These only make it an offence to refuse to give details if on airport property. However, he was off the airport property, i.e., the bylaws had no powers.

Completely arrogant, rude, trying to antagonise the person, lack of knowledge. Trying to Arrest him for a law he didn’t know and told the suspect to look up the law himself to find out. That’s a new one eh. He was clearly pissed that he was made to look like a joke and couldn’t intimidate the guy so decided to get info to put him on intel system and went the wrong way about it. It is correct that this bylaw makes it an offence to refuse to give Police your details when on the property, but it doesn't make it an offence outside the property. The fact he entered the property and left the property doesn't matter, as the bylaw has no powers off the property. The Office is on camera committing false imprisonment, kidnapping and battery. He's proven to be a very dangerous person to be allowed near a firearm.

This will be one of the easiest wins ever. The Manchester Airport (Constitution) Order 1986 applies to Manchester airport property, but not outside the property. Rice V Connolly 1966 still applies outside the property; therefore, the Office committed false imprisonment, kidnapping and battery. The Police need to reconsider letting a man who commits kidnapping and battery to have access to a firearm.

Not only did he abuse the Manchester Airport (Constitution) Order 1986 (the law he could not remember) by claiming it has jurisdiction outside the airport property (it doesn't), but he also lied when he told him he has to stop filming. You don't lose the right to film when arrested unless the act of filming is interfering with the arrest. In the case it wasn't, as the office was able to put the cuffs on without any obstruction. The Police could seize the camera under Section 19 of PACE if they believe the camera had evidence of a crime taking place; however, in this circumstances the alleged crime was refusing to give detail to the Police (which wasn't actually an offence as Rice v Connolly still stands in public).

I believe the bylaw the police was refering to, is this bylaw 3.26 Identification. No person shall, upon request by a Constable or an Airport Official, fail to provide their correct name and address, the purpose of their being on the Airport and any identification which is necessary for the purpose of the request.

The Manchester Airport PLC Byelaws 2024, which came into effect on 12 June 2024 and supersedes any previous version, do cover the entire airport site but I couldn’t see anything compelling people to provide their details to police. Edit: Unfortunately 3.26 of the bylaws does require people to provide their details.

However, the bylaws do not apply outside the airport property; otherwise, they would not be bylaws, they would be laws, i.e., he was not committing an offence by refusing to details as he was protected by Rice V Connolly 1966. You don't need to be a Solicitor to understand the model of the law.

Concerning whether this is land is privately owned or not, I would suggest as this was accessible by the public and it was a public easement. So private land does not have traffic restrictions such as double yellow lines. You will see in the background double yellow lines leading up to the entrance of the hotel. Where the incident took place was clearly in a public place. These are council enforced RTA regulations, and therefore I believe not privately owned roads .further to that, it is publicly accessible as it’s a bloody hotel!

You can’t really base things on yellow lines as owners of private land can paint yellow lines too. In this case the entire site is part of the airport, so nothing to do with the local authority.

As yellow lines can be painted on private land, using them to determine if land is private is not a good method, as you can come to the wrong conclusion, like you did in your original comment, despite your thoughtful analysis. Airports are pretty unique as some have byelaws specifically relating to vehicles, but generally speaking, yes, there’s not much that can happen if you park on yellow lines on private property thanks to the Protection of Freedoms Act 2012, which made it illegal to clamp, tow or block-in vehicles parked on private land. The RTA can still apply on private land that’s open to the public, but other than that, whether or not it’s publicly accessible isn’t relevant. TGA has confirmed that the bylaws that were in effect at the time this video was filmed didn’t require people to provide their details unless they had broken a byelaw, therefore his arrest was definitely unlawful. It would be a different matter today though as the current Manchester Airport byelaws, which came into effect on 12 June 2024, require people to provide their details when asked, even if they haven’t committed an offence. Others cover filming/photography, having to leave if asked, failing to comply with signs, along with many other draconian restrictions. There’s a map that shows where the current byelaws apply and it covers the entire site, including the hotels.

That first officer should be up for disciplinary. This is why police get a bad name. Thinks he is one of the lads and better than anyone. Grow up. If this is how you deal with public then no wonder there is issues with police. I suspect he is the 5-10% of bad apples but absolutely shocking behaviour. Antagonising the suspect, not knowing the laws and telling the suspect to look up the law. Couldn’t even tell what law it was. Basically what happened is he was absolutely embarrassed And tried to use his power to threaten and scare the person in to giving the police intel on him. No wonder this didn’t go anywhere as defence would have a feeeeel day in court. Please take this cop to court and make sure everything is revealed and what has happened with this copper. I hope new training, disciplined and a lot more. Has a huge ego, aggressive and lack of common sense. Needs taken down a peg or two. Keep us updated on how this one goes please.

I stayed at that hotel before flying in 2009 and a member of staff told me that they aren’t part of the airport but work very closely with them and they allow each other access etc because it’s benefits them both and makes things like shuttling passengers and security etc easier for them. The breakfast had the best pork and leek sausages I’ve ever had.

I surmise the 2024 Manchester Airport Byelaws are an update in response ? to this woeful incident; seems '3:26 (2024) Identification' is pretty draconian along with '4:25 Photography.' Were the charges dropped because they failed to state the byelaw for the arrest or were the present ones not in place 2023? Or do you have to be suspected of a crime to be subject to 3:26 ? (this is not specified in the Byelaws) 3:26 (2024) reads like a carte blanche to abuse citizens. Credit for standing your ground, takes some courage and very pleased to see you got a result.

Hi, be careful, certain airports have bylaws in place that differ from "other" UK laws. I know that Stanstead airport has similar bylaws in place.

This is good advice. I’ve seen some bylaws at other airports that are quite comprehensive. The new Manchester Airport byelaws are draconian and require people to provide their details when asked, even if they haven’t broken any byelaws, along with many other restrictions, but they only came into effect in June 2024. At the time this video was filmed, people only had to provide their details if they had broken a byelaw, so TGA was definitely unlawfully arrested.
