UPDATE: Tim Schmidt spoke to Mr. Colie and learned Mr. Colie chose the Loudoun County public defender that was assigned to him because he liked him and he thought he could help him. As a USCCA member, you get to choose the lawyer that you want. Mr. Colie's attorney, the Loudoun County public defender, is a seasoned attorney and at his recommendation Mr. Colie is now using an appeals attorney being paid for by Mr. Colie’s USCCA Membership benefits.

PD assignment is done by the courts for folks who cannot afford an attorney; therefore, a PD WOULD NOT BE assigned to someone who has an attorney (which your company was supposed to supply). "IF YOU CANNOT AFFORD AN ATTORNEY, ONE WILL BE APPOINTED TO YOU" (assigned by the courts). So why did your company not assign an attorney? You're still not answering the question.

The insurance company, Universal Fire and Casualty Insurance Company (UFCIC) has been and continues to be in contact with Mr. Colie. Mr Colie is currently represented by an attorney whose fees are being paid for thanks to his USCCA Member benefits, and who is seeking an appeal.

I have never seen uscca indicate anything other than Alan Colie not being denied, and they are now saying he was never denied. I do wonder why he had a public defender, but, I guess, remember that public defenders can be very good, and, well, IDK what else. But if he wasn't denied, he wasn't denied. I hear he's being released on time served now so if there is major stuff going on maybe we'll hear it from him

Im a data guy and in order to have some sense of trust it would be nice to have aggregate data showing # policy holders by state, # claims accepted (separated by criminal/civil), # denied claims, # acquitted, # convicted, # appeals, etc.. that one could use to verify USCCAs claims independently. You can't people to simply trust your word. Data is crucial

USCCA vs AOR: AOR represents everyone regardless of guilt and USCCA is strictly coverage for "law abiding citizens" that used a weapon in self defense.

I have been a USCCA for years. In my April 2024 issue of the USCCA magazine there was an article about plea bargains after a self defense action. While the article clearly stated the benefits of a plea bargain under certain circumstances, there was no mention of the fact that the insurance coverage provided with membership immediately terminates upon accepting a plea. This is a fact and is deceptive to us members.

Looking over the court records Mr. Colle did contact USCCA after the shooting, but ended up with a public defender instead of an attorney paid for by USCCA. As a journalist I am trying to get the the truth and accept you can not give specific details. So let me phrase the questions this way. Did USCCA or any third party affiliated with USCCA decide not to provide the attorney for Colle's initial trial? Did Mr. Colle decide not to take USCCA's help? You don't have to give me a reason, but I think it is reasonable to answer that question since it would not affect the appeal, but would clear up a lot.

I’m currently a member of USCCA but I just watched a video called “The Truth About The USCCA Self-Defense Liability Policy (2023) - Attorney Marc J. Victor” and now I’m considering switching over. The biggest point that he made was that they are a law firm and now an insurance company like USCCA so they don’t have the same limitations.

You're speaking in half truths. Both the client and AOR have the ability to drop coverage at any time. HOWEVER, once you make the call for Self Defense services, They cannot drop coverage. I actually just went through this yesterday. I did have U.S. Law Shield until yesterday.

I can tell when something doesn't smell right from half answers and can do my own research. I just think everyone else should do a little research too. ​@@USCCAOfficialBeing a Subject Matter Expert (SME) for the last 21 yrs. I can tell you having a good and competent lawyer is a necessity, not having a public defender represent you at trial that may not be as good as Mr. Colie's public defender happened to be in this matter. So, as an Elite USCCA member I ask you, why was Mr. Colie not provided the resources to hire a good and competent attorney when he contacted USCCA at the very beginning of the case before the trial stage, and it was not until after the judgement had been rendered that he was found guilty of the lesser charge of discharging a firearm within an occupied building that now UFCIC wants to assist financially towards his defense? I do not know the details of the case but having a SME assist in explaining that in Virginia a sign indicating no firearm allowed has to be brought to the attention of the CCW holder and the owner then has to be trespassed could have assisted the jury in understanding the nuance of Mr. Colie’s case (especially since he was just picking up food as a Door Dash driver and temporarily being in the Dulles Mall) that could have rendered a Verdict in his favor with the lesser charge. Only with the proper financial resources can such a defense be presented to the jury and looking only at the information you have provided; it appears as if that assistance from USCCA was not provided at the outset. I want to be clear I am not asking about the case because it is ongoing, but I am asking a simple question, did Mr. Colie receive the financial resources promised from USCCA/UFCIC when he contacted USCCA for assistance at the very beginning not the end of his trial? That information has no bearing on the Colie case currently being appealed and should be answered without qualification. If that is not the case, please let me know.

