Scalping has _always_ been above board (except when bot scripts are involved and the use of them is against a site's terms of service anyway but as far as I am aware, there's no way to enforce that because there's no way to detect a user-side macro). It's just generally frowned upon because of the absurd markups and the hoarding and selling out of items pushed by corporations (like Nintendo and their Amiibos and Premium Bandai and their basically everything) who engage in the equally scummy tactic known as artificial scarcity (which Wario clearly doesn't care much for because he wants as many people as possible to play his microgames).
