Hi, I’m looking to add a clause to my contracts (if there isn’t one already) to protect myself in case my buyer backs out or there are issues during due diligence. Specifically, I’m thinking of including a contingency that states the offer is contingent on a partner’s approval and an inspection period. If I make this change, do I need to make any other adjustments to the contract? Also, where should I include this clause-should it go in the purchase and sale agreement, the assignment addendum, or both? Thank you for your guidance! Love the video.

Hi Adi, Great question! No, an Assignment Contract for wholesaling typically does not need to be notarized. As long as the contract is signed by all parties involved (you, the seller, and the end buyer), it is legally binding. However, it's always a good idea to double-check local laws or consult with a real estate attorney, as regulations can vary by state. Hope that helps! 💙

Great video, I just have two question: 1- who bring the title company? Who pays for the title company? Where/how to get the title company? 2- who pays for the inspection me or the cash buyer? Do I really have to do inspections or just write it in the contract that will be 7 days inspection?

Great question! As a wholesaler, it’s smart to establish a relationship with an investor-friendly title company early on to handle closings. Title company fees are typically split between buyer and seller but are often covered by the cash buyer in wholesale deals. As for the inspection, the cash buyer typically handles and pays for inspections. While you’re not obligated to conduct one yourself, it can still be recommended as it helps you market the property better and get a better understanding of what the repairs needed would look like. Including a 7-10 day inspection contingency in your contract gives you the flexibility to back out if needed. Great video as always, what CRM do you guys use to keep track of this MLS deals from all the offers that are sent and any homes that come back to market from previous buyers the home was pending with?

Hey there Chris! We've been using Streak CRM for years to keep track of MLS deals and all of our contacts/notes. We love it because it directly integrates with GMail. You can check out Streak here: get.streak.com/RealEstate We either do a manual review to see if any properties that went pending with another offer come back on the market, or set up notifications for a specific property through your Local Multiple Listing Service (MLS), or set up notifications for a particular property on Redfin. Hi Ricardo! Great question! Here are two options to minimize visibility of your assignment fee without a double close: Blind HUD: Ask the title company to prepare a Blind HUD, so the buyer won't see the fee breakdown until closing after the assignment contract is signed. Escrow-Only Disclosure: Structure the assignment fee as part of the closing costs, disclosed only to the escrow company and shown to the buyer in the final settlement statement. These methods help manage when the fee is revealed, usually after signing. Hope this helps!🏡
