He actually has a pretty good track record, but his cases tend to go before a jury (by choice). Besides I’d rather have a lawyer like this rather than one that just plays ball with the judge & prosecutor & just goes with whatever they dec. If he’s wanting to recuse this judge, he most likely has a damn good reason.

That's not actually what they're fighting over here. The issue is that the law requires her to stay the proceedings until a ruling on her recusal has been issued. But instead of doing that she is requiring all parties involved to show up to court every day as if the trial is going to commence, wait around for hours until she decides they're not getting a ruling on the recusal motion that day, and then rinsing and repeating every day. So everyone involved in this case has been wasting hours every day for almost two weeks standing around the courtroom when they all know that the recusal motion hasn't been ruled on and that the case is not proceeding.

That said, whether or not to hold proceedings (even for a status conference) seems to fall within "judicial" acts (albeit without jurisdiction) rather than "administrative" acts therefore, even if she is wrong to hold further proceedings, she would have absolute immunity from any consequences. On the other hand, if the court is truly acting without lawful authority by lacking jurisdiction, the parties have no legal duty to show up for any proceedings. The parties COULD choose that option if they are confident they are correct on the legal issue BUT (the classic big "but") that choice would likely not be without undesirable consequences. PS I, personally, interrupted a court proceeding (municipal court in my small city) because I thought it lacked jurisdiction and was immediately put in jail for 2 hours and issued a judgment of contempt of court against me. I still think I was correct on the law but the three judge appeal panel thought otherwise - although one of those judges issued a dissent to say that, in their opinion, the contempt of court should have been reversed because the process for issuing a contempt of court judgment was not properly followed. I may have a "contempt of court" conviction on my record, but no proceedings have been held by that municipal court ever since that day, over 8 years later (7/10/2015).

Nah. Every profession has people like the judge. She is one of those that gets everyone else to do her job for her. Under the guise of collaboration. I'm extremely in favor of team collaboration but when every task you have requires said "collaboration" you're really just pawning your work off onto others. But with a judge I would much rather she ask for assistance than make a decision when she isn't aware of the law.

Every qualified immunity case ever follows that standard, and I've been pushing to just arrest all involved for years instead of making a law to cover for something the judiciary made up to usurp another law.

He's not trying to interrupt her, every time she pauses after finishing her sentence he tries to speak. That is normal in conversation. If you wait too long to say your next sentence, people will talk over you. This happens to me all the time. People aren't being rude or disrespectful, they just think you've finished talking.

Disgusting corrupt judge. She interrupted him a hundred times and plays a victim card saying she allowed him to speak, where she has literally told him "I'm gonna cut you off here", and proceeded to keep interrupting him. Horrible judge.

In this video Judge Hurley who uses a very empathic neutral tone of voice told the lawyer to be more professional..."Court Cam: Judge John Hurley SCOLDS LAWYER For Lack of Professionalism" I actually like the fact that when this male judge says opinion he says it repetitively but with a normal voice. I think this female judge probably just needs to change the tone of voice.... Because some people take it as offensive speech. Maybe people enjoy more neutrality of mind don't like it if judges or lawyers don't use neutrality of mind and voice. But it seems people in comments don't use neutrality as well, they are often judgmental rude for various reasons but say that judge can not do it, or lawyer can not do it or teacher can not do it or officer can not do it... no matter the gender or nongender or whatever.

@@juneslugg2 lawyers generally have a flat fee. If they are retained you pay by the hour when get guidance. At least that’s been my experience in speaking with multiple attorneys. And also living with 2.

Not always true i was billed 300 an hour for a 10 months of court with my ex for custody and child support. Crazy expensive but not as expensive as what she was trying to get out of me.

@@deedee_31 I believe maybe you might have misconstrued my post. I believe Larry was very respectful of her. He was simply advocating for his client. Also there is also something else going on that attorney/client privilege maybe won't allow him to share. But there is definitely a reason she is being asked to be recused from the case. It tells me it must be serious if he told his client to stand by and not even come into court.

