Was definitely interesting. Regarding the Let's Play thing, as far as I know (I didn't start yet) Let's Plays technically count as copyright infringement since footage from the game is used. I'm not too deep into the topic but from what I read is that (at least in Germany) you need to ask the publisher (or creator for indie games) to record the game and (what most want) monetize the video. Technically you even need to ask for both separately because some companies are okay with recording and uploading the content but not making money out of it - 2k Games, Bethesda or Blizzard had a policy like this, even though it could vary and might have changed over time (just ask and see how they decide for you).

From 5 minutes of Googling (I am not a laywer, etc.), I think there actually are serious penalties for bogus copyright takedowns: you have to swear under penalty of perjury that it's your work, and perjury is a serious crime. **Edit**: Strike that, it's only perjury in really specific cases; most of the time it's only a monetary penalty (damages and legal fees) which probably wouldn't mean much to a big company. **Edit 2**: and even that penalty apparently applies basically never. So it probably does need a more serious penalty -- but even then to actually _get_ the penalty you'd probably still need to go to court, which isn't much consolation for most of us.

+Angry Camper I sometimes do things I know are wrong, but it's always for me to have fun, it's not-for-profit, and it's small so I don't spend a huge amount of time on it. That way if it does get deleted it's no great loss. Maybe think of a way to change your idea so it's more "fair," or so that it's all your own original creation.

Well, after watching this video. If I was ever called to court for one of my fan made trailers infringing on copyright, while I don't really know what I'd do. I do know now that saying they are parodies would be a reliable defense, right? Also, with the way I structure and treat my channel, I don't mind Hasbro using my videos for money. They already use two of them for that anyways.

this is a super fun topic for DJs considering they upload content that is mostly, if not entirely comprised of other people's work. It's like selling drugs in a police station. I had a video with 34 songs in it for about a year until it randomly got taken down last week because the copyright on one of those songs was suddenly changed. My video went from freely available to the public to blocked in all countries at the snap of a finger. Kids, if you want to play with music, don't. Find independent musicians who aren't owned by anyone or anything available to work directly with you OR use KZbin's hand-picked list of copyright free music.

Even on my videos, sometimes people claim their song is a Creative Commons license, but it turns out they stole the song or they've enrolled in content ID. Live performances you can get away with most of the time, but once you're trying to upload your mixes to something like KZbin you're screwed.

This channel is pretty great and super informative. Definitely subbing and sticking around. The one statement I'll debate about is fair use when it comes to Let's Plays. Reaction videos I'll give, because the video you're reacting to is not transformative media, but unless your game is 100% story like, for example, Firewatch, I don't think a Let's Play would break Fair Use simply because a major part of the game is actually playing it. The media is transformative, nobody is going to play a game exactly like you, and watching someone else play a game you like is a much different experience compared to playing it yourself. Games and Let's Plays (usually)don't compete with each other. This is coming from a Let's Player, albeit a small one, so there's oviously some bias, but I do make a point not to play games that rely on story over gameplay, as the ability to make it your own experience is drastically diminished. I do know you blatantly said "I don't know" and gave your personal opinion, and I'm not trying to change your mind, but I'm mainly posting this to give the other side of the debate specifically for this scenario in case anyone reads the comments and is curious. Like you said, until it's brought into court and explicitly stated yes or no, we'll never know.

I wonder if tutorials on how to do some fancy in-game trick, or video walkthroughs on a specific part to show you what to do (perhaps because the game's official instructions were unclear) might be able to classify as "educational" as well- you're arguably teaching people how to play the game. Then again, why do _you (instead of the company that owns the rights)_ get to choose what kind of game is considered story-heavy? Maybe a player shows some crazy fluke that happened to them in Splatoon 2's online multiplayer- _maybe they uploaded a video of the Octo-Expansion's cutscenes so players don't have to pay for the DLC to watch them._ *KZbin's Content ID program can't tell the difference,* and will probably claim all ad revenue for Nintendo on both of them. Maybe the player decides Splatoon 2 doesn't have as many cutscenes as something like Final Fantasy, so he thinks he deserves the ad revenue on the second case as well. Given my first paragraph, puzzle games like Portal or adventure games like The Secret of Monkey Island might not have much in the way of story, but a lot of the gameplay relies on figuring out what to do next, and a video will spoil that for you. Fan-made walkthroughs posted online ruin the company's ability to sell official strategy guides, which actually have mostly died out a couple of decades ago _for this exact reason;_ most players will ask, "why buy a book when I can look it up online for free?" In the olden days of the internet, game companies couldn't do a dang thing about text-based walkthroughs because they technically don't contain copyrighted material, _but the video walkthroughs they use these days... THOSE can get shut down easily._ [Note "Profiteering" (if your walkthrough has ads), "Substitutes" (it's a substitute for the "merchandise" of the official strategy guide) and "Automated Deletion" at 7:26] I bet a lot of game companies would much rather put one policy on all of their games than try to figure out which ones can easily be "spoiled" and which ones can't, too. Gameplay footage of an action-platformer like Megaman, as you said, is arguably transformative because it's different for every player. _Gameplay of a Visual Novel like Phoenix Wright however, is just showing you the dialogue and the answers to all the puzzles._ Both games belong to Capcom, and their legal department may not want to mess with having different procedures for each. *Tl;dr: Making a one-size-fits-all law is complicated, man. ¯\_(ツ)_/¯*

