An unlawful arrest by a civilian is not only a criminal offence, but it’s ten times more serious than the same conducted by a policeman when it comes to a civil claim. His employers have a vicarious liability for his actions so you ask HNK solicitors to pursue claims against both as co-defendants

You're right about the unlawful arrest. It's classified as unlawful detainment. Common law only allows detainment for a indictable offence (crown court and/or jail). HNK don't handle civil matters other than against the police, which is what they specialise in and are very good at. There are dozens of other no-win-no-fee solicitors who will happily take on this kind of case because the amounts that can be claimed can easily go into the hundreds if not thousands. The police will stick to around £500/hour or part there of, but there is no rule for private companies.

I stowed away on that plane once but ran out of food after three weeks and had to give myself up to them. They fed and housed me for several years but when I wanted to join them and do an SIA course they said I was overqualified so I went back to managing an international company.

@@nineoclockhero What I meant was security in general have no more legal powers than any other member of the public. They can make an arrest under section 24A of PACE if an indictable offence has been committed (whether on private or public land), but so can anyone else. They can ask people to leave private land and use reasonable force to remove trespassers but so can anyone else acting as an agent for the landowner. There’s not really anything security can do that somebody else can’t.

That security guard is a serious liability to his employer, unlawfully detaining people when no indictable offence has been committed. You weren’t being rude or aggressive in the slightest, as he claimed on the phone. Although his superior was ok in general, he failed to take on board what you were saying about the first security guard and dismissed what you said as “personal”, even though you didn’t say anything personal and were just informing him what had happened.

Your best bet would have been to allow him to arrest you then sue for unlawful arrest. Each and every one of us does have the power of arrest but only for an idictable offence personally witnessed. For example if you see someone punching someone else you can grab hold of them, call the police and keep them there until they attend. However this situation was far from that, You missed an apportunity to make a few thousand quid. All you'd've had to do was to confirm he had arrested you, that he intended to prevent you from leaving, let things run their course and then start a civil claim.

19:55 Unfortunately for the Royal Mail, they covered up the bit that said "employees only". So now the sign is more about vehicles with the no parking and clamping bits. So nothing against pedestrians. Private property doesn't mean people can't walk on it. That's what barriers, gates, etc. are for. Leaving it wide open for anyone to wander on means the Royal Mail don't see the unsecured parts of the property as important or part of their work. So you can't even be charged with aggravated trespass since no one is working in that area. Note that aggravated trespass requires other people to be in vicinity and doing something which the trespasser is actively stopping them from doing.

If they can remove you, how come travellers need to be served a court injunction to be removed from private land. GDPR, if an employee takes a picture, then that picture has to be available to the subject. It doesn't matter if it's a personal or company phone. You have the right to know where that picture has been sent. The employee would need to submit his phone to the company so that they can search where the photo has been sent. If he doesn't, then the company is liable to prosecution under GDPR laws. That is why contracts of employment forbid employees using their personal mobile phones. If they do surrender it, then the company will have to look at all personal messages and pictures. The only way you can be removed from private land is by walking off unless you are committing aggravated trespass, which stood filming and would not meet the requirements. You have to obstruct them physically. Filming doesn't fall into that category. Stop watching American audits. The law is different.

A court injunction isn't needed for travellers on private land. Companies have no right to go through someone's phone. Not even the police can without a court order. It's highly unlikely the company would get a fine for an employee taking a photo. They can physically remove him. He doesn't need to commit aggravated tresspass for him to be removed. They can't arrest him like they tried to, unless he commits an inditable offence.

They shouldn't have their phones when on site. When I worked for the Royal Mail we had to have our phones in lockers. I also worked for a merchant bank dealing with data protection, they have no right to record you.
