You are correct. At the stage of filing Chargesheet, there should be provisions for filing documents and be proved first to see whether the case shall go to trial. And for false evidence, there should be provision for punishment in the trial itself without relegating to S340 Cr.P.C.

People who made these laws have made it deliberately, this is about Hindu marriage act where it is systematically arranged by acts to destroy the sanatani Hindu families. People are not getting the point, very systematically other communities have their personal laws and Hindu community is subjected to derailment of their cultural ethos by way of such laws dividing the Hindu families by fighting amongst themselves.

We want Law Against willfull missuse of law. Law should be like - Judges must take self cognizance agaist the complaints when its clear that the case is filed for extortion. The punishment must be hery harsher then what the complainant wished for the accused. This way the number of cases in the courts will reduced too..

I think the IO should hear both side before submitting the charge sheet. If refused it should be sent to him through email Also the accused should approch HC/SC with all the evidences to quash the charge sheet. Or at the time of trial properly cross examined with evidences There is provision for WS. Also if found false there is provision in the IPC to punish the false accusation. I may be wrong sometimes. Correct stand may be given by anyone.

Sir I think that is the reason why provision regarding Pre-cognizance notice to the accused has been added in BNSS in section 223(1) Proviso where the opportunity of being heard has been given to the accused before the Magistrate takes cognizance of complaint case. I think this provision has been added keeping in mind the increasing false complaint cases. Sir, What is your opinion regarding this?