The judge actually said 'Let the chief justice be the judge of that.' The Chief Justice has not yet decided. The defence attorney is insisting that she should be treating this as if the Chief Justice had decided against her. Do you not see the problem with the position the defence attorney is taking?

@@MissionaryInMexico Say for the moment, someone makes an accusation against the state bar, including all judges and prosecutors generally, in response to having been arrested. Regardless of the fact there is almost certainly no merit to that accusation, they simply get to walk? It does not work that way. She is only staying the proceeding. Now I do agree that she should likely not schedule the proverbial next hearing until after there is an answer, but other than that, she is not actually hearing the case at the moment.

Quite plausibly, however, if she can't do anything, she could not make that decision either, could she?

Assuming he has money for appeal, a judge improperly failing to recuse herself is the best thing that can happen, because it provides grounds for overturning a conviction if things don't go well for the client.

This doesn't apply to judges only. For instance a city council member would recuse from voting on a motion if there is a conflict of interest. Pretty much anytime there is a conflict of interest a person should recuse themselves from a situation.

Judge Hurley is a great judge, he is loved by many for his genuine attitude.... he was also accusing an attorney of running the court his way, it's in one of the videos..... and told him that many others had a similar problem with him. that the court is run by the judge and not by the attorney, and that he was asked before to change attitude but he never did, and he asked him to finally change the attitude....he wanted to say his rulings whether the suspect will stay in jail or not and the attorney was pushing his own agenda, but the attorney was not pushing it so hard, he was actually quiet most of the time...didn't push it so hard as Mr. Forman did in these videos...But I understand that Dui's cases are different than the cases of Judge Hurley who ahs a real offender.....It seems some courts are mostly run by the judges as Hurley who speak the rulings 95 percent of the time, but he is also very empathic and doesn't want to punish the addicts too much, or too less,..But it's confusing when the judge has the right to speak and when not.. if Judge Hurley explained to the attorney how disprespectful his behavior is, for running the court his way and expecting his agenda to make rulings for his clients. The attorney only said I need only this and this and the judge replied ok we will write it down and take care of the request...or something like that. It seems Judge Hurley&y likes to have things done quickly therefore he doesn't like it when someone is trying to run it differently in different timing. Maybe the timing of the speech was the biggest problem because then the judge could not focus on the papers that he was reading and studying.. so he loved things in his own tempo and timing...So maybe this lady is not a bad person, maybe she likes to have some orders...and I guess if she will know Mr. Forman better, she will understand his type of work more and better....In some videos the female lawyer was annoying but the female judge was annoyed by her attitude and interruptions but she as the judge was very decent to her, she tried to be fair..and told her in a polite manner to do it the right way...and explained to her that she wants to be fair to both sides... in the end, she said I have to today many other cases you have to give me some break, I didn't have lunch yet etc.

It is so concerning to see a judge behave this way! To belittle an attorney who is clearly making a valid point for her to follow the law, this is so concerning of this judge on so many levels!!! These are the judges we do not need! Clearly she feels she is powerful, everyone else is beneath her, and she doesn't like to be rightfully called out when she is clearly wrong! To belittle an attorney like that, yet she's the one who began interrupting him! Sadly, this attorney is in front of her a lot. Makes you wonder how he could be mistreated in front of her on his next case. I would file a grievance!

She's unwilling to follow the law as written and yet her frustration is with him continuing to tell her what the law is. This judge really needs to either be brought up to the bar, or have her self-educated.

@@sublimehypocrisy. Actually, there wasn’t even a need of a hyphen. My pet peeve is the overuse of the words and subsequent watering down of their meanings. Words such as ‘genius’, ‘GOAT’, and ‘legend/legendary’ for example. Or the redundant use of the word ‘literally’!

