I think this is using faulty logic to begin with. People who look at their phone don't just stop doing it. The type of people who do this will now just not even bother turing on autopilot, and look away anyway to not be annoyed by the nag. They already do this with every other vehicle. Now they dont have a safety switch to mitigate the risk.

Exactly. The manufacturers cannot possibly deal with every situation a stupid or reckless person can put themselves (and others) into. Somehow, Tesla is being beaten up by the US government, and the other OEMs not all all. With Ford BlueCruise, it can decide to take you out of the system at a moments notice, and their notification is very subtle. You could easily assume that the car is still driving (until you reach the next bend in the road). Somehow, this is not a problem for NHTSA.

It seems strange that if I look at my phone while I'm driving, the car is totally okay with it. However, if the car is driving, and I look at my phone, suddenly the car objects to this and starts screaming at me. Also, the number of false warnings (meaning I was paying attention and looking at the road) is also way up. Subscription canceled. Maybe when v12 comes out?

They don’t do it for your safety it’s just for their liability. While the car is driving they have some increased liability for any accidents however while you are driving it is clearly all your fault if you crash.

I still think the “hand on the wheel” nag is the worst. I don’t care too much about the increased “eyes on the road” nag. I really just want to stop accidentally canceling FSD because it doesn’t sense my hand on the wheel until I put too much pressure.

I'm always turning on Minimum Lane Changes for each drive, and I have to use the touch screen to do so. It's so annoying to be yelled at when I'm turning on a setting that won't stay turned on. They took away the confirm lane change option as well in the Beta of FSD, so that's annoying too given this hyper sensitivity.

I agree wholeheartedly with this, I wish there was a setting to enable it permanantly because at least in my area, people have no idea how to drive and me switching lanes to go around people when I rather just keep driving in the far right lane and just let others go around me is much more prefered than having the car make lane decisions around people that don't know how to drive. It seems to consistently throw my car off at least when everyone is doing there own thing with no pattern to the road rather than just maintain one single lane the whole time and adjust speeds.

As an Uber driver I spend many, many hours driving my Tesla model 3 performance with FSD. I have never received a single strike but I do occasionally get a nag or two while chatting with my riders. It’s not that difficult to observe and obey our driving laws that help protect us from accidents and injuries. If more people would step up and take responsibility for their very own actions and stop blaming their issues on Tesla or other drivers we would have safer roads for all of us to use and enjoy.

Yes on this! The only strike I got is when I was texting back to back ( shhh) that was after 3 nags which I wiggled the steering wheel and then the 4th time it flashed twice and gave me a strike. Not unreasonable really. All my fault

Yeah, I’ve never had a strike. One of the improvements with the lockout is now there is a definite restoration time frame, which I think is actually pretty short considering how difficult it is to get a lockout (IMO). Previously, if you were locked out, you had to hope for one of the lockout reset updates, which could be months away.

Mine constantly nags me for not holding the steering wheel when I am. Yes, I use one hand on one side of the wheel so they're not cancelling each other out. Every time it nags I have to pull downwards to cancel it which risks breaking it out of autosteer.

Here's my take: This situation is being manipulated by the NTSHIT to make FSD so annoying, no new users will ever want it. Also, if I try to change lanes in rush hour traffic without FSD, there's a good chance I get a "Forward Collision Warning" now. This seems highly inconsistent. I've gotten warnings with TONS of free space, and nothing with cars pretty close. My safety score just keeps going up to 96, then crashing down to 79.

I think it's more likely the other way around: Tesla is retaliating against the Autopilot recall by intentionally going much further than what the NTHSA demanded, creating the illusion of the government getting overprotective.

LOL! I've hardly ever gotten forward collision warnings and when I do it never effected my score. Use AP or FSD 100% of the time and forward collision warnings will not be counted against you unless you're pressing your accelerator.

I have really not had any issues on my tesla m3 running, I never ever touch my phone when I'm driving and I use voice to text or the in car calling for everything. I get weird forward collison warnings sometimes that are false positives but these are like once a month and I drive everyday for at least an hour, I use Tesla insurance and I have full coverage on it with a saftey score of 98 and I consistently keep that score above 95. The biggest issues I have noticed are when you think you are traveling a safe distance from the car in front of you, you are to close. This car rewired my belief of tailgating as I always thought I was safe distance away but car seemed to differ, I now travel with at least 4-5 car lengths on the highway and I never have any issues with the car freaking out. I also never touch my phone when I drive and that could also play a factor as well. I also always have at least one hand resting on the wheel. I have never gotten a single strike in the 1 year and 3 months of using beta and I use it everyday. I use it as an assistance more than a FSD, I treat it like super advanced lane assist first and full self driving second. I am using the beta and pay a monthly subscription, do I think its perfect? No, absolutly not. Do I think people are overreacting about the suspension? Yes, absolutly. I feel like people are blaming Tesla rather than themselves which I could be wrong but I am almost certain that is the case. People are trying to make the tesla adapt to them rather than them adapting to the Tesla. Though I understand not everyone has the same experience as me, just thought I put mine out there.

