I think this judge knows he's going to be reversed so he took the easy way out just to give Democrats talking points. It appeals courts that overturn this throw out the conviction and save New York taxpayers money if not it will go all the way to the supreme Court which will cost a lot of money to the taxpayers. In the meantime the New York bar association should dusbar this judge and remove hin from the bench. Lawfare is not to be tolerated. This judge chose his path. @chuckschillingvideos Obvious reasons? Elevating misdemeanors to class E felonies on the basis of "an intent to defraud (defraud whom, btw?) in order to commit another crime" (what other crime?) Paying hush money in exchange for a NDA is not a crime. Yet they presented these misdemeanors as felonies to an ignorant jury of liberal peers. Not to mention the State interference into Federal issues (impeding the transition of a president-elect). Between the immunity ruling and the precedents in case law of a State interference into Federal matters (let alone the wrongful elevation of misdemeanors), this case is dead. Therefore, the punition phase should be delayed pending the higher courts appeals decision. NY Judge and prosecutors are making a mockery of the judicial system.

BTW, the "official/unofficial" conundrum is not justiable by the Courts (including the Supreme Court). This is irrelevant dicta to the central question of who has jurisdiction over the conduct of the President. The Framers removed this from the Article III Courts and specifically assigned it to the Legislative Branch in their Judicial function. Article I Section 2 Clause 5 clearly vests the Impeachment Power in the United States House of Representatives (SOLE POWER means only they can charge high Federal officials with Crimes allegedly committed while in office). To be blunt, POTUS has absolute immunity to criminal charges in the Article III Courts unless he has been impeached and convicted by Congress first. This is a Due Process of Law violation of the 6th and 14th Amendments.