As a current platinum member, I have a concern that a shaky camera angle and a political prosecutor that throws semi relevant charges at me, to see what sticks, will be enough to get me dropped and my bank account drained from recoupment. All while sitting in a cell somewhere. As a paying member, I feel concerned about this.

They are an insurance company. All they want is your money then when you make a claims they drop you! My friend got dropped by uscca because he was being sued from a home owner that said he didn't have permission to carry at his house. My friend was there for a graduation party, a homeless man entered said party with a machete waving it around and threatening others. My buddy presented his firearm on the homeless man and told others to call 911. He was able to keep that guy from possibly hurting others. But yet he gets sued and then dropped by uscca. Not one shot was fired!

There was never a denial of Mr. Colie's claim, or a denial that he acted in self-defense. Alan Colie is covered and always has been covered through his USCCA membership benefits. Mr. Colie did not share with us why he chose a public defender. We do not know why he made this decision.

I tried to apply years ago and your site said "WA State does not allow carry insurance. I put in a request at WA . gov and they said there is no such law. I found 2 other companies that insure WA residents. After watching, I don't know how many videos of people complaining about USCCA, the consensus was you refuse to cover WA residents because they're considered too expensive. 67k views and only 4k likes? Thank god I dropped this company. Backpedaling fraudsters. You are collecting money at a rapid rate and paying out zilch. There are laws applied to insurance companies to keep from doing things you are actively doing. Health insurance companies would be indicted if they performed like your organization. Shame on you. @@LEP021085 So in my area under the USCCA attorney network there is only 1 Lawyer in my area, his main practice is Accident & Injury, Bankruptcy & Debt, Bankruptcy, medical malpractice, and car accident injuries. Now if I'm forced to defend myself, I'm going to need a criminal defense attorney, it says he practice criminal defense, but it doesn't seem like a strong lawyer I'd want. There is no other lawyers besides him, so my options are, take him, or take the public defender? I'd probably rather take the public defender.

Ive been a USCCA member for about 10 years and after watching some of the stories where USCCA did not cover some of the cases it has me pretty worried that im not covered. I dont have USCCA for training im here to get out of jail and get an attorney if i have to defend me or my family. Im really thinking about changing over to AOR unless something changes in USCCA policy insurance claim, AOR is cheaper and cover for everything

Brian be very careful I was a member of Legal shield and sold the service as well. Well my wife and I got scammed by way fair after canceling an order- we asked legal shield to intervene and they jerked us around- well 4 years later we are still fighting it. I watched the AOR video and they said they also have the right to not accept cases and don’t cover misdemeanor charges- every other insurance plan for defense does the same thing- go research them. Use the USCCA training so you can avoid even a claim and keep your mouth shut if you are in a situation. Btw I’m an insurance agent for 41 years you should see what the Health insurance companies and life insurance companies and Casualty companies try to do with claims. As I said the best fight that you mean he’s the one you’re not

Yup I switched earlier this years after hearing about all the stories earlier. Ya I don’t really need the training but I do need to be covered no matter what when defending myself. Plus I live in California so I’m sure any self defense is considered a crime

@@joset356 It's important to note that an individual will not be dropped simply because they are charged with a crime. We fully understand that being charged with a crime is an inevitable outcome of a self-defense incident and took this into consideration when structuring the membership.