1 car length per 10 mph and 1.5-2 per 10mph over 60mph, stopping distance times 2, typical car on dry pavement stops in 130ft from 60mph, so at 60-80mph you should be following at 150-200ft.

This is great info. I have a 2018 MS with no interior camera, Updated HW3 and EAP. I have been avoiding this update because I was worried it would nag more (which is already enough to annoy me) and that little nugget you mentioned about cars without cameras getting only 3 strikes before you're locked out absolutely convinced me I made the right decision. Good thing too because I almost applied the update the other day just to see what the changes were. No way now.

New speed restrictions in the rain now make the system unusable on the highway even if there is only a drizzle. Max speed was just limited to 60MPH on a 70MPH highway, and my car became a traffic hazard for not running with traffic...

Sometimes when I get one like that, I think back and realize I was thinking about something that involved me conjuring a visual scene (like replaying a football play from the night before). I wonder if, even though I am looking straight ahead at the road, the inside camera can discern that my brain is a million miles away. Just a suspicion.

The difference is Tesla has marketing that encourages misuse of their system. Every other auto manufacturer doesn't market their ADAS system the way Tesla does.

I always turn on cruise and set a speed before turning on FSD (we live off a country hwy where the set speed limit is 55, but near us, anything over 45 is pretty sketch) , so I am never looking away when I engage it--it takes anywhere from 10-30ss for it to tell me to pay attention. I AM. I think it's just timed.

There must be something wrong with my 2022 Model 3 11.4.9, I rarely get an alert to pay attention unless it's at night or in the rain. I have found if I rest my hand on the bottom of the steering wheel I can drive for at least 20 miles of straight road before get an alert.

Your hand is applying a small force to the wheel that is detected and system uses that as a contributing factor in its internal calculations as proof you are paying attention. It also takes speed, traffic density, weather and road type as inputs into this calculation. Try doing the same thing without touching the wheel, at higher speeds, on curvy roads, in the rain and/or in dense traffic. The nag rules are not fixed, they adapt.

I've had FSD for a little over a year. I received my first strike right after this update was done, while I was staring at the road with my hand hanging on the wheel as I've always done. The nag didn't accept my hand hanging on the wheel, and wanted me to basically start steering to be satisfied. Between that and very few FSD fixes over the past year, you can count me with the frustrated users.

@@Quickcat21MK No, it started happening for me too after the last update. It now requires way more force on the wheel and I often disengage FSD by accident too. The scroll wheel flick no longer works either. NHTSA is great at making FSD less safe and more annoying.

I like Chris have not had any issues with the update. In fact I've only ever had 1 strict since 2019 when I got my first Tesla. I do get yelled at from time to time if I'm futzing with Spotify, but it's rare and totally understandable.

As speed limit detection is not existing on highways in Switzerland, the speed ALWAYS needs to be adjusted. So I always have to check the speed and I am always getting yelled at. In Germany, the speed limit sign looks identical and there computer vision based speed limit recognition is enabled.

Using Autopilot only, but less and less since the update. I was willing to learn about how AP works initially, but now, I don’t like how it works, so I’m using it less frequently. I’ll give it a chance over the next few months but I’m on an behavior extinction curve at this point. Can’t see why I would pay for a subscription or buy FSD outright now. Maybe if basic AP could do autolane change with out deactivating AP?

There is a camera in the Rivian, but they did disable it in a recent software update. They could re-enable the camera in the future.

I have advanced autopilot and I have noticed very little difference in how it works on my daily 2 hour round trip highway commute. A couple more nags at the start of my journey then it mostly leaves me alone as long as I have my eyes on the road. If I look away it nags me. Seems pretty reasonable to me. If I keep my eyes on the road then no problems and few to no nags. I do agree that the sensitivity in first 30 seconds is a bit over the top as I also check my speed as soon as I turn advanced autopilot on.

