My mom went through this when her mom died without a will. She had 2 other siblings and those two went at it tooth and nail over some farm land. It tore a close family apart for almost 10 years. They finally reconciled but by then her brother was terminal with cancer. I also have 2 siblings and we were joking one day about putting Mom in a home if she didn't stay off of ladders. Somehow in the kidding around it came out that she did not have a will. I chewed her out royally after what she and her siblings had gone through and asked her why she wanted to put her kids through something like that. A week later we all four met with an estate attorney so Mom now has a living trust with a pour over will. Having your affairs planned is one of the most loving things you can do for your survivors. If you've been putting it off, GET IT DONE!

@@ALCAN52 My grandmother didn't hate her children. She just didn't foresee them fighting like hyenas over what little estate she had. Neither did I, but I learned from the experience. My wife and I had wills done when we had our first child. Now that the kids are grown and we have assets we also have living trusts.

I was the little tag-along child and remember this getting taken care of. I knew I had older parents and it was a bit of security knowing who I’d live with if something bad happened. Do this for your kids, please, no matter what your age!!

Wills are cheap upfront, but expensive to get a lawyer to resolve in probate. A living trust is cheaper in the long run. Unless you die with no assets. Then get a will.

My mother died without a will. She wasn't a rich lady, but it still caused problems. No instructions on how to split up her possessions, savings and checking account.

If you don't have a will, the state will provide you with one through the intestacy statutes and the decisions of a court.

A good way to frame it may be to ask them if their parents were in the same situation what amount of urgency would they take to have them get it done?

Adult children have no specific rights to inherit anything in most jurisdictions. Now, that means parents can have a will that expressly disinherits an adult child, or if they have no will then virtually anyone in the family can step forward while the estate goes through probate. And probate happens anyway, of course. As for custody of a minor, well that’s going to be settled, in part, by the state anyway, so not having a will just complicates it further needlessly

my parents have a will and it will have to be split between me and my sister who do not like each other... the good thing is after hospital bills, etc. they probably won't have anything left for us to split... I watched the same thing happen with my grandparents and watched my parents and aunts & uncles fight each other for majority of the will and there was nothing left... I'm tempted to just tell my parents I want to opt out of it that way I don't even have to deal with my sister ever again

Well, some live with their head in the sand more than others. My sister and I are far older than this woman. But, I’m coming to realize that my mother is narcissistic and not only is she self-destructive and family destructive, but she just doesn’t care and has decided to check out and leave her problems to us. She decided to not file for taxes for s few years and, although I believe she has some dementia, she knows she’s liable for whatever amount is due. But, she really wants my sister and I to deal with her tax accountant. I think, as per things she’s said, that she’s decided not to worry anymore and she’s just going to do the things she wants to do. She doesn’t care about her health or her property. If you asked she’d say that’s not true. But her actions and lack thereof tell another story. The good thing for me at least, is that I already expect for her to leave a trail of destruction in her wake. I wish my sister understood this. Because the only thing left to do is to be somewhere else when it happens.

A Will is very important . Especially when you have children . It saves alot of fighting and arguments . People today prepare for retirement. But never prepare for death . And death is the surest thing . I've known someone who was about to retire at 30 years but died at 28 years in the company . Everyone should have a Will .

Agree. My mother died without a will. No instructions on how to split up her finances or possessions. Trust me, it causes problems even between the most accommodating siblings.

@@AnnMitt I'm sorry to hear your mother passed . I hope your ok . Yeah Wills are super important . It's meant to give some sort of direction or plan for the deceased assets . I know in some families the fighting over materialistic things can be severe . But some people in life never think they will die . It's a mental block. Many people prepare for all sorts if thing . But the one certain thing which is death. Few prepare for .

I looked at US Legal Forms (I imagine Mama Bear would be the same). It looked unprofessional to me, and I paid to have it done locally. It cost about $250, which won't break anybody.

There is probably a will, and they probably don’t want her to see what’s in it. Perhaps they are leaving custody of the minor to her, but they don’t want to have to show that they are leaving everything else to some corrupt pastor that has them conned, or to some Nigerian prince, or to some timeshare.

Yea I mean atleast give the vast majority of the assets to charity. The way I see it, she’s wording it like she would NEED part of their money which is the wrong motive for writing a will. I’m not discrediting the fact that you should write one but the fact that she wants to become the sole and ONLY beneficiary is morally wrong. Don’t make excuses and build ur own financial empire and don’t be reliant on family money for it either. But to your point, they should have some sort of plan for the long term in their will

I have already fill out the one page Payable Upon Death form at the bank for my bank accounts. You can divide it up however you want. It took under 2 minutes to fill out. The credit union lets you do it at the drive thru! It's Free. If you have someone that will need money right away, it's the easy way to go. My name is on the car title . Make sure it is listed as OR, not AND. I will be able to sell the car if anything happens to my companion, without resorting to forgery. He has no will, in spite of nagging by everyone. He says" Let them fight it out". Sigh. You can lead a horse to water......

Sounds like the daughter want the parents to memorialize the daughter's wishes that cuts the brother out. It is clear she presumes that with becoming guardian of the younger siblings means she should inherit the parent’s assets. This is the typical law school case study.

No assets does not equate no possessions. You apparently have a device to access the internet. A phone maybe? Computer? Having a will means you choose who gets it. Even if you leave everything to charity.

@Anne Day when you go to the lawyer or printed up online, you will have a chance to put down any assets that you own... It could even be jewelry or a car. You can put down the name of the person that you wanted to go to. You can also put down the executor. I highly suggest you get it notarized, and give the executor a copy of the will and let him know where you keep the original. I have taken a step further, and given a copy of the will to the persons that I bequeath my items to. That way, everybody knows the deal! There is no mystery.
