On the note of copyright, what the initial intention was that: artist makes work, it’s protected but only for so long so the artist still has reason to make art. If it doesn’t end it creates a monopoly on characters and art rather than enabling them to be reimagined and doing new things with them.

Originally the point was that if it wasn't protected then the artist couldn't make any profit because someone else could just duplicate their work and steal all the profits but then Disney decided they wanted a monopoly forever so they bribed the government into giving them one

Which is the exact same reason why they changed the law for Disney so that they can monopolize but since Disney started getting into politics Florida decided to say okay if that's how you wanted to be here in 5 years when Mickey mouse is going to be back up for renewal you can't copyright renewal anymore you're no longer your own entity so they stopped exempting Disney because they wanted to hop on the bandwagon of lying about a certain bill so hoping that it won't pass which is ironic since that bill was to stop groomers which come to find out Disney has a lot of pedophiles because every few years when they run a pedophile sting in Florida they always get Disney employees there's always at least two Disney employees every single time so it's kind of ironic that Disney decided to speak out against a bill that would stop rumors but hey

I love Osie so much. She brings so much character to the conversations, is terrible at the game until suddenly she’s a god tier gamer out of nowhere, and she’s got the best sense of humour. I love everybody in this session, but I don’t see enough Bouphe or Osie appreciation.

Cheese is like the glue that holds together any mish-mash of dishes that you wouldn't normally make together. Like breakfast and tacos? Take your breakfast, throw it in a tortilla, add the cheese, and it works. Or a just taco, ground beef and a salad, throw the cheese on and it sticks.

Cheese is a dish that should only be served cold. As soon as cheese gets heated and melts, I hate it. The texture gets so slimy, those stretchy strings look disgusting. Cheese on toast, love it, eat it almost every morning, just don't put it on pizza, burgers, burrito's etc.

Ped is slightly wrong about copyright, I believe Japan is a signatory of the Berne Convention, which means copyright protection for Japanese works expire after a set amount of time following the death of creator, I think 50 years (might be 70). Sonic has 2 creators and they're both still alive and in their 50s, so I wouldn't expect to see Sonic in the public domain in our lifetimes.

@@hamilton2861 Ahhh, fan art is such an interesting and tricky subject when you're talking about copyright. Technically all fan art is derivative work and therefore fan art made without permission of the copyright holder is a breach of that copyright. However, I really doubt you'd ever find a company that would chase up any legal action unless you're selling that fan art in a way that would negatively effect the market for the original work. I mean, look at all the sonic fan art on the internet, and how much of that is taken down by SEGA? Even fan art that's being sold for a profit by artists is rarely ever acted upon, even by the most litigious media companies because most of the time there's way too many to actually effectively police.

@@supercool559 Nintendo would 100% bark up that tree, as technically if they don't chase down people who breach copyright or trademark, they can lose the license to their own work. Thats why so many fan games get taken down, because that breach of intellectual property or the unwillingness to fight for your own work can actually result in the work no longer being yours to own and released into public domain.

@@RamesGamesLC You've confused copyright with trademark. A "trademark" is supposed to be a unique symbol of your business, and if you're lax about other people using it, then what's the point. Copyright cannot be lost in the same way. If a copyright holder chooses not to bar access to their work, then _effectively_ what they've done is just implicitly grant license. But they can change their mind at any time, without restriction, even long after. This is why license to use a work really really should be in writing. This gets extra confusing because prominent characters like Mickey Mouse may simultaneously be trademarked and copyrighted...

@@supercool559 Yeah, certain things like fan art just usually aren't bothersome or troubling enough for companies to care about - plus there's also just way too much of it for them to focus on and take down. If they did, they literally wouldn't have any time for anything else. It IS a breach of copyright, however, it only ever becomes an issue - or more succinctly, it only ever results in what copyright intends to protect against when the fan artist (or whatever it may be) starts SELLING and trying to make a profit of their fan art (or whatever it may be) OR OR OR when they start making something that has the potential or actively is negatively affecting the original copyright holder's brand or their work. What sucks is when companies take something down that neither is for profit or would negatively impact them in any way. Like fan made mods or games. One could argue though that those developers of the fan art, fan mod, fan game, whatever are able to gain fame or status from using someone else's IP - and that is probably the justification for taking things like that down. Which... you can't exactly argue against that point because it is true.

I know this is mostly satire but please explain how R2D2 bares any responsibility for Anakin's fall and his actions thereafter? R2 never once aided Anakin in anything like that. He is most certainly not responsible for the deaths of billions.

