacular catches with Niner DBs draped all over him. And he made them in clutch situations. That rainy afternoon at Candlestick is one of my favorite all time games even tho my Niners lost. Gotta hand it to Minnesota on that one.

I still think its strange how former 49er QB's ended up starting with the Chiefs: Steve DeBerg 1988-1991 Joe Montana 1993 to 1994 Steve Bono 1994 to 1996 Elvis Grbac 1997-2000 Alex Smith 2013-2017 You could do a separate video alone on that trend by the Chiefs. The 49ers had a LOT of decent and good QB's from the mid '80's on for a long time. There was Montana of course, Matt Cavenaugh was good (although as untested long term)... Then they got Steve Young...Bob Gagliano... Elvis Grbac (who went on to start for KC like Montana did.. .AND...) ...Steve Bono They had a good system where they actually coached and further trained QB's. Some teams do not coach/train their QB's (like Cleveland or the NY Jets) and those teams always suffer the most. It's amazing how many of their QB's who left... ended up starting on new teams. Jeff Garcia even succeeded Young and when he left he started on at least two different teams... (Eagles and Browns- briefly).

I'm so thankful that NFL rules are different these days. Its clubs could use the extra roster flexibility that they didn't have back in the '80s. I always remembered Gagliano as a Lion. I have no real memory of him as a 49er.

Here’s the thing, I kept hearing throughout the video “I can’t believe a team as dominant as the 49ers didn’t know the rules and would expect it from lesser teams”. Lesser potent teams are probably used to doing it more all the time. The 49ers during that regime were known for drafting, making big time trades (Fred Dean) and acquiring cast offs like Wendall Tyler and Matt Millen signings. They were never in desperate times/measures scenarios because they were always winning. Bill Walsh was the HC and GM at the time. It was up to him to know the rules. It’s kind of hard with your star QB out with injury and you get desperate. That’s also a pretty stupid rule about cutting someone in camp and not allowed to bring back for the rest of the season.

This doesn't compare to the NBA rules at all, which prevent reacquiring a player you trade away, if the receiving team then cuts/waives the player. If Gagliano had not signed with another team in the interim, I could see the NFL enforcing the rules. But he was with the Colts after the Niners cut him. His free agency rights were preserved.

John Paye was on the 49ers 1988 roster, but I don’t think he was active for any games that season. I had the 1989 edition of the NFL Record and Fact Book. I think the book said that John Paye was last active in 1987. I think the roster rules in 1988 called for a 47 man roster, but only 45 players could be active on game day.
