Definitely contact an attorney. Don’t know how closing on a property in Oklahoma is done,but my experience in CA. and NY. There is a title company that checks for things like that. I believe that they should have informed you of this before the closing. They should be held responsible if that’s the case. Hope this helps. Good luck

If you haven't already, I would call teh Oklahoma Energy Resources Board (OERB). They have a program that cleans up orphaned or abandonded well sites, including remval of equipment , concrete and trash. Even if the wells on your property aren't abandoned they could be a resource for information on what to do. Good luck.

I'd call a Lawyer and talk about how the land was misrepresented to you and possibly see who you could sue, because this is AMAZINGLY ridiculous!! How did no one know anything about this until over a year later? Freaking INSANE!!

Especially since in 2021 the federal government deemed if an oil-filled had not been active for 12 months it was considered abandoned

@@mywoobee And due to that law any abandoned oil pumps left abandoned the owner is responsible for plugging it up with cement. With the property being abandoned before they bought it and it's been over a year since they bought the land, and nothing was done on the pumps, it's considered abandoned. The company is responsible for shutting them down permanently. Any land or property that's abandoned in Oklahoma from 30 days or a few months, is considered abandoned, and anyone can get the title and take over paying property taxes on it.

Chill, DO NOT PANIC. I've told you this before but you've never paid attention to any of my posts. My dad has 160 acres at hwy 48 and 56 just to the West about 3/4 mile. If you drive it, you'll see the big ponds, you can't miss them. OK, he's about 30 minutes South of you on 48. He too has a pipeline through the property. The oil people are very very understanding and WILL WORK with you. They are not the A holes people make them out to be. I'd about be will to bet money, if the oil people were to come and look at your stuff, they'd say leave it, we can work around this and will work around it for you, but going forward, whatever else you do, keep us mind, call us up and lets see what we can work out. We've had the oil people come out to my dad's property to repair a leak in the pipeline that was detected by air. While out there, they asked, hey since we have this equipment out here, do you need any dirt work done? Is there any oil related messes you want cleaned up on the property. They COULD do many things, but usually they WILL NOT and they are very cordial and nice people. Also if something does need moved, they'd even offer up to help you move it. For real, don't panic, just work with the oil people, YES it's worth staying there and keeping what you got. A few plans might have to change, but I'm guessing you'd be able to keep what you've already done.

I'm a Right of Way Agent in Texas. While this puts a damper on things, I don't see this as a huge issue. Especially with this being what appears to be an inactive field. Get in touch with the oil company. They'll work with you.

I know it's not my situation, but I honestly feel sick to my stomach for you guys. Please speak to an attorney before going forward. I'm so incredibly proud how you're dealing with this. A lot of people would have come on and been a train wreck, but you two handled this with such grace. I know you're extremely stressed, but wow🙏👏I will be seriously praying for God's hand over this.

@@tinybubbles263 It shouldn't matter 60+ acres much less a house on small lot, still has to be surveyed and so on or you could be building stuff on someone else property. Plus it has to go through a title company in order for this to be even sold and they require it to be surveyed and everything on the property is marked with in that survey especially on land purchases. If this did not happen then they got suckered in. If they are this gullible then I got some old cans they kick on down the road for sale.

I agree contact a lawyer to figure out which Homestead Act your land is filed under. The fact that you have documented your journey fully helps. Also consider hiring a landscape architect or property surveyor to help you plan out the grading of the land as you continue your journey.

California Land surveyor here. While every state is different, I have NEVER seen a remote access road match that of the written legal description for said road easement. I mention this because the road/path itself may not be at the legally recorded location for said easement. These things become tricky if written before 1972 as the verbiage is typically vague. In short, it would behoove you to have a surveyor review the language of the access easement and have them stake the centerline of access per the document. I highly suspect you'll find that the path and the recorded easement are not the same. With any luck the route of the recorded easement will work in your favor, but you definitely do not want to invest in utilities until the road location is set by a surveyor. You would also benefit from recording a "record of survey" with the county tying the access road the established monuments. Good luck!

Wow!! You two are handling this much better than I would. First, you two wanted an acreage for peace and privacy, you won’t have that if the oil company decides to use the property again. Besides that, your property is now pretty much divided. I’m one that would seek a lawyer and figure out if you have any options as to getting your money back. Of course, the ball is in your hands to its your choice. Best wishes for getting through this messy situation.

