Employer severed my employment due to an arrest charges but the case was discharged by the court... can I sue my former employer for discrimination or human rights violations?

What can you do if you work for a company who drives a tractor trailers and requires a class a driver's license if you are fired because someone else got caught driving tractor trailer without a class a license and then they hired you knowing that you didn't have a class a license and still put you on that truck instead of California

Mr Samfiru I need to know if I have a chance to get severance pay. Have been working at a call center for about 2 and half years full-time. Earlier this year my employer announced that the company will shut down April 10th leaving me unemployed. The job is pay for performance. Would I even qualify for severance or not?

Jay, on what date did your employer inform you that the company was shutting down? When your employer terminates you without cause (or in the many terminations that are incorrectly classified as "for cause") they can offer you either working notice, pay in lieu of notice (severance pay/termination pay), or a combination of both. Just be sure that the working notice they have provided covers your full termination entitlements. You can use our www.severancepaycalculator.com to determine what you are owed, based on several factors. For the field that asks how much severance you have been provided, enter the amount of working notice you have been given. Then submit the form to our firm, and we can contact you.

Hi Gloria, If you worked in Ontario, BC or Alberta, you should contact our team immediately at 1-855-821-5900 BEFORE accepting their severance offer. We would need to review any employment contract you might have. Barring a properly written termination clause (many aren't properly written!) you are likely owed much more than 5 weeks' pay based on your length of service, age, and position.

I was retaliated against and fired after I reported sexual harassment. The employee was fired and 27 days after I reported it I was fired.

Hello Angela, Retaliation following the a sexual harassment report is completely unacceptable. You would be entitled to wrongful dismissal damages (stlawyers.ca/labour-employment-law-for-employees/wrongful-dismissal/) You would also be entitled to human rights code damages. If this happened within the last two years, and you were employed in Ontario or British Columbia, you should contact us directly at 1-855-821-5900.

I have a question what if someone at my job put there hands on me and I report it and my job take forever to handle the situation and after tell me they are not gonna handle it, and then after ask me to leave the work permiss and don't give me a estimate time to come back...I called the union but waiting for a responds, so what can I do next?

Hello Lisa. in a non-union work environment, you may be able to treat your employer's response as a dismissal, and seek full severance. However, because you are represented by a union, only your union can assist you in this and any other employment law matters. Unfortunately, you cannot seek assistance from an employment lawyer. Sorry we don't have better news for you Lisa.

Hi Stephanie. If your daughter was terminated in either Ontario or British Columbia, we can take a look at her situation to see what can be done. If that is the case, your/her best course of action at this point is to give us a call at 1-855-821-5900 or email us help@employmentlawyer.ca Employers can terminate somebody's employment legally for many reasons. Those reasons may include the simple fact that the employer no longer likes the employee, or wants to bring a more favoured individual into the terminated employee's role. While it is within an employer's rights to do so, the employer must pay proper severance, which is dictated by the employee's age, length of employment, position, and other factors that we review.

There are pros and cons to unionized environments. One of the biggest cons of being fired from a unionized job is that severance tends to be much, MUCH less than what it is for non-unionized employees. Also, if you feel that your union has dropped the ball in terms of representing your file, you cannot seek assistance from an employment lawyer. You are bound by the collective agreement, and must be represented by the union.

can an employer use surveillance cameras to monitor your work performance and then terminate you from something they "don't like"

Hi Polo. In Ontario and British Columbia: Yes, an employer can use cameras, so long as they are in a common space and not in a private office. If you are let go for something they "didn't like" (nothing criminal), you may still be owed full severance so it is important to give us a call if that happens. Quite often employers will terminate and claim it was "for cause", when it actually wasn't legally for cause.