Another situation where the Autopilot nag is now being displayed is if the car enters an area where there are traffic cones bordering road construction or a change in road layout. The steering wheel nag is activated automatically in these situations and will often repeatedly appear at short intervals until the car reaches the end of the construction zone and the road layout returns to normal. Some (many) people have undoubtedly been abusing the system by switching off when they activate Autopilot - familiarity breeds complacency. So it is fair for NHTSA to demand that Tesla improve the monitoring and warning system to better ensure that people continue to pay attention to the road when using their ADAS systems.

Same here. No significant difference here for actual use of FSD after this recall change for me. I put close to 23,000 FSD miles on my MYLR last year and am on track to do so again this year. So far I have had a similar experience to you. Not really any inconvenience on my end.

Last saturday I was driving normaly, with autosteer enabled (In europe there's no FSD) and I got suspended for no reason. I was literally looking forward and my hands where in the starting wheel. The car warnings didn't got my attention (Joe mode was enabled) and I got suspended. I'm paying the bills for those using gadgets on the steeringwheel to not have to do it theirself. And because of them, now the car asks me to almost change lines to let it know I'm driving. It's not having the hands on the steeringwheel anymore, it's literally move the steeringwheel in a way I will never do in case I'm driving myself. (like trying to get out of the road to let the system know I'm having the hands on the wheel) Nonsense.

Way before my interior camera was activated in my car, I had an Amazon purchased camera cover over it. In the past year it has fallen off and is lost. With the new updates, I’ve been thinking about purchasing it again. Does anyone know if having a camera cover while you’re driving essentially cripples these new attentiveness updates because it can’t see you?

If you only use Autopilot, you can still cover the camera as of now, but that could be updated. If you use FSD, the system won't work with the camera covered.

When Highway driving on I-10 going east it nagged me constantly wasn’t using my phone but did have my sunglasses on because the sun was bright early morning and I was going east. It also shut off auto steer because the sun was too bright for the camera. The nagging got so bad I started using the right scroll wheel to up or down the speed by 1 mph which works to tell the Tesla your paying artention

Chris, thank you for bringing this issue to the fore via your channel. It is very important for many reasons. The first one is that a government agency deems itself technically competent on making regulations about something it knows nothing about and does not even deem it necessary to first put out RFCs to competent technologists as to how to go about defining a thorough and justifiable driver monitoring system for each particular product, i.e. the AI in the driver assistant. The second, which probably comes to mind to just about anyone that is using FSD (and others have pointed out already in these comments) is that the morons at the NHSTA, are such forward thinkers that they will make people MORE UNSAFE because their regulatory girations are not followed, and to make matters worse, they don't provide the details on exactly how they are monitoring nor how effective that monitoring is in preventing accidents, of course because they are pulling out their criteria out of the thin and rarefied air that makes up 99% of their brain. I'm glad that you have not been given a strike by this absurd system, but absurd it is because while I was stopped at a red light it came on to tell me that I needed follow the instructions of keeping my hands on the wheel and look forward. So it kept telling me this for 5 to 10 seconds, all the while as the car was stopped waiting for the light to turn green and I kept looking forward, putting a turning force on the wheel, enough that it usually acknowledges your input and stops the nag, but not this time, it ignores that I'm doing what I'm told to do and decides that it is time for a strike! Absurd is a mild word for this nonsense. Where is the monitoring system system quality control? Why is it ignoring user input. Because FSD is so safe now, the criteria for strikes should consider data from the FSD system from which a probability of an accident happening can be derived, if in the next second or two the driver is not holding the wheel or looking forward. Tesla is copping out to the whims of NHSTA and being totally unreasonable with the customers that buy FSD.

I've seen people block of the interior cam which completely disables the warning. They never get any warnings other then to hold the steering wheel. Can you test this? Seems insane. Also using sunglasses seem to disable watch the road warning?

You can cover the camera (for now) with autopilot. If you cover it in fsd, it won't work. Sunglasses change from eye tracking to head tracking so it's not as sensitive

My testing of FSD Beta was if you glanced away in the first 5 seconds it would give you the warning to pay attention to the road. Like you I would glance at the speed setting, which considering it has a tough time with correct speed limit in my area I have to do this. I found if I waited 5 seconds I wouldn’t get nag to pay attention to road. Oddly now I don’t even get that nag anymore. Now as for the steering nag, the only time I notice that is when I switch hands on the steering wheel and I have both hands on the steering wheel for a few seconds. You definitely can’t do the old 10 - 2 hands on steering wheel and not get nagged. Although I never did that personally I was more the 9 - 3 position giving more turning of the wheel.