As Arthur commented, below, contact an attorney if for nothing else to make sure this isn't some type of scam. You wouldn't believe the kind of detailed research some scammers will go to in order to fool property owners into giving up their rights and even their homes/homesteads! It's sickening that there is so much scum allowed to exist, in the world but, unfortunately, it's a fact of life. At least an attorney will be able to determine, without a doubt, if it's legitimate, or fake.

Obviously all the details aren’t in this video. To me, it sounds like they don’t own the mineral rights, and whoever does, whether that’s the government or private oil company, has future plans for their wells. Still though, even as the landowners, they have a lot power. They definitely need to meet with an attorney who specializes in the oil and gas industry.

Wow I am so sorry ! Here in Alaska the Realtor or owner of property must disclose things like this and more . It seems so wrong, the Realtor could withhold this information . Knowing you wanted to build a home and have animals . I hope there is a way to find some kind of relief for this situation. I have a bad feeling they didn't use a title company to close the deal on the property. A title search would have disclosed all of this during escrow.😟

I wonder if there was a real estate company. Perhaps they bought it or even leased or financed it directly through the owner. I think the property in TX was owner financed and it reverted back to him if it was not fully paid.

I’m so sorry for what you have found yourselves in. A title company would have been helpful before but may be worthwhile to follow up with one in the area that’s familiar with the area now, especially if your planning on selling. I’d cut my loss and try to pick up the tiny house to another area, IMHO. Good luck! And all the best to you 2🙏

“Officer”? What department or agency is he representing? What laws, ordinances, or policies is he empowered to enforce? Who failed to perform their fiduciary duties in disclosures during the closing of the real estate transaction? Why don’t you know these things?

Jason, it's no coincidence that the officer came by 24-48 hours after your neighbor came over and had a long talk with you..Humm ! All that being said, how would the police know you were there and within so many feet of what he told you ? And I'm guessing this officer told you, that you had no mineral rights to this property ?? I'm also guessing the title /deed search never gave you any clues to this potential situation that someone or something else owned part of what you just bought and paid for ..sounds like a legal issue of someone trying to scam you out of money and property you bought ..I do think you need a lawyer .. One who has knowledge of these things & issues..and please know you have more rights than the officer was letting you know.. He has only been told one side of a possible issue with your property. ..please check it out legally..a good attorney will give you a free initial consultation. This would be to know if indeed you have legal possession of YOUR property ..hope this helps

Go off grid solar . You could install a couple of small systems at each building. Use the generator as a back-up during winter. Will save you on electricity infrastructure also.

I'd be checking at the land titles office to make sure there isn't an access easement on the property (I might have missed that part trying to fend off my dog who was wanting attention), and then check with the State Mining Department to see if the well is actually listed as "abandoned". If it is, I'd try to have the easement removed and the well recovered and remediated at the well company's cost, and then you'd have your property free and clear. Fair warning, it'll likely cost a fair chunk of change to have that done (if it can be, that is), but it'd be money well-spent to get it done.

And get a clear map of all the boundaries and parameters needed to properly CO exist. Before moving forward with any more projects. I know you two will figure out the best Game plan for your future.

My experience with the drilling companies in OK is if it has been abandoned, most likely it will not be reopened. They don't "own" the land. Were you told if you got minerals right along with the land?

Keep the property. Ideal location despite a few large hurdles. The studio building is portable and can be easily moved. Use the barn as long as possible and build another as you can. You can do it 👍👍👍👍👍

It's almost impossible to obtain mineral rights anymore...I'm a former lease and title analyst of 15 years. Most land that is sold now days is surface to the sky.

Always confirm important information in writing cause people will tell you want they think you need to make your decision. Here in New Zealand a realtor can be sued if they give you wrong information or don’t make you aware of issues relevant to your purchase such as oil wells or boundaries etc

That is why you always research the land you are looking at buying at the county courthouse or register of deeds before putting money down or have a contract written that gets you the deposit back if the land is not free and clear from issues like this. Hope you all get it figured out.

My money is on the fact he will not use his head and get an attorney. As always too stubborn for his own good. I used to feel sorry for her thinking she had not a clue what she was getting herself into but some have to learn the hard way. And some like Jason never learn it all.