Looking over the court records Mr. Colle did contact USCCA after the shooting, but ended up with a public defender instead of an attorney paid for by USCCA. As a journalist I am trying to get the the truth and accept you can not give specific details. So let me phrase the questions this way. Did USCCA or any third party affiliated with USCCA decide not to provide the attorney for Colle's initial trial? Did Mr. Colle decide not to take USCCA's help? You don't have to give me a reason, but I think it is reasonable to answer that question since it would not affect the appeal, but would clear up a lot.

I couldn’t care less about the p-ing contest that’s going on between USCCA and its competitors. I want to know how I avoid the same fate as this guy - sitting in lockup while I’m “covered”. …losing confidence in your organization…

Kayls Giles committed a heavily pre-planned and recorded attack on her estranged spouse. It shouldn’t be surprising to anyone that this was not covered as self-defense. It shouldn’t be surprising to anyone that this assault case was not covered as self-defense. Contrary to what you may be hearing from competitors, coverage in the Alan Colie case is not and was never denied. The insurance company, Universal Fire and Casualty Insurance Company (UFCIC) has been and continues to be in contact with Mr. Colie. Mr Colie is currently represented by an attorney whose fees are being paid for thanks to his USCCA Member benefits, and who is seeking an appeal.

If the attorney you chose was a public defender, that is on you! In USCCA you have the option to choose your attorney, and Mr. Colie chose his attorney, not USCCA. Research the backstory, and the truth becomes very clear.

@@BiggHoss you seem to be confused which makes sense considering you bought everything Heavy Duty Dummy served you. USCCA is a member platform that gives you training for self defense. With that, they, being USCCA, purchased an Insurance policy and members are added on to it. Kind like if you bought health insurance and added your kids to it. Does that make you insurance? No it doesn't. See how easy that is?

I think the issue is whether you would be cover if convicted or being dropped based on a technicality. If you lose your self-defense case are the expenses for that case still covered? The other question is if you happen to be in a place where you weren’t allowed to carry (unknowingly in some restricted area) or had a 12 round mag where you’re only allowed 10 would you still be covered?

Coverage ends with a conviction, which is defined in the policy as the final non-appealable entry by a court of an adjudication, judgment, order or ruling finding a party guilty of a crime. However, this does not include the “insured’s” “conviction” for a violation of a concealed carry or similar law. "Gun-free zones" by themselves are not an exclusion in the policy. If the weapon was possessed per FEDERAL LAW and all other terms and conditions of the policy were met, there would likely be coverage.

That really depends on the defendants statements at the time of, or shortly after the arrest. It is made very clear in CHL/LTC courses around the country, the responsibility of knowing when, where and how you can carry rest on the carrier. The ancient saying, "Ignorance is not a defense of the law!" shows precedence here. Much like many choose to carry without any sort of personal or professional training. And when the SHTF, they are slow, inaccurate and very dangerous. If I am travelling outside of my normal zone of residence (anywhere outside of Texas) I study the local laws to make sure I am not in violation. If I am not sure of the law, I will message attorneys with the entities I am a member of for clarification. If that does not satisfy my need, I avoid areas I am unsure of, or make the conscious decision to leave my firearm secured offsite until the required visit is completed. If you are traveling into a state with mag restrictions, you should have known that before you crossed state lines.

Why are you LYING to us? I am a USCCA member since 2017 until it expires next month. I am not renewing and went with Attorneys on Retainer. AOR claims that the prosecutors in the Colie case made a court filing to show the jury that Colie made a call to USCCA after the shooting and that he was denied coverage to use against him in the trial. The judge denied because the filing missed a deadline. But there is Colie, with a Public Defender. Did Colie make the call to USCCA? Why was he stuck with a Public Defender then? What good is the insurance if it is denied?

As a family, we were members with USCCA. One of our family was arrested for 'brandishing a firearm". I contacted USCCA, which referred us to a lawyer. Long story short, they were able to get the charges dismissed and our family member has a clean record. Excellent service and representation, and I highly recommend USCCA. It also puts out a first rate magazine.

I switched over to AOR myself after recent events and revelations in regard to USCCA. There's too much on the line for me to gamble whether or not my insurance company, who by the way is more expensive than AOR, does or does not like my case. AOR is up front and open about their coverage. I might not get a magazine each month anymore, but I have more peace of mind when I holster up for the day. Glad I never put that sticker on my truck.