We have a 2020 x. The nag warnings are only a line of text at the bottom of the gauge screen and a thin grey bar flash at the top. Not like the blue background flash of the model 3 or y. If I am watching the road as I am supposed to, these warnings are not in my peripheral. The fact is that I have to watch the screens and not the road as I am supposed to to not get knock outs, strikes, and ultimately a week ban which I am in right now. Not to mention that the visual warning is supposed to be followed by an audible which I would hear, except every time I got a strike, THE FIRST AUDIBLE WAS THE KNOCK OUT RED WHEEL AND NOTHING BEFORE THAT. Sometimes I would get a prior audible, but not consistently. The system is inconsistent and a fail. Plus I am not paying for a monthly if I loose a week or two of what I paid for because of this. I am seeking other options to avoid and prevent the nags. AGAIN I ALWAYS WATCH THE ROAD, NEVER TOUCH MY PHONE AND WANT TO USE FSD. I have called tesla and reported this to cs and to my local sc. Not sure if anything is going to happen as a result of this. NOT TO MENTION I HAVE RESPONDED TO A VISUAL WARNING AND RESPONDED, THEN 2 SECONDS LATER GOT AN AUDIBLE THEN. WHAT?? Plus if I touch the scroll wheel continuously and regularly this does nothing. It still nags at its own schedule. They told me the scroll regularly does nothing where the wheel pull does. ??? WHY. Why is the scroll wheel not a viable option for random touches and only for when it asks you. THINK ABOUT IT, THE GAUGE SCREEN IS FULL OF MOVING CARS AND ROADS ETC AS THE VISUALIZATION, SO THESE MESSAGES/FLASH DO NOT STAND OUT AT ALL! THE WOLE SCREEN NEEDS TO FLASH ON AND OFF AND REVERSE.

For me it’s working fine seems to not nag for a while before it asks me to touch the wheel but it does ask you to pay attention faster when your looking at your phone

Worth noting that the system is ONLY watching for you looking at the screen in the first 10-20 seconds. You can stare out the roof for 10 seconds and be fine.

Seems to me that that immediate Alert on starting FSD/Autosteer is just a Recall related replacement for the old warning that came up in lower left of screen in small text font. I haven’t completely tested my theory, but I belief the initial warning is not scoring you as being at fault. Just my two cents.

FSD is CONSTRANTLY disengaging due to "System Error" in the latest update and it's driving me crazy. Freeway, Surface Streets, Daylight, Nighttime. This happens with basically every drive. While it doesn't count as a strike it's made FSD USELESS!!!

So basically what the NHTSA would prefer I guess would be for people to just turn off the safety features it they need to send a text or do something that might distract them. 😂 I will see the text feature. If you have your phone synced up to your car is great. It’s just a shame that it won’t show pictures as well because that’s when I find myself reaching into my pocket to grab my phone when I’m driving. I also prefer to use FSD if I am trying to adjust my navigation or change the radio station or something it’s a heck of a lot safer than doing it without for myself and everyone around me to keep the road safe NHTSA.

I have an FSD Tesla and an autopilot Tesla. The autopilot Tesla seems to be much more aggressive with the warnings compared to the FSD Tesla, especially when first engaged.

13:20 Same as all cars have belts now, they will all have real driver monitoring soon. Some people will want to resist, but the safety numbers will be overwhelming, and the gov will mandate it. In the end, it's going to end up being like operating an elevator, left to the machines. But in the intermediate period, driver monitoring and assistance is even clearer cut than seatbelts. Seatbelts arguably help save others because in a minor accident, you can be jarred from your seat and lose control of an otherwise controlable situation. With driver monitoring, the argument will be that if you aren't paying attention, you can kill people and its not wrong. My final thought is this. Once no one wants to drive the naging cars and sucumbs to letting the cars do the driving. How long after do seatbelts and monitoring stay around.

I haven't done too many drives with the changes, but as someone who has always paid attention to the road (only have autopilot, not FSD)--I notice no difference. If anything, the nags are less frequent after the changes.

With basic AP it’s driving me crazy bc I drive with one hand 90% of time. It doesn’t recognize this so I’m constantly clear errors now. I have been using AP less and less.

