Avoid working in skilled trades to protect yourself from WCB’s well documented “culture of denial”. Go to college and find yourself a safe and sustainable career!

Thanks for informing the public. My experience with Worker's Comp has been horrible. Misdiagnosis which lead to improper treatment and tge doctor " wanted to wrap it up" meaning what? They stall, treat u bad, Misdiagnosis and want u to go ur own way. I got a second opinion and it was so different than worker comp original and new doctor. I feel like my xare hasn't been in my best interest and further complicated my life with little consequence to worker comp. If they would jus do what's right from beginning then I would b well now. They need to hold these fly by night quick stop clinic doctors accountable. This should b a two way street- if employees cheat hold accountable and if doctors treat improperly then hold accountable. This set up is only in business favor and if their was an option to pay a percentage to see my own doctors I would have seriously considered that option. My own doctor would have me on path to healing right now.

WCB will prevent your diagnosis to classify your injury as “pre-existing”. Which will allow them to deny any future claims.

They should. But remember the court systems are corrupt. These judges were once attorneys and know EVERYTHING about how these cases go and that these doctors are obviously using malpractice for financial gains. Therefore, these judges and attorneys know that these quack doctors add length to these claims. 1. The extra length = more court fees which = more money for the judges and attorneys. 2. They know the real value of your injuries. But they want people to not obtain money because they want to keep people miserable and poor. 3. These malpractice doctors can definitely be held accountable. But, the court systems want to make cases more “interesting” because of 1 & 2 (money & keep people poor). The solution is easy. If a real independent exam is needed, the ICA should randomly handpick qualified and trustworthy doctors to see injured workers. NOT the insurance companies who are known for consistent bad faith. Then you’ll see how drastically the results of comp & personal injury cases change.

I had nearly the same thing happen. They are trying to claim that I don’t get a settlement because I have “so many pre-existing conditions”. Firstly, those conditions I just so happened to have were treated and cleared by various I saw to get me better. I was working just fine before the injury, but afterwards I now have to walk with a cane so I don’t fall down. I got a second opinion from a clinic that mom recommended, and they found an issue that might need surgery. Huh that’s interesting then why was I put a “non-surgical treatment needed” when I was being treated by workers comp doctors. They put me through months of physical therapy where no improvement was made. I was supposed to be seen by a doctor who would assess my level of injury so I can be compensated. As of now it’s been three months since my adjuster has spoken to me. A month ago I had enough and got myself a workers comp attorney. I hope things start to work better, but who knows.

I'm in the middle of a WC case w an atty, I had my deposition in Nov last year, testified Feb in court, the judge approved a weekly salary almost 2 months ago and I have not seen any checks yet. How long does it take after a judge approves an income to get it? This case has brought me nothing but losses, 9 months into it and I have not received a dime from the insurance. Any advice? Thanks!

Horrible attorney, you should of gotten checks within a month. Only occurence is that you probably took a long time to file a claim from date of accident or carrier have doubts about your deposition statements

It's been a year since I've gotten hurt on the job by a civilian driver. I hired a personal injury lawyer. I think I made a mistake by hiring a lawyer. It's almost a year now and I have not received anything for my injuries. I have two slipped disc in my neck according to the MRI due to an auto accident. I feel like my lawyers are rookies. The set out a demand, 30 days later the at fault party insurance company is asking for a last ledger of the workman's comp because I am trying to get paid lost wages. I gave them that ledger 35 days ago and today asked him for an update. They said they have some issues with the adjuster in the adjuster has not made an offer yet. I'm wondering what is going on and my lawyers will not tell me. Any ideas?

Nothing. Alabama law is 100% in the insurance companies favor. They pay out politicians to keep it that way. Our comp pay scale is based off income in the 1970's. It's absolutely disgusting and corrupt.

I had an IME and my attorney sat down with me before it. I had planned to go into IME and turn it into a bitch fest against doctors and claims adjusters. My lawyer told me that if I appeared to have an axe to grind things would go very bad for me. That was good advice and changed my attitude real fast and the IME came out glowingly in our favor even though my surgeon and pain management doctor were both disputing their prior diagnosis on my case. But I see how things could have gone badly if I went in their with a chip on my shoulder.

Hi I had a fall at work . My I was put on partial comp and then upgraded to full disablility with no work , following this I was discharged and told to go back to work . I went to the ER the following day that the comp clinic originally referred me to . The first time I went to the ER I was discharged with no findings but I was told that if the symptoms persist to come back . So the day after I was discharged I went back to the er , and they decided to give me an mri . I was diagnosed with severe spinal stenosis with a lumbar herniation l5-l3 I believe . I went back to the comp clinic and showed them the findings and they put me back onto full disability no work of any kind . It has been almost 4 months and I have not received any check nor have I been scheduled for a orthopedic even though the comp clinic referred me to see one . What would you say if I settled my case could be worth ? Thanks

Harris Cluddy If your claim is in Alabama, it will be subject to the minimum and maximum set by state law. The weekly benefit will be 66 2/3% of your average weekly wage. We cannot speak to any other state’s laws though. We hope that answers your question.

Good morning sir, my dr. Did indeed release me on light duty with further instructions of care, my work said they would accommodate but the job they assigned was tougher than my original job. All duties assigned went against Dr.s orders. My attorney told me to not go in. They have failed to keep my attorney in the loop. Should I be worried?

If someone settles their work comp claim, can they later use their own insurance to pay for surgery? Like pocket the WC money, and have private insurance pay for treatment

B Rad Thank you for the question. In Alabama, if you have settled your work comp claim with future medical care closed then any related medical care would be your financial responsibility. On the other hand, if you settle your claim with future medicals open, then medical care from this claim is paid directly by the insurance carrier directly. Basically, the answer is no. My personal injury case was going perfectly. I had a positive PTP report my deposition was neutral I was truthful though the whole process but this QME doctor ruined my case with false statements and he based his opinion and finding on a study that was outdated and reclassified reevaluate from a possibility can cause cancer to human to carcinogenic to human.
