Hanafi law, the donee must be must be legally in existence at the time of hiba. Thus, a gift to an unborn person, one not in existence, either (actually or presumably,) is invalid. Under the Shia law, a gift to an unborn person can be validly made provided the gift commences with a person in existence. How is it possible that you said the exception of 6 monts it is valid only in concept of will not in gift

Hi! My father in law got 2wives (1st wife) Christian love marriage (2nd wife) family arrange marriage than 1st wife got 1 daughter only but 2nd wife got 3son and 2daughters. My father expired recently by living property which was gifted to 1st wife 22years back(ORAL HIBA), both my father in law, my mother in law and daughter used live from last 22years but now 2nd wife sons tell 1st wife to vacate independent house as they are legal hire after they dad expired. We told them that this property is gifted by husband 22years back but they are not able to digest and fighting with us. Note:- 1. 1st wife CHRISTIAN 2. 2nd wife MUSLIM 3. We are still in the position in the ground floor but above 2 floor given for rent since 22years rents used by 1st wife but used give to father in law for his needs and for maintain his business. My queries: 1. As per you she is 1st wife legal owner but they are holding original documents so they are saying they are legal owners. What to do now in this situation and how to get legal documents from them or any other alternative methods to acquire legal documents on 1st wife’s name? 2. 1st wife would like to registrar this property on daughter name right now. What is the process as she doesn’t have any legal documents? 3. As per you who is the legal owner and what legal or police action can be taken to make them understand that this is our property? PLEASE REPLY THIS QUERIES ON URGENT BASIS. Thank you.

Suleman Khan, a Khoja Muslim inherited a farm house from his father Salem Khan and started living in his newly constructed bunglow with his friend Suneel Kapur, who was working with him in a Tyme Cinema MNC at West Mumbai. Suleman was relocated to Italy, by his organization and decided to migrate there. In the farewell that was organized at that farm house for him where after consuming alcohol he declared before his friends that he was gifting the farm house he inherited from his father to Suneel Kapur, who smiled and gave him a hug with tears in his eyes. After that farewell party Suneel Kapur stayed back at the farm house with Suleman Khan till early morning and from there directly went to the airport for his shooting assignment scheduled in Switzerland. Giving instruction to a lawyer for mutation regarding farm house, Suleman boarded the flight to Italy but died in the air crash. His brother Raheel Khan sues for the possession of the farm house on the ground that the gift was not completed as per the provisions of Muslim law. Questions???? 1. Whether Suleman Khan was competent to Gift that property ? 2. Whether Gift was complete as per the provisions of Muslim Law ? 3. Whether Raheel Khan is entitled to possess the farm house and inherit it ?

Because of genuine reason that the donor has no other residing place other than his hiba property. So can he stay with permission of donee even after hibanama is duly registered. Plz guide..

Sir.The Civil trial court grants permission to accept a gift document that is not registered with the civil trial court. We then put the WRIT petition in the High Court, and then the High Court ruled that the Gift Deed registration was not required by the Muslim Mohammedan Act. This is OK....?

Suppose someone does oral gift to his daughter in the presence of three or four witnesses in which two witnesses mother and brother and other two witnesses are outer on 31st July 2020 .can hibanama be made of oral gift while oral gift is fully completed after one month of the date of oral gift? If the delivery of the hiba after the oral hiba has been done, then their is no need to do the hibanama. But if you wish to make it in writing you must do get it registered.