This is a good video, (as my being a furry fan) this goes back to 2004. I met MaxBlackRabbit at Anthrocon who had a character I liked. I pulled Max aside and asked him politely if I could use his character ZigZag in a story that wasn't porn involved, and wanted his permission face to face. He was pleasantly surprised and said sure. I met Max a year or 2 later and he remembered me and asked how my stories was going. I said things were fine, but He also said he remembered me because I was polite and up-front with him. ^^ (And my being Canadian as well as he was helped too I bet... ) ^^ The point I'm making here, is always be polite when asking. Sure the stories were finished, but I never had them published. I might make a web comic or small animation later. And when that happens, i'm sure his (MBR's) permission still stands. You don't need to be big to enroll for content ID, you just have to have 100% original content. I know some companies like Valve have policies where you can legally use their stuff no problem, but KZbin's staff won't care. Plus you can still remove a video that was stolen without content ID. I've done it once with this parody of mega evolution in pokemon (the obvious digimon joke) using footage from an offical trailer. Then again, it might just be that the guy took it down himself when I yelled at him... but really KZbin doesn't actually review copyright claims so it probably doesn't even matter who you are as long as you uploaded the video to your channel first.

Other types of fanart protected by fair use: Porn >:V Porn parodies are a really REALLY common thing that's protected under fair use. Thing with fanart on fair use, though, usually it doesn't matter because it's not being sold. When it IS, however, there's a major argument to be made that you missed: Fair use pertains to copyright, and copyright in US (and currently international afaik) copyright law applies to actual media, not concepts. Art, writing, scripts, dialog, etc. It's a gray area, but essentially you just can't copyright a character. Ergo, on a stylized piece of work, fair use actually isn't even an issue because the only thing 'infringed' upon is a concept--the character itself. That said, characters can still be protected through means other than copyright (eg trademarks) and that becomes a different can of worms. Unless you live in Canada. Or Japan. edit: You actually did mention characters, saying the copyright applies to them. :V That's actually incorrect, though (unless you're in one of the aforementioned countries). Common misunderstanding. As I said, it has to be some piece of media. It IS possible to copyright a character but that's a hugely complicated process that not even a lot of major companies have been able to go through. It'd be kinda f'd up if you could copyright a concept. It's open to abuse, and does often get abused in countries where copyright can apply to concepts and characters.

Otherwise, if someone were to take Starsign characters and make a spinoff for money, there would be nothing to stop them from doing so. In order to have trademark protection, those characters would have to be used in branding to identify products or services. And you're right, you can't copyright an idea. That bit I mentioned in the other video.

The copyright at the end of the day still applies to the media, not solely the concept. And that tbh is a bit more broad reaching than it sounds, but it's the most accurate way to describe it still. Characters aren't quite protected by copyrights--they're rather protected by extension of copyright-protected works. If say you have a character, call him Superman, make a world around him in the form of comics and writing, that's what'll protect you from someone reproducing your work. The trademark is a protection that comes in to prevent someone else from naming their 'similar' character Superman as well. I use Superman cause there was actually a debate and case on that years back--it was essentially how a copyright can wind up applying to a character. The key dependent factor was while the original works that conceptualized Superman fell into public domain, the parent company was still producing new works that contained him in them. This video basically sums up my problem with fan fiction witch I am writing one and it is that it will only ever be fan fiction you can have the best story on the planet but if you want it to take place in the same world as a series you like it will only only ever be a fanfic and can never be truly yours.

All in all this is a really well done video explaining fair use, but I believe you might want to be more specific with regard to your statement "...or something Disney could make with its characters." Your execution of the idea might not be what they could come up with, but the idea its self could me recreated by Disney and then merchandised. Also for anyone who wishes to look at case law, weather for fair use or anything in general, you will be looking for case laws that set precedent, these are the laws that Crowne was referring to when saying that the court will look for cases that are similar to yours. Quick question for Crowne is Scribble Wolf a puppet? If not how many different pre-rendered positions are there? I've counted at least 5 to 7.

+Murphy andhisLaw Scribbles is part puppet, part frame-by-frame. I don't use the puppet function much. Like I could tween the side pose's foreleg, but so far I haven't.

Thank you so much for the video and to help to giving me a better understanding of fair use! You explained pretty clear and I'm sure now I got an idea of fair use and it's laws! I just have one more question, if you are making an animation meme, (I don't mean like if Its an original meme, example; I want to make the floppy ears meme but I didn't actually create the meme. ) will you still have to check the song used in the meme for information about its fair use?