6:30 I can think of a few. To grossly simplify: Media preservation - if a company owns the rights to a piece of media forever they can simply choose to never sell it again and copyright strike any reuploads, creating lost media. Prevention of Monopolies - companies like Disney tend to buy up every company in sight. If one man owns every company and those companies own all ips forever it can be difficult for independents to find success. Imagine how fast Star Wars fans would ditch Disney if people like Warner Bros and Viacom could also make sequel trilogies. You'd have to make an objectively good piece of media to grab attention instead of just banking on brand recognition. Encouragement of reimagination - Dracula was originally a horror novel, but now the guy has popped up in comedies and pornos. There are lots of new twists that you could put characters through that people often don't try for fear of copyright. Experimentation is fun... Though it also leads to dogshit like that Will Farrell Sherlock movie. Opportunities for fan fixing - How many times has a Nintendo fan made a non-profit game that uses a Nintendo IP but is way more fun? While fans can be indecisive, they often share common ground on what elements of a franchise they enjoy and what should be changed. People have managed to do shit like put Cappy from Mario Odyssey into Mario 64, things that the rights holders would never in a million years bother to do despite consumer demand. Continuation of a brand - The LEGO Group hasn't made a single product for the BIONICLE franchise since 2016. And non for the BIONICLE people actually care about since 2010. Despite this, there's a thriving fan community that 3D print and paint custom masks and armor for each other to keep MoCed figures alive. If the original company doesn't want to keep providing content for their fans, the fans will pick up the slack. It's more fun to do that without threat of legal action in your shoulders. Mickey Mouse, I can kinda get holding onto that. But stuff like Cinderella? Sleeping Beauty? Disney didn't create those stories and they've barely used their versions of those characters for modern profit. If you ain't using them quit hogging them!

About copyright, while I agree it should be longer than a patent, a patent and a copyright are somewhat similar in their existence, creations of a company or an individual for exclusivity and monetary gain. The difference is that copyright can last for over 100 years while a patent lasts for 20. Really shows that copyrights are much too long-lasting. 40-50 years are much more reasonable. Also, it should be noted that only the original versions of, for example, Mickey Mouse, would stop being protected by copyright. Modern renditions of the character would still be copyrighted and it would encourage companies like Disney to actually evolve their characters and not just surf of the creation of a dead guy 100 years ago.

To add to that, Winnie the Pooh is also a Disney property and It's a not-so-well-kept-secret that Good ole Walt was pretty keen on stealing character designs and then suing their creators to claim the copyright. A perfect example of this is Bimbo/Fritz the Dog (1926) vs Mickey Mouse (1928).

generally the copyright stays with the original creator until their death, or until they sell or pass it on to someone else, but the copyright holder can make their own stipulations in regards to the use of their creation, which means some things can be used as long as the copyright holder is credited, while others require a written authorization. As long as the copyright keeps changing hands the new holder have control over how it's used, but there is a point where if no new product - no matter what it is - is produced that falls under the copyright, that copyright seizes to exist. That is why some companies occasionally change their logo and why companies like Hasbro and Mattel keeps relaunching all their toys every 20 years. When you say copyrights last too long it means you believe people should be allowed to rip off other's work instead of coming up with their own ideas, which is exactly the reason copyright exists - to protect the original creators/authors and prevent plagiarism. The system was never intended for companies to own copyright, but in the US people are allowed to completely waiver all their rights and thus you end up with corporate copyright which is a bitch to deal with. Meanwhile in Europe the original artist always retains the right to their product and they can only give up/loose that right in a legal process

Winnie the Pooh isn't a Disney property, they own the copyright on all the films they made but the original books were written by A.A. Milne, that's what's entering the public domain. The vast bulk of Disney's classic films were based on fairy tales and classic literature that were already in the public domain when they made them.

@@thesteelrodent1796 Copyright currently lasts until the death of the creator + 70 years. (Just 70 years for companies.) The problem isn't that people do should not benefit from creating something, the problem is that a person's descendants descendants shouldn't still benefit from something some long-dead dude did. The only people who gets their ideas ripped are dead bodies whose children probably also have half a leg in the ground. What I found the most laughably stupid is that "Den lille Havfrue", a statue in Copenhagen which has become one of the symbols of the city and was created in 1913 doesn't actually have an image on Wikipedia because the statue is still copyrighted and protected by a group of people so they can keep milking it dry of money without adding anything to the world.

@@thesteelrodent1796 nobody said artists shouldn't be compensated fairly, but current copyright law, especially in the US, is just silly. It creates situations where a few people and organizations can put in effort once and earn almost infinite money. E.g. Wham! have earned a decent living wage just from "Last Christmas" royalties since 1984 and will probably continue to do so for decades to come. Meanwhile the vast majority of artists get less than nothing as they have to carefully avoid an ever increasing minefield of prior copyrighted work. At the very least copyright should end with death of the original author.

the problem with Disney owning the copyright to media created decades and decades ago is that we have one corporation having a monopoly on nearly all media, so like a dragon it hordes all this content and characters that they aren't using, but equally no one else can use, meaning that we can't get new versions and takes on classic media. I mean so many fairy tales are off limits because Disney has bought the rights to them.

