It's because some define gain of function to apply only to viruses that are known to be dangerous to humans. So if you were to experiment and make a non dangerous virus more transmissible to humans, that would not be defined as gain of function. At the very minimum, he did lie. He said there was no gain of function research. He knew that was a lie when he said it, he knew that wasn't the truth. He is guilty of intentionally and deliberately lying to congratulations.