Your a weapon mate and I would love to have you on my defense team 😃 I'm an Australian that has unfortunately spent most of my life in and out of our courts so you can imagine how many times I have had a front row seat for clashes just as entertaining as this one was. Much respect to you for standing your ground. My long suffering lawyer (and friend) has actually recently been made a judge which gives me some hope for our courts as from what I can see you are both much alike. My question for you Mr Foreman is do you have a similar end goal to become a judge? And is that something you can aim for with the system you guys have over there?

@5:35 the judge seems to say she's going to look into the decision, now. Then goes on a rant, expressing her frustration with being interupted. If she weren't interrupted, she would have continued, without jurisdiction. KANGAROO COURT INTERRUPTED.

Imagine being a kid, growing up and arguing the shit out of things, suffering the repercussions of arguing with anyone who will listen - and finding out LAWYERS do this and get paid. Then having a judge tell you, to stop talking and listen more. This fearless advocacy from a lawyer is what I’m hoping for if I ever need it.

We filed a motion to recuse the judge because we felt she had personal bias against me as counsel based on statements she said about me in previous court hearings. It was ultimately denied.

@@ihatecrackhead The defendant's attorney was quoting case law, not Statute, and there is a difference. Also, I thought I heard the case-law cited as "Southwest Second" [SW2nd], which would indicate Decisions made in Arizona or New Mexico. He is before a Kentucky court. The cases may be of persuasive value, but not probative, i.e. compelling of a Kentucky court. My hunch is that the trial court has Jurisdiction, although it would be prudent for this judge not to declare same until the matter is reviewed by the Chief Administrative Judge. What defense counsel seeks to do is remove this particular Judge from this particular case. Without seeing the Motion contents, it is unclear what the grounds are. I would have to assume some demonstration of lack of impartiality. A smart judge just grants the recusal and lets another judge deal with it. This Judge has apparent ego issues and a thinly-disguised desire of revenge, and that breeds disdain for the court system in the general public.

Judge Hurley is a great judge, he is loved by many for his genuine attitude.... he was also accusing an attorney of running the court his way.... and told him that many others had a similar problem with him., that the court is run by the judge and not by the attorney....he wanted to say his rulings whether the suspect will stay in jail or not and the attorney was pushing his own agenda, but the attorney was not pushing it so hard, he was actually quiet most of the time...didn't push it so hard as Mr. Forman did in these videos...But I understand that Dui's cases are different than the cases of Judge Hurley who ahs a real offender.

Dude you’re completely wrong. All the judge is saying is that the matter was set for trial on Friday and now there’s this other motion up in front of another judge so they’re waiting for his ruling to come back down and she say just come back day-to-day until we get the ruling. She’s not beginning the trial at all she’s just saying each day will meet at one and see if there’s a rule and if not then we come back the next day but if there’s a ruling we’re ready to go if that’s the ruling as she’s certainly within the rights to do that they do this all the time with cases that are set for trial to get trailed or 1 million different reasons but it certainly wasn’t her prerogative to make him come back each day to see if the ruling Has arrived yet. The lawyer is trying to delay the trial obviously and so what he wants her to do is just let him not show up and then when they get the ruling reset the case for trial and she doesn’t have to do that so you’re wrong. Also people always admire lawyers that fight like this, but in the long run it doesn’t do your client any service because all it does is aggravate the judge and having the judge aggravated against you and your client is not a good thing you can be a zealous advocate without being a jerk every time she said something he was stepping on her toes she let him speak without ever interrupting him

No, anyone could and should report judges to the Judicial Qualifications Commissions (varies by state) who review violations of the judicial code of conduct.

👍Ugh... This judge has an ego issue that is very frustrating. She is also not honest or informed about this law. I'm sure she fought tooth and nail to keep control over this case. I can relate to the feeling of exasperation that is evident in his voice. It’s the frustration of trying to explain something to someone who has been given authority, something they would already know if they were actually qualified to hold the authority they possess, and having no recourse against their incompetence.