Curious how things like "donation and support" fall into this. Like say an artist uses Patreon to support their fanart creations. The argument I've heard is that they are being supported for the labor, not the content directly, because most (at least the ones I follow) upload the content for free anyways (like say a comic) regardless of how much support/donations they may or may not receive. But as you mentioned, getting compensation out of it doesn't matter legally when trying to defend. Great video though. It's just funny, because it sounds like 80% of fandoms are violating "something" ie: nearly every single convention I've ever been to. It's amusing because in the case of at least Hasbro, they go around supporting MLP conventions (letting staff attend), and totally know that fan content is being sold. But as you said, they probably like it as it garners support for the official release.

+Wheelz567 This is also something with no legal case law to look back on. Crowdfunding is pretty new. And Patreon is what - two years old? Patreon is often used to solve the problem of making money directly off of fan art (or even things that are much more blatant forms of copyright infringement). If someone is doing this I suggest also mixing in their own original creations, and cover multiple fandoms instead of one. Anything you can do to avoid being pinned as, "this person is making money off of this one specific franchise." The less one specific copyright holder is able to attribute profits you've made to their copyright, the better. Yeah, everybody's violating copyright all the time. You just have to know what's likely to get you in trouble.

***** Yea very true. I for instance follow two fan made MLP based fan comics that *used to* use Patreon. Their stories had a mixture of original ideas combined with established content (like the settings and about 30% of the cast being from the show itself). Granted, both of these artists have actually stepped back from Patreon due to stress of needing to crank out rewards every month >_> But that's for another day xD. Thanks for the reply :)

The most ridiculous thing a company could do is, to give an option to upload recorded videos to KZbin, and claim those videos. As Nintendo did this exact thing in Wii U games.

QUESTION: At 4:28 the line "or something that the creator could do with its creation"; well, the creator can do ANYTHING with its creation, so, how can ANYTHING fall into fair use using that argument? What I mean is, if I have enough money, and want to remove someone's commentary or critique of of my work from someone else that used even if a tiny portion of my work, all I would have to do is say that I would have done it myself in order to draw attention to it (via drama) and voilá, nobody will be able to critique my work because I can do whatever with my work and someone else did some whatever thing that I could have done just didn't do yet.

+TemporalOnline When I say that, it's about them taking their creation and using it to make merchandise or spin off series' or whatever. The legalese is that the creator has the right to exploit their creation to make money, and you don't have that right. The copyright owner couldn't respond with, "Oh, I could have critiqued my own work," because that's pretty silly. Actually, blocking people from critiquing your work is censoring and gets into free speech problems (in the US). And while the law won't do anything about it unless someone with enough willpower and money sues you, you'll sure as heck get internet people breathing down your neck about "this person takes down anything bad that is said about them."

I understand what you said and I also think it is silly, I agree with you 100%, but if this is the legal argument someone has to pass through, in a place were corporations are people, and money is speech, in my mind any stretch, no matter how far-fetched, can, will, and has possibility of being won in court.

I DIED When she said make your own stuff!!! 😄 Because I have these characters that are completely original and I made them and I've created them or had them in mind for about 4 years now and they're gonna become a cartoon series!! >:3 And plus I've made changes to them as the time went on, so that's great!! 😄 (OMG I just realised it's been five years now because it's 2017 oops 😁) Also I'm getting my own animating "thing" that comes with a stylus for my birthday (March 20!) so I can do my dream cartoon I've been wanting to do for so long (*_*) (I said thing because I don't know what that may be) And also I've made stories about my characters 😀 but I need animation tutorials because I didn't start animating yet.... 😳 But I just need that practice and I have serious passion to make my characters that I worked on for all this time now into an animated cartoon!! >:3 Even if it takes like, some years to practice. Also I need to practice drawing my characters and adding more characters I wanna fit into the series because there are some characters that are the main focuses but I need more >:3 (Gonna have to create) And also I have these books I've written to back me up. :3 BTW I'm 14 😐

Speaking of smaller copyright users Toby Fox can once again be used as an example due to a recent album of cover songs from the game that was directly approved by Toby himself to be sold for actual money

+Pip Yep! I'm thinking Toby contacted RichaadEB and Insaneintherainmusic and allowed them to sell albums if they gave a percentage in royalties for each sale to him. That's how a smart businessperson behaves. Now everyone involved makes money instead of none of them, and the music covers are super awesome and allowed to exist.

There actually was a case on fair use regarding reaction videos, the channel H3H3 was sued if their reaction video was fair use and the judge ruled in their favor, so now there is case law regarding that. I'm not sure about Let's Plays though.

Doubtful. They also look a little like Starfy, and Kirby's Warp Star. Some concepts (such as the shape of a star) are too generic to copyright or trademark.
