Prof. Abou el-Fadl strikes a chord when he points out that REAL scholars in the present era are those who are well versed in modern approaches to knowledge rather than the many traditionalists who propagate a simplistic, outdated and "Mickey Mouse" version of Islam. For one thing, the traditionalists never study the effect of their text based rulings on society because they have no - particularly academic - background in the modern subjects of sociology, anthropology or philosophy/ethics etc. This explains why these people are able to produce Fiqh which is simplistic, ugly, unethical and unfit for modern minds and thus which is off-putting to modern, reasonable humans. The Prof. uses the word Shari'ah correctly - an enlightened path. According to the traditionalist formula, however, the Shari'ah is used to mean, is consonant with, law and legal matters which inevitability leads on to legalism. Farooq and el-Ghattis's paper "In Search of the Shari'ah" in the journal Arab Law Quarterly, 32 (2018) 315-354 and Farooq's 2011 book "Toward Our Reformation", IIIT deconstructs the traditionalist account on this front.

Beautiful insight. However, don't you think that the way in which the 'modern mind' approaches topics such as ethics etc should also be deconstructed? For example critically assessing liberalism?

A very sugar coated claim with an agenda please do not confine scholarship into so called modern academic backgrounds and such a sweeping claim that the fiqh simplistic in what sense will you care to explain? What modernised fiqh do you call for? one that is secularised and western oriented? When was traditional islam micky mouse themed? In fact there is no need to call it traditional as though its perceived as a group based ideology traditional is pure it does not conflict with modern issues rather modernists want to change and twist its principles presentating in such an alluring manner almost deceptive if you have any shame whatsoever take back what you said and do not undermine great people for verily we stand on the shoulders of giant and will carry on doing so until qiyama whether you class it as simplistic or not jazakallah

@@Abul_kutub Scholars of the golden age were well-versed in philosophy and the sciences. They took into account their epistemological context. Today, traditionalists are not and do not. Hence, the simplicity and blind nature of their rulings, and their regurgitation of the past without addressing modern issues

The aim of the sharia is not just the promotion and protection of human benefits rather it’s also for preventing harms which you sir want to open the door to with your lies and innovations !!
