Russia made in clear almost 3 years ago that foreign fighters (contractors/mercenaries) would not be given the same legal protections as Ukrainian soldiers if taken prisoner. They knew the risks if they went there.

Jenkins was not a POW because he was not a serving Australian soldier. The guy was a private citizen who was either a foreign volunteer who chose to fight for Ukraine or he was a mercenary. Either way that was on him. All this talk of him being the first Aussie POW to be executed this century is complete rot.

Practice relating to Rule 108 Mercenaries. A “mercenary” is a person who takes a direct part in hostilities motivated essentially by the desire for private gain. A captured mercenary is not a prisoner of war. Article 47 of the 1977 Additional Protocol I spells out six cumulative conditions for a person to be a mercenary.
