For those of us out there trying to build a rail or railings like this please don't use them type of nails (pneumatic brad or finish nails) they WILL rust and fall off...looks nice though...

Did you use pressure treated lumber or standard pine 2 x material ?

Russell Motter pressure treated. And for the slats I used fence panels that were split down the middle.

I couldn’t tell ya because you’d need to check with your local regulations. There are many things that have to be accounted for when building so I would check if you’re unsure.
