A lot of people say "I don't answer questions, you NEED to say per the 5th amendment I will not be speaking with you anymore and invoke the right to remain silent. California,_ 572 US 393 - Supreme Court 2014. {After a 911 caller reported that a vehicle had run her off the road, a police officer located the vehicle she identified during the call and executed a traffic stop. The RAS that justified the traffic stop was based entirely upon the information from the phone call. The “law student” said that a stop can only be based on facts known to the officer. This is true…except that information given to the officer by others can contribute to RAS to perform a _Terry_ or traffic stop. They don’t necessarily have to witness the suspicious conduct themselves.

Funny thing, I emailed a formal complaint to a police department about an officer I witnessed with a suspect in a way I will say as "conduct unbecomming of an officer" to an administrative contact at the police department. My complaint took months but was reviewed and substained. I prefer email, it leaves a digital trail and the person I sent it to sure as hell doesn't want it sitting in their email inbox so forward it went just as I planned 😂.

If the officer has to be the one to write the complaint he can purposely write something else and then can use the lie "this is what the complainant told me" and if there isn't any video to back it up it becomes your word vs. Officer's word

Retaliation! From the first time they could not arrest him. So they thought they had something on him to make his lawsuit go away from the first case. They have to get an arrest and him take a plea deal and the first civil lawsuit they have on him will be dropped. Now they bought a second civil lawsuit. His law professor is representing him in the first case. The police chief needs to tell all officers to avoid this guy like the pledge. No one does anything to this guy without written permission from the deputy chief or the chief.

But only 83.5 hours of that is focused on learning the law--so yes, a law student who has taken or is taking a single law school class on criminal law has far, far more training. But as a friend who is a former cop says "the real problem isn't that police don't get enough training, it's that they hire dummies" (I'm paraphrasing that word "dummies"--he was more direct and less politically correct.)

Seems that most of these charges get dropped, so never make it to court. And when they do, I have yet to hear a judge chewing out a cop for arresting someone illegally, and the DA for clogging up the court docket with unconstitutional BS. I suspect they never will.

I challenged about 10 officers that surrounded me and wanted to search my property cuz THEY believed they could since the statute said they could. I clarified what a search was, clarified what an inspection was. Asked em can you stop a driver to inspect his DL just to see IF his license is valid. No of course not it's a 4th violation. So you have no actual violation to stop me for correct,, you can't determine by observation if there's a violation correct. The only way is for you to seize me and search my property, correct...Right so why would it not be an unlawful search for you to stop me search and inspect my property to see IF my property has a violation??? Crickets....well the statute says...(it did but we all know it's unconstitutional) They did end up arresting. Yet prosecutors declined ALL 3 charges...1 was even the catch all obstruction. I got them to admit EVERYTHING which is they had nothing to base it all on. 1 important factor is there has to be factual observations or facts NOT a hunch or gut feeling of criminal activity etc

The issue with suing is finding an attorney who will take the case. I don’t see much money here. How was this law student harmed? Did he lose a job or a house or his eyesight? Here in Philadelphia I know of a similar case that was settled out of court for $20k but only because the attorney was the litigant’s father. I don’t think any other attorney would touch it.

I wouldn't be surprised if they started "receiving more anonymous calls" because retaliation is not a problem if the officer can come up with any excuse for it. (They can even admit it's retaliatory so long as they have some excuse It's good enough for courts)

He has to. Department policy requires they get the ID. Cops conflate policy with laws and hold the belief that what they are doing is lawful. A cop can lose his job if he fails to follow policies but qualified immunity protects him if he fails to follow the constitution.

He was kept in handcuffs for over an hour and while he was alone in a cell? Total retaliation. He was non-violent, no threat to the officer, and was compliant as far as lawful requests. The use of hand cuffs is way out of line, and to keep in cuffs when he is placed in a cell and was not violent or resisting.

It's why I'd like to see people using the word "decline" (or to go super wordy "I'm electing not to satisfy that voluntary request"). You can only refuse something that is mandatory, especially in a legal sense. Of course they'll never stop this conflation since they're benefiting from it, however getting it on the record as early as possible is a good thing.