Your perspective is from that of an FSDb driver, and you drive on city streets. My perspective is as a long commute freeway driver. I commute on the I-15 in Utah. This is an 80mph speed limit divided freeway with long straight stretches. My commute to Salt Lake City is 230 miles. The attention intensity required on city streets and on a long straight freeway drive are completely different. I was an early FSDb tester, but abandoned it in favor of AP/NOA because of the strict attention requirements of FSDb. Tesla's new attention requirements for AP/NOA basically match that of FSDb. So it is no surprise that you find it no big deal that what you have been driving with should be applied to other drivers. But from my perspective, a 5 hour commute is radically different with the new attention rules. My view is that Tesla needs to recognize the distinct difference in attention requirements for these different driving scenarios.

That is an intense commute. You must be able to charge at work? I do commute daily on the highway, but my commute is only 45-60min. I can spend the entire time on the highway with only a couple nags still. One way to reduce the severity if it's annoying is wear sunglasses or a hat

. @DirtyTesla Thankfully, I only commute, on average, about twice a month. It is a five hour drive, with two supercharger sessions. Speed set at 85mph the entire drive. When there is light traffic, and a straight divided highway for as far as the eye can see, it is difficult to understand how Tesla can require the same attention as that required on a city street with turns, traffic, intersections, etc. It is a not so smart application of a very smart system.

I do know they ruined Summon and Smart Summon. I have 2020 Model S and it has with the cameras Ultra sonic sensors. it will no longer find me when I'm in visual range less than 200feet and the car doesn't know which way to go coming out its parking spot in an empty school parking lot. It used to be able to come to me from one parking spot around a school building. get to the stop sign and make a right turn and meet me curbside. now it's worse than a child learning to drive.

This post is regarding FSD - Dude this is so weird, I'm on the latest version and I BARELY get a nag. I can also touch the screen, change radio, etc without it beeping at me. I haven't seen any difference whatsoever for any of the most recent versions for my MSP 2021. I've seen all these videos of the initial nag, constant nags throughout the drive, I just don't get them. The only difference I see is my scrolling wheels no longer work for acknowledgement and I have to turn my wheel so hard sometimes that it kicks me out of autopilot. But other then that I just don't have the same aggravation everyone is posting videos of with FSD. I hate to state the obvious but if Elon never bought Twitter I doubt any of this would be happening. How about they go after every single automaker with ADAS systems. Hell how about cruise control, maybe they should ban that next. In my S580 I can enable ADAS and talk on my phone, txt, do whatever and as long as I touch the wheel every few seconds no problem.. Really seems like there only picking on Elon

You started out with 11 incidents, I’ve not seen any of these incidents happening with other systems. Tesla claims Autopilot or FSD, and it isn’t close to that language, and if I remember correctly, the other hands-off systems are limited on where and when they can be used.

Damn, no joke: I scratched my balls and got my first strike. I had to laugh, but I was angry too. It´s not that funny. Another thing i figured out is after one week I still have 4 attempts left. So it does not reset the counter.

I exclude myself from your "Everyone is" comment. I do not have FSD, don't want it, wouldn't use it. Case Closed. However, comma, I use Autopilot (TACC) both locally and on the road. It works just fine. I don't understand the reason for all the hand wringing. Drive with your hand on the wheel, keep your eyes on the road, and Bob's your uncle. Get sloppy and inattentive and you get yelled at. It works the same as it always has, excellent speed control, apexes turns too close to the outside for my taste, and it groused at me when I glanced at a text message. Really am no sympathetic with the NHTSA, they are too intrusive, just like the rest of the gubmint agencies. However, comma, in this instance it seems the new rules are there to protect us from stupid people.

I have a theory that the initial warning is NOT because you looked at your screen. I think that initial warning is automatic. I say that because it happens to me every time I engage autopilot (within 5 seconds or so of doing so), even if I’m looking straight forward. Have you tried that? I do agree that other than that first warning, it’s not all that different and I haven’t got a strike yet (on our standard AP Model Y and FSD Model X). Makes me wonder how closely those complaining about were actually paying attention while driving. 😉

In my tesla model x, I have to look at the screen constantly and not the road because of the nags. I DO NOT GET CONSISTENT AUDIBLE WARNINGS OR AT ALL SOMETIMES UNTIL IT KNOCKS ME OUT. STUPID!!!

Its funny its so strict, yet you can easily buy a phone mount, stick it right behind the steering wheel, and watch a movie. Even without sunglasses. The camera cant see past the steering wheel, and the camera cant tell if you're looking at the road or the top of your steering wheel.