Rights which by all means they shouldn't have been able to. You shouldn't be able to buy the copy right off someone and make it your own. It should be a payment to remove the copy right. To buy it off another directly undermines the entire point of protecting the creator.

Copyright exists to protect the profit of an original creator of a work, not directly to stop knock offs. If Star wars wasn't covered by copyright, Disney could still make insane money making movies/games/books, even if indie groups create their own low budget star wars stories. 34 stuff exists of things already (that's the rule), so copyright expiry wouldn't corrupt an IP more than it already can be. IMO, I'd rather see Star wars 9 AND someone's star wars fan game. Fan games are choked by copyright, but Star wars 9 would've been made regardless

The copyright thing annoys me cause it used to be 25 years after date of creation. Which would have been great cause we'd have gotten a dozen MCU rewrites and Harry Potter spinoffs in their own canon. It's how new art gets made; it's built off remixing of the old, which is hard to do without new works entering public domain.

You're actually wrong. Winnie The Pooh is only in free domain in regards to the FIRST published book, and it's art or art based on it. So only the materials within the book are free to use.

Kind of a little more than bullshit that the US allows them to pay to change the law to favor them, they've done it twice since I've been alive at least. Pretty sure copyright was not intended to be used as a club wielded by billionaire corps, it was to protect creators from such entities abuse of their creations.

That Winnie the Pooh is just whack since it's not even transformative, it's just for brand recognition and if you just called it "Plastic Bear" or something it could even become its own thing, but now it's just a one and done deal since you can't just turn Winnie's public image completely upside down.

I think they should get rid of the fixed period for things to fall into the public domain, and rather change it to an "active use" clause. So, you know, if Disney are still actively using Mickey Mouse, the copyright holds. But if things are allowed to elapse, then the copyright expires and it's public domain. That way, Disney won't keep bribing Congress to extend it to 60 million trillion years all the time to keep Mickey forever under their wing. Nah, if they're still making Mickey Mouse cartoon and selling Mickey Mouse plushies or whatever, then that counts as "active use" - it's still an on-going product for them, still making money - and then we can reset copyright law to be more reasonable. Like, every ten years, they've got to re-apply and prove to a court that it's still under "active use", otherwise it falls into the public domain. This'll let Disney keep Mickey, but doesn't distort things for everything else. Some properties would, like, make cash for ten years and then they never bother to make any sequels or any merch or anything... and, letting it elapse, it becomes public domain much sooner. Yeah, it's a compromise, as you're kind of letting Disney keep Mickey under copyright, essentially forever. But if you don't do that, then they'll just keep extending American copyright to silly lengths - like "5000 years after Walt Disney's death" - to hold onto it, and then there's tons and tons of other stuff that'll never fall into the public domain ever either. Like, the idea of copyright terms is that you retain exclusive ownership of your creations for a while... so you can make a living out of it. Make a bit of profit for inventing Wallace and Gromit, or whatever. So my idea is to exactly focus on that. You get 10 years copyright automatic and free. But then you've got to re-apply to extend it, proving that it's still a viable product - so, here you go, here's some Mickey movies and cartoons we made and here's receipts showing we made $100 million on selling Mickey plushies. Like, this shows that it's still an active product that we're making a living from, extend our copyright another 10 years. But there'll be lots of things where someone did something - invented some character in a novel or made a cartoon - and, ah, they made $250. But now they don't care. It's not an active product, actively making anyone a living. We've not made any sequels or anything for over 30 years now. We don't care. So the copyright on that lapses and it becomes public domain. Indeed, implicit in that is that you've got to give enough of a shit to 1. pay attention to what's going to elapse 2. keep making active use of it (you can't just, at the end of the 10 years, say you want to extend the copyright, without any proof that it's still an active on-going concern for you that's still making you a living) 3. That it makes you enough money to be bothered to go through with the whole process of re-applying every 10 years. Simple idea. Every 10 years, prove it's still an on-going concern for your business - and, like, you're still making money to pay employees from it, so retaining copyright is about retaining the ability to make a living from your creations. And if you can't be arsed, then it's public domain. (And if you really hate corporations, you could add a thing where you can only re-apply 10 times, so copyright will eventually elapse after a 100 years - active use or not. So that things do eventually become public domain at some point, as you can't re-apply for the rest of all time.)

A company that “created” (look up the origins for all the classic Disney movies, all copied from other works) a character I.P. (Intellectual properties) should not get to be the only entity that can create and profit from a character forever. Especially because it’s individual people/teams within the company who creates the character or IP not the owner or shareholders that get to profit off the IP. Especially when companies are constantly buying each other up and become more like monopolies.