There was never a denial of Mr. Colie’s claim, or denial that he acted in self-defense. Alan Colie is covered and always has been covered through his USCCA membership benefits. Tim Schmidt spoke to Mr. Colie and learned Mr. Colie chose the Loudoun County public defender that was assigned to him because he liked him and he thought he could help him. As a USCCA member, you get to choose the lawyer that you want.

I literally called you last week specifically on this matter because of a claim made by the KZbin channel "Heavy Duty Country". While discussing this matter with a woman from the contact department I was told that after all appeals that a convicted person can make and are still found guilty, Delta Defense would require that all cost for Defense would be paid back. I greatly appreciate this video, and maybe I'm either misunderstanding you or the woman I talked to. Could you please respond to which is true? I'm still covered with you and wish to continue. However, if I'm obligated to pay everything back because of a conviction, then I'm wasting my money! Please clarify.

USCCA about to loose a ton of "members" here is California with SB2. Yes it is pending lawsuit, but unfortunately for us CCW holders here in Commiefornia, we will have to live with SB2 until the supreme court rules on it. Back and Forth with USCCA reps and they all dance around the questions. "Will you cover me if I were to defend myself in a so-called California sensitive location?"

overzealous district attorneys charge people who use firearms in self-defense all the time. What use is the coverage if an out-of-control DA charges someone in that instance? You still haven't explained why Colie had a public defender and refuse to comment. While I can respect privacy and issues with commenting on ongoing cases, understand that without comment, all we have to go on is the facts... which don't look good for USCCA.

Exact numbers are private company information, but over the years thousands of USCCA Members have acted legally in self-defense and tens of millions of dollars have been paid out on their behalf by the insurance company to defend them.

Exact numbers would give the Loss Ratio which would tell you whether their service was even remotely worth the costs. I read the news about people being prosecuted for legal self-defense. I don't see any way that the costs could be even remotely close to the amount of money collected based on your publicly stated membership. Why should anyone believe your claims?

@@BurrowsNE According to their advertised membership numbers and assuming minimum payments for membership, they collect something over $500 million per year. The Loss Ratio is a number all insurance companies live by. Loss Ratio is Claims Paid divided by Premiums Collected. A typical Loss Ratio for legitimate insurance companies is about 67%. That is, for every dollar of premium collected, the company expects to pay out about 67 cents in claims. Based on their advertised membership and costs of membership they should be paying out at least $350 million PER YEAR in claims. That is far more than "tens of millions" over many years. By this time, they should be bragging about paying BILLIONS in claims. A quick look at the news will show that there are not enough self-defense claims per year that $350 million per year in payouts would even be possible. As one example, California had four shootings by concealed carry holders in 2023. NONE of them resulted in a criminal prosecution. I showed their policy to a friend who was an insurance consultant to major corporations for decades. He laughed out loud when he read it. The number of claims they would have would be so tiny that I doubt they even have a real claims department. If anyone had a claim then they would find out what the policy really says.

Tim you've been called out and are avoiding critical questions. Which means your being deceptive. I am cancelling my membership immediately and what I recommend is having a 2A attorney on retainer would be the best for anyone in a self defense situation. You have a lot of good stuff within your company but the so called insurance part is BS. God bless

All successful insurers use logic to sell, then when time comes to cover the client they Deny, Deflect and Delay. 3. If there was other services allowed to cover me in my area I would have USCCA. Let’s put it this way, there has been way to many people that are customers like the most recent individual in your monthly magazine, who have spent any amount of time in jail. We pay you so that doesn’t happen. Not one day and certainly not over a year. And probably the biggest reason why I will leave as soon as I can find a better program is Tim Kennedy. Flat out his service aside, that man literally stand for and believes in two different things depending on who he is talking with and who is paying the bill. USCCA: all about 2A and our rights. Some podcast or behind closed doors: only people like him should have “weapons of war”. Not the type of people I want representing a company I use for my legal protection or my families. Same reason why I won’t buy, or use anything 5.11.