My biggest concern is if it is an active well cite, is it toxic? How will that effect your health or the health of your animals? Other than that, take your time. Look at all options. I'm 100% sure Jason will figure out a game plan. Then we will watch those awesome videos. I would be checking into previous owner selling you oil field land and the price of the property you bought would come down drastically if you choose to stay.

They have to pay you for surface use! We looked into buying another 40 acres and it had wells. They only have access to the oil and only when they pay for surface usage! You need to give the oil company an invoice for what you’ve done

If it was considered abandoned property, they should have detailed all of that before it was bought. With how overgrown everything was, it was abandoned property, and the oil well wasn't even being used, all these months they never bothered to come out and do anything. So I'd look into that legally, and and see if there are any loopholes around it. If they do tear down anything, I'd sue them to re-compensate for the money you put into it. But do not sell, you worked so hard on this property. Don't let the greedy oil company take it from you.

Who in the hell would buy it, how could they offer a problem to anyone else without disclosing all they have found out. Just because they were duped into buying domain property doesn’t make it okay to sell it to some other people without disclosure. Research people, if you see unusual things on a piece of land you potentially want to buy, dig deeper and question more about that property, including going to the court house, state department, know the law that’s in your favor! It’s really a shame in so many ways, nothing and nobody is a winner here. So who sent out the officer by the way with all this information? Did you even say that? I’m not sure you did 🤷‍♀️🤷‍♀️. Laws in this country are for corporations not we the people! By the way, they don’t care Danielle how much you did or what you must leave behind or what it costs you, hell a lot of people have their homes and property under the damn water because it was taken from them! Sorry, it’s a travesty, I consider it a crime against honest people just trying to make a life.

This is the responsibility of their closing attorney! Any easement should have been exposed at closing. An easement is an agreement to SHARE property ... NOT to impose an imminent domain. J & D needs a good attorney.

Land survey where I am at cost between $120-$150 an acre depending on topography. If you are purchasing 100 acres... well you can do the math. I put these costs on the seller as I believe ALL buyers should. A seller should know exactly what they are selling if they want the price they are asking. If seller was unwilling to get a survey I would knock that cost off your offer. We are not living in 2017-2022 anymore. SELLERS do not have the upper hand anymore. Title searches are free to anyone. Public record. If you pay cash for land, which is most common, you do not deal with a bank, and most forego these bank requirements due to cost. Put it on the seller always.

Hiring a lawyer that is not affiliated with the oil company is always necessary !Water is your key ! Leaching? Solar is an option but do want to live that life? As you always do, deep breath. This is when your friendships with your neighbors will help. Ask them if they own the oil on their land. If not how do they deal with the company. Seek out the neighbors that have found a good balance with the companies. If you feel the oil companies have primary power over you and there is a possibility they can take you freedoms away, leave. If not work with the worst case situation and protect yourself from it. Remember when you move there will always be problems. They will just be different. Ask your lawyer the questions about other people have come across in the worst case. That should be your baseline.

Jason and Danielle my husband and I found out we had a water easement through our property after we moved into our home. After going through the county and state we where able to get the easement moved but it took thousands of dollars. The best thing we did was hire a surveyor to come out and survey our land mark our easement. It was the cheapest way to find out what we where working with and how to proceed. They will mark the easement for you then you can figure out how to move forward. That is my 2 cents it did work for us. Much luck to you and Danielle.

Jason and Danielle, I’m so sorry that this has happened to you. Everything was looking so good on your property. Maybe there’s a chance you both can talk to the oil company about this situation and they will be willing to work something out with you. That would be my first option. The second option would be to leave everything the way that it is for the time being but move your trailer to a different location. Then figure out a plan B. You both have done so much to this property within a years time that I can’t visualize you having to lose your property and rebuild your dreams. Figure up how much it will cost to relocate your electricity poles, etc. In other words, talk with the oil company and the electric company. Then you will know which direction to take. See an attorney. My brother lives 9 miles out of Bristow and they have an easement. They have obligations to repair any damage to roads and lands. They paid a fortune to my brother for road damage and there was NO OIL and they’ve never been back. They may work with you but I would get any agreements in writing.
